Salisbury Street Raleigh, NC 27604 Re: Stoneridge Estates Subdivision (formerly Malik Property) Request for NWP 3 & GC 4132 USACE Action ID: 2018-01267 NCDWR Project # RRO 18-179 Sage Project # 2017.78 On behalf of Stephen & Kathleen Malik (applicants and owners) please find attached the complete application and supplemental information requesting written concurrence from the US Army Corps of Engineers (USACE) and North Carolina Division of Water Resources (NCDWR) that the activities associated with the proposed residential development may proceed under Nationwide Permit (NWP) 3 and General Certification (GC) 4132. Project Purpose and Location The purpose of the proposed Stoneridge Estates Subdivision (Project) is to construct a residential subdivision with associated utilities to meet the demand for housing in this area of Raleigh. In addition to the construction of the residential development, maintenance on an existing pond will be completed. The pond's failing dam will be repaired and sediment will be removed from the pond. The Project is located northwest of the intersection of Stoneridge Drive and Ebenezer Church Road in Raleigh (Wake County), NC. The coordinates of 35.8311520N, 78.718785°W, generally correspond to the center of the Project. :rt -. toraeri ge Estates Subdivision Project Detail The 16.98 -acre Project is a proposed single-family residential subdivision with 27 proposed residential lots. There are no proposed impacts directly Proposed impacts will result from the maintenance of an existing pond and its dam. The dam has numerous trees of various sizes growing on it. The roots from the trees have begun to create leaks in the dam and are compromising the structural integrity of the dam creating a safety hazard. The pond will be pumped down, the trees on the dam removed, and the dam reconstructed in its existing location. Existing accumulated sediment within the pond footprint will also be removed at this time. New pond inlet and outlet structures will be installed and the emergency spillway will be replaced. Heavy equipment typically used for construction projects (e.g. back hoes, bull -dozers, etc) will be utilized. No recorded federally listed species are recorded as being located on the project site. An occurrence of Michaux's sumac is documented within a 1 -mile radius according to the NC Natural Heritage Data Base (see attached report). The project area is heavily wooded. Habitat for Michaux's sumac was not found to exist within the proposed development footprint. The Project will require the removal of trees but not within jurisdictional areas. No bridge maintenance or removal is required. No wind turbines are proposed on the Project. Blasting is not proposed for this project unless shallow rock is unexpectedly encountered. According to the SHPO website, no documented structures are located within the Project area. A recorded structure, Cooks Mill Dam (WA -3714), is recorded as being located approximately 0.3 -mile due west of the Project. Project History The project area appears to have been wooded since at least 1981. Sage completed a delineation of wetlands, streams, and riparian buffers on June 6, 2018. A site meeting was held with the NCDWR on June 27, 2018 and a stream and buffer determination letter (NBRRO #18-179) was issued on June 28, 2018. A copy of the NCDWR letter is attached. A site meeting with the USACE was held on June 26, 2018 and a PJD (Action ID: 2018- 01267) issued on December 10, 2018. Avoidance and Minimization The site plan proposes large lots along a single proposed road. No road or other utility crossing impacts are proposed within wetlands, steams, or riparian buffers on the project. Open space is planned in the northern corner of the project area as well as in the areas between the primary drainage on Project and Ebenezer Church Road. Project Impacts No wetland, stream, or riparian buffer impacts are proposed. Proposed temporary surface water impacts will result from the draw down of the pond (required for the dam maintenance) and from the removal of sediment within the pond. The pond's surface area is 0.953 acre. No other impacts are proposed. Mitigation No wetland, stream, or riparian buffer impacts are proposed therefore no mitigation is proposed.
