Durham continues to use the team approach for implementation of the City's Industrial Pretreatment Program (IPP). The Industrial Waste Control Administrator is Gerald Tyrone Battle who has oversight of the planning and implementation of the program. Two full time technicians are dedicated to the Industrial Waste Control (IWC) Division. They provide sampling and equipment maintenance among other tasks to insure that all requirements of the program are met. Sample analyses are provided by the City of Durham's state certified Laboratory Services Program. Both the IWC and the Lab Services Programs are located at the South Durham Water Reclamation Facility. The programs are under the management of Ms. Vicki Westbrook, Assistant Director, City of Durham, Department of Water Management. The City of Durham's pretreatment program currently has 13 Significant Industrial Users (SIUs). The North Durham Water Reclamation Facility (NDWRF) basin has 9 SIUs, including 4 Categorical Industrial Users (CIUs), and the South Durham Water Reclamation Facility (SDWRF) basin has 4 SIUs which includes 1 CIU. During this reporting period: ➢ AWNC (Permit #1011) was in Significant Noncompliance (SNC) for the monthly average of Zinc for the second semi-annual period of 2015. Per statute, the SNC was published in the Durham Herald Sun. The scenario was detailed in the 2015 PAR. AWNC and the City of Durham entered into a Consent Order April 2016. Provisions of the Order include a timetable and course of action, monthly updates, interim limits with violation penalties and the expectation of the installation of the proper pretreatment unit to address each of AWNC's wastestreams. The expiration date of the Order was extended until June 30, 2017. The Consent Order is attached immediately following this Narrative (Attachment 1). Civil penalties were collected and are reflected in the Pretreatment Performance Summary (PPS). There have been no violations since the installation of the new unit. An Authorization to Construct (A to C) was issued and the cost of the unit and installation was in excess of $1,250,000.00. ➢ Coca Cola (Permit #1012) submitted certification letters stating they have no process waste discharge. Therefore, no Industry Data Summary Form (IDSF) is present. They are scheduled for a permit renewal in 2018 but have petitioned to be dropped as an SIU. They plan to maintain their status as a City of Durham 2017 PAR Page 1 distribution warehouse and have no intention of returning to the bottling process. Their request will be assessed in the near fixture. ➢ Freudenberg Performance Materials (Permit #1021) was issued a permit renewal that included the addition of an acceptable pH range. ➢ Angelica Textile Services (Permit #2015) received a permit modification to reflect a change in ownership as well as changing the name to Angelica. There were also changes to the language pertaining to flow. Angelica received an Authorization to Construct for the installation of an effluent flow meter. The cost associated was $30,377.00. VIOLATIONS: In 2017, three industries were issued Notices of Noncompliance or Violation (NNC and NOV). They are AWNC, bioMerieux and Angelica. The violations are detailed as follows: AWNC ➢ The monthly average limit for BOD is 3,000 mg/L. The Technical Review Criteria (TRC) limit is 4,200 mg/L. The November 2016 monthly average was 3,077 mg/L. It exceeded the monthly limit of 3,000 mg/L; not the TRC criteria. ➢ The BOD daily maximum and monthly average limits are 4,000 and 3,000 mg/L respectively. The Technical Review Criteria (TRC) limits are 5,600 and 4,200 mg/L. The February 21, 2017 result was 4,250 mg/L. This result violates the chronic daily maximum limit. The February monthly average was 3,925 mg/L. It violates the chronic monthly limit. ➢ The BOD daily maximum and monthly average limits are 4,000 and 3,000 mg/L respectively. The Technical Review Criteria (TRC) limits are 5,600 and 4,200 mg/L. The April 12 and 13, 2017 results were 6,850 and 4,650 mg/L respectively. The former result violates the chronic and TRC limits. The latter violates the chronic daily maximum limit. The April monthly average is 5,750 mg/L. It violates the chronic and TRC monthly limits. ➢ Per the Consent Order signed April 2016, the daily maximum and monthly average limits for Total Oil and Grease are 900 and 700 pounds respectively. The TRC limits are 1260 and 980 pounds respectively. During November 2016, the results in pounds were: November 1 — 489.3 November 4 — 587.4 November 8 — 961.8 November 9 —1,038.2 City of Durham 2017 PAR Page 2 Monthly Average — 769.2 As indicated by the bold, November 8 and 9 are daily violations and the monthly average was violated as well. These are chronic violations; at this time, there are no TRC violations. ➢ Per the Consent Order signed April 2016, the daily maximum and monthly average limits for Total Oil and Grease are 900 and 700 pounds respectively. The TRC limits are 1260 and 980 pounds respectively. During February 2017, the monthly average in pounds was 745.8. This result was a chronic violation of the Consent Order monthly average for Total Oil and Grease. ➢ Per the Consent Order signed April 2016, the daily maximum and monthly average limits for Total Oil and Grease are 900 and 700 pounds respectively. The TRC limits are 1260 and 980 pounds respectively. During April 2017, the results in pounds were: April 12 —1,056.0 April 12 — 889.7 April 13 — 779.1 April 13 — 829.1 Monthly Average — 888.5 As indicated in bold, one of the April 12 samples was a daily violation and the monthly average was violated as well. These are chronic violations. ➢ Per the Consent Order signed April 2016, "Upon start up and