Subject: Notice of Deficiency (NOD -2019 -PC -0028)
Failure to Properly Implement the Pretreatment Program
Program: Town of Troy (NPDES Permit No. NC0028916); Montgomery County
Dear Mr. Dennis:
The Division of Water Resources (DWR) has determined that the Town's Pretreatment Program has
failed to meet the minimum requirements as specified in 15A NCAC 2H.0900 and 40 CFR 403.8(f).
Specifically, the Town has failed to require Wrights Foods submit a completed industrial user permit
(IUP) application to the POTW prior to their IUP expired in August 1, 2018 and has failed to take
appropriate enforcement action against the industry.
According to the Town of Troy's Sewer Use Ordinance (SUO) Section 4.2(I), significant industrial user shall
submit a complete permit application at least 180 days prior to the expiration of the existing permit. The
IUP, Part ll, General Condition No. 23 also requires the SIU to apply for renewal as least 180 days prior to
the IUP expiration date.
To prevent further enforcement action, perform the following actions by the indicated due date:
1. Respond in writing by February 22, 2019, addressing the causes of noncompliance and all actions
that will be taken to prevent the recurrence of similar situations.
