Project Setting The property proposed for development is located at 40081 Harbor Road in Avon, and consists of .37 acres on the northeast corner of Avon Harbor adjacent to the Pamlico Sound. The site is a mostly vacant lot with 200 feet of shoreline that is bulkheaded with an old historic fish house and decks on the waterfront that was built in 1950. The adjacent property to the south also contains an old fish house on the waterfront and the property to the Northwest is a vacant lot. Both of the adjacent lots are privately owned. Vegetation on the site includes, but is not limited to, indigenous yard grass and Salt Meadow Cordgrass (Spartina patens). Soil Types include, but are not limited to, Psamments (PsB). Also, the water classification for this site is Tidal Salt Water (SC) and High Quality Waters (HQW) and has a maximum depth of 6 feet. There is no submerged aquatic vegetation on the site. The property has an elevation of 4 feet above Normal Water Level (NWL). Development Proposal The applicant proposes to reconstruct the 38 foot by 16 foot historic fish house and decking around the fish house and install a gutter system to keep runoff out of the waterway. The applicant also proposes to construct 4 new finger piers that are 13 foot long with 3 foot at the base tapering down to 1 foot at the end. Also, the applicant proposes to dredge a 29 foot by 9.7 foot section of the harbor in the Northwestern corner near the bulkhead to a depth of 4 feet and move the previously proposed boat lift to the south end of the lot. The water depth at the terminus of the proposed piers is 6 feet. Anticipated Impacts The proposed development of the four 13 foot finger piers will result in the shading of 104 square feet of Estuarine Waters and Public Trust Areas of environmental concern. The proposed development of the 29 foot by 9.7 foot dredge area will result in the removal of 281.3 square feet of shallow bottom in Estuarine Waters and Public Trust Areas of environmental concern and filling of 706.9 square feet of Estuarine Shoreline. Temporary water turbidity will occur during pier construction and dredging. The 38 foot by 16 foot reconstruction of the historic fish house will not increase the shaded area in the Public Trust Shorelines Area of environmental concern. The project has had a fairly substantial amount of work and progress already completed. The bulkhead, mooring piles and site work has been started and partially completed. The house construction has been set back due to some monetary constraints as well as hurricane damage. These issues are being resolved and the project is now continuing. 2- The project will not be completed before the current expiration date due to stated issues. 3- There have been no modifications or changes approved since the issuance of permit. 4- There has been no change of ownership since issuance of permit. 5- The project is in compliance of all conditions of the current permit. All building regulations will be In compliance. New finger piers will be built using the existing mooring pilings. Dredging to remove shoaling and to increase the water depth will be done in the north area of the basin. A boat lift will be built in the south boat slip on the south side of the building. The building has substantial damage from the last several hurricanes and is in disrepair. The west side, east side and roof are beyond salvage. The concrete floor is broken up and caving in in several locations. The building is unsafe and the replacement would be beneficial for myself and the community.
