Ellison Page 2 PROJECT DESCRIPTION: The project site is located at 2223Middle Sound Loop Road, adjacent to the Atlantic Intracoastal Waterway (AIWW) and Middle Sound, in New Hanover County. To locate the property from Market Street (NC Highwayl 7), turn onto Middle Sound Loop Road and turn right at Ogden Elementary School. Travel east approximately 2.5 miles and tl~e property of interest will be located on the right. The lot is approximately 5.45 acres with approximately 300' of shoreline frontage. The lot averages 20 feet above mean sea level and the shoreline is stabilized by vegetation. The applicant maintains asingle-family residence. The highground vegetation consists primarily of live oak, and lawn brass. Waterward ofthe applicant's shoreline there was an existing boat basin and access channel to the Atlantic Intracoastal Waterway (AIWW). On June 23, 1952, the applicant's adjacent property owner was issued a permit (#?~-~?_ cope attached) from the Wilmington District Army Corps of Engineers, authorizing the excavation of the original basin/channel. The authorized project dimensions, at that time, were a 650 feet long and 50 feet wide (approximate), with a bottom depth of 4.5 feet at mean low water (MLW). The applicant's adjacent riparian property owner was also issued a CAMA Major and Dredge and Fill permit No. 37-00 on March 8, 2000 for the maintenance excavation of the basin and access channel. State Permit No. 37-00 expired on December 31, 2003. The dimensions of the authorized maintenance excavation of the basin was 80' in length by 40' in width, to a depth of-4' @MLW. The access channel authorized dimensions were 260' in length by 20' in width, to a depth of--4' @MLW. There is an existing private docking facility located within the southern side of the basin that is used by the adjacent riparian property owner to the south (See Sheet 1). There is a border of coastal wetlands, varying between 3~ feet wide in the area of the old basin. to X00 feet ~~ icle adjacent to both sides ofthe old basin and access channel. This area is both marsh and inter-tidal mud tlats. The marsh consists of smooth cordgrass (Spartina alterniflora) which transitions to high coastal marsh adjacent to the highground. This high marsh consists of intermixed Spike Grass (Distichlis spicata),~Sea Lavender (Limonium, spp.)~ Salrivort (Salicornia, spp.), Sea Oxeye (Borrichia frutescens), and Salt Meadow Grass (Spartina patens) that transition to occasional shrubs, marsh elder (Iva frutescens), grounsel-bush (Baccharus halimifolia) and wax myrtle (Mvrica cerifera) along the marsh's interface with the mowed lawn grass. The New Hanover County Land Use Plan classifies adjacent waters as Conservation, and the adjacent hi;h wound portion ofthe project area as Resource Protection. PROPOSED PROJECT: The applicant proposes to perform maintenance excavation of an existing boat basin and construction of a new pier, platform and floating dock adjacent to the AIWW. Excavation of the basin would be accomplished by barge mounted mechanical excavator. Excavated material would be placed on the applicant's highground property adjacent to the basin and would be contained behind silt fencing. Upon drying. the spoil material would be utilized as backfill for a proposed 80 linear foot wooden bulkhead along the shoreline. The applicant proposes to construct a private pier measuring 50' in length by 6' in width, which would extend towards the Al W W along the northern side of the basin. The pier would terminate in a gazebo measuring 16' in length by 16' in width. An access ramp would then lead onto a floating dock measuring 76' in length by 6' in width, which would run parallel to the edge of the northern side of the basin. Due to the water depth at this location, the application states that the floating dock would be designed to remain fixed 12" above the substrate and allowed to float at higher tides. ANTICIPATED IlVIPACTS: The proposed dredging would result in the excavation of approximately 800 sq. ft. of shallo~~ bottom. Shirt tcrnt increases in turbidity can be expected during dredging activity. The excavation of the basin by mechanical means ~-~ i I I create steep side slopes and subsequent sloughing, there by increasing the top width dimensions of the proposed project. Approximately 178 cubic yards of material ofspoils material would be generated from the project and placed on the highground portion of the applicant's yard and then utilized for backfill for the proposed bulkhead. The bulkhead would impact 1,600 sq. feet of highground for the proposed backfill and the tie back anchor s}stem. The proposed pier system construction would incorporate 712 sq. ft. of Estuarine Waters and Pubic Trust Area and 210 sq. feet of Coastal Wetlands due to shading. Minor increases in turbidity should be expected during construction. The proposed pier would extend approximately 100 feet into a waterbody which measures approximately 600 feet across, which would conform with the 1/4 width rule and the established pier lengths. The proposed structures would not encroach into the adjacent riparian corridor 15 foot setback and into the 80-foot setback from the AIWV4'. We are proposing the maintenance dredging of a 10' x 80' section of an existing boat basin. The original permit dated June 9, 1952 allowed removing approximately 5000 cubic yards of material from a 50' wide channel. On March 8, 2000 permit #37-00 was issued for maintenance dredging to Elsie W. Kelly's adjoining property. At that time, the homeowners did not want to dredge in front of their property at 2223 Middle Sound Loop Rd., so only a 40' x 80' basin was excavated. However, the current owners would like to utilize their property and have the protection from boat traffic that the basin offers. We are proposing a 6' x 50' stationary pier, 6' x 76' floating dock (to accommodate 3 vessels) and 80' of high ground bulkhead, to keep the dredged material contained. This design allows for fewer disturbances than a 400' pier would cause and leaves less to be damaged during a hurricane. The primary purpose /use for this dock and dredge is to allow the homeowner to access the water for recreational purposes.
