The site currently serves as a wastewater treatment facility, Mich covers approximately 2.8 acres of the site. The remainder of the site is wooded. Two bottomland hardwood forest
wetland fingers encroach into the property from the south. Residential is the general land use in the surrounding area. Please see attached aerial photo and site plan, for existing
conditions.

The purpose of this project is to construct a newwastewater treatment facility, as well as a new access road, that meets Onslow County Fire and EMS design criteria, on the property.
4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
This project involves the construction of a newwaste water treatment plant (WWTP) and the disassembly of the old WWTP, as well as the construction of a new access drive into the
new WWTP. Clean earthen fill will be placed within the wetlands, at Impact Area A, which will serve as the road base of the newaccess road. Impact Area B will also be filled, with clean
earthen fill that is excavated from the proposed tank locations. The fill is necessary to provide adequate maintenance area around the plant, as well as stability of the slope once the
plant has been completed. Culverts and/or stormwater ponds are not proposed as part of this project. Large machinery, such as dump trucks, backhoes and front end loaders will be
used to complete the work.

1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
During the design phase, the Applicant's engineer designed the turning radius of the road to be as low as possible, while allowing fire and EMS
vehicles to utilize the access drive, and is utilizing 3:1 or slightly less, which is required to ensure stability of the banks, rather than flatter slopes.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Prior to land disturbance,the wetlands will be clearly marked and silt fence installed along the wetland bound line and limits of impact, to help ensure
sediment is not discharged into the resources. Additionally, S&EC measures will be installed to collect construction stormwater before discharging into
downstream receiving waters. Lastly, the S&EC measures will be inspected at least once
a week and after a rain event that produces > or = to 0.50" of
rainfall within a 24 hour period.

Most of the project area has been cleared of woody vegetation. Cutting of trees will only take place in areas where the wetland impacts are proposed.
SEG utilized the NC Natural Heritage Program (NHP) to investigate the potential for adverse impacts to ES or DCH. The US Fish and Wildlife IPaC
system is not operating due to the government shutdown. A copy of the NHP species list will be forwarded upon receipt.

The project is located at 250 Zachary Lane, in Hubert, Onslow County, NC (lat/long: 34.50371/-77.20206) and consists of
replacing old infrastructure with new infrastructure. In order to facilitate the proposed work, two areas of bottomland
hardwood forest, totaling 0.30 -acre, need to be filled. The wetland impact areas are forested, while the remainder of

F. JURISDICTIONAL DETERMINATION (JD) TYPE (Select One)

A Preliminary Jurisdictional Determination (PJD) provides an indication that there may
be "waters of the United States" or "navigable waters of the United States"on a property.
PJDs are sufficient as the basis for permit decisions. For the purposes of permitting, all
waters and wetlands on the property will be treated as if they are jurisdictional "waters of
the United States". PJDs cannot be appealed (33 C.F.R. 331.2); however, a PJD is
"preliminary" in the sense that an approved JD can be requested at any time. PJDs do
not expire.
❑ I am requesting that the Corps provide an approved JD for the property identified herein.
An Approved Jurisdictional Determination (AJD) is a determination that
jurisdictional "waters of the United States" or "navigable waters of the United
States" are either present or absent on a site. An approved JD identifies the limits of
waters on a site determined to be jurisdictional under the Clean Water Act and/or
Rivers and Harbors Act. Approved JDs are sufficient as the basis for permit
decisions. AJDs are appealable (33 C.F.R. 331.2). The results of the AJD will be
posted on the Corps website. A landowner, permit applicant, or other "affected
party" (33 C.F.R. 331.2) who receives an AJD may rely upon the AJD for five years
(subject to certain limited exceptions explained in Regulatory Guidance Letter 05-
02).

■ Isolated waters, waters that lack a significant nexus to navigable waters, or non -
jurisdictional upland features should be identified as Non -Jurisdictional. Please
include a justification in the label regarding why the feature is non jurisdictional (i.e.
"Isolated", "No Significant Nexus", or "Upland Feature"). Please include the acreage
or linear length of these features as appropriate.
For Preliminary Jurisdictional Determinations:
■ Wetland and non -wetland features should not be identified as Jurisdictional, 404,
Waters of the United States, or anything that implies jurisdiction. These features can be
identified as Potential Waters of the United States, Potential Non -wetland Waters of
the United States, wetland, stream, open water, etc. Please include the acreage and