refinement of the pilot pretreatment program(s), AWNC will collect compliance samples for Zinc and Oil and Grease once per week and submit the results from a NC Division of Water Resources certified laboratory to the City for compliance judgment for the duration of the pilot program.... Sampling will not be required in the periods prior to and during installation and fine tuning of the pilot and permanent pretreatment system(s)." The system was running consistently for the last five weeks of the Consent Order which expired June 30, 2017. The flows on October 17 and October 20 were 140,877 and 146,004 gallons respectively. These results violate the daily maximum limit. Additional compliant data has been submitted. Angelica ➢ The daily maximum for flow is 150,000 gallons (150 MGD). The flow during the July 11, 2017 POTW sampling event was 184,539 gallons. This result violates the daily maximum limit. Additional compliant data has been submitted. SIGNIFICANT NONCOMPLIANCE (SNC): There were no instances of significant non-compliance (SNC) during this reporting period from January 1, 2017 to December 31, 2017. City of Durham 2017 PAR Page 5 Attachment 1 North Carolina City of Durham In the matter of the City of Durham Significant Noncompliance - Zinc Discharge Permit No. 1011 Held by AW North Carolina, Inc. CONSENT ORDER Pursuant to Chapter 26, Article IV, Sections 70-341(2) and 70-343 of the City of Durham Code of Ordinances, this Consent Order is made effective the I" day of April 2016 between AW North Carolina, Inc. (hereinafter referred to as "AWNC"), and the City of Durham, North Carolina (hereinafter referred to as "the City"). A. STATEMENTS: 1. AWNC holds Industrial Discharge Permit No. 1011 (the "Industrial User Pretreatment Permit" or "IUP Permir') and discharges into the City's sewer collection system and publicly owned treatment works CTOTW') (said discharge to be referred to hereinafter as the "AWNC discharge"). 2. The City issued a Notice of Noncompliance (NNC) to AWNC dated December 16, 2015 stating that AWNC exceeded its monthly average limit for Zinc for the months of September and October 2015 imposed under the IUP Permit. The same NNC stated that the daily limit and monthly average for Oil and Grease were also violated in October 2015. 3. The City issued to AWNC a second Notice of Noncompliance, dated February 5, 2016, stating that on certain occasions AWNC exceeded its daily maximum and monthly average limits for November and December 2015 imposed under the IUP Permit (these two Notices of Noncompliance hereinafter referred to as the "NNCs") for Zinc. The same NNC stated that the daily limit for Oil and Grease was also violated in December 2015. The City issued to AWNC a Notice of Violation — Significant Noncompliance (NOV-SNC) dated February 22, 2016 that detailed the SNC for Zinc for AWNC for the second semi-annual period of 2016 (July 1, 2016 — December 31, 2016). B. Whereas the goal is for immediate action to return AWNC to continuous compliance, AWNC and the City hereinafter stipulate and agree as follows: The City shall, at this time, waive any fine(s) associated with SNC with the directive that those monies go towards resolution and under the condition that AWNC adheres to the terms below as well as those outlined in the February 22 NOV-SNC. AWNC Consent Order - 2016 Page I of 3 2. As required, AWNC submitted a formal plan to this office within 14 days of receipt of the February 22 NOV-SNC. The NOV-SNC required the following (the completed items based on AWNCs letter of response (attached) are marked (completed): a. timetable that will not exceed 60 days between milestones - completed b. short term and long term solutions - completed c. Explanation of transitional period between running of the pilot study unit and installation of a permanent solution. d. AWNC must submit updates every 30 days (beginning 30 days after date of submittal of plan) e. All plans must be reviewed by this office prior to implementation. f. This department must review and approve any construction, i.e., issue formal Authorizations to Construct or other approval, prior to the initiation/implementation, AWNC shall conduct an assessment to determine all zinc usage at the facility. If identified, AWNC will propose practicable methods of conservations and/or removal of such zinc as may be necessary and practicable. Findings and plan of action shall be submitted to the City under separate letter on or before May 3, 2016. 4. Interim fUP Permit Limits for zinc for the duration of this order shall be as follows: a. Daily Maximum — 7.00 mg/L b. Monthly Average — 5.00 mg/L 5. Interim IUP Permit Limits for Oil and Grease for the duration of this order shall be as follows: C. Daily Maximum — 900 pounds d. Monthly Average — 700 pounds 6. POTW sampling will continue per the Industrial User Permit at a frequency of not less than 4 events / calendar quarter. The results of such monitoring shall be subject to Interim Limits set forth in sections 4 and 5 of this Consent Order. Upon start up and refinement of the pilot pretreatment program(s), AWNC will collect compliance samples for Zinc and Oil and Grease once per week and submit the results from a NC Division of Water Resources certified laboratory to the City for compliance judgment for the duration of the pilot program. The results of such monitoring shall be subject to Interim Limits set forth in sections 4 and 5 of this Consent Order. AWNC Consent Order - 2016 Page 2 of 3 8. Sampling will not be required in the periods prior to and during installation and fine tuning of the pilot and permanent pretreatment system(s). It is the expectation of the City that Industrial Waste Control will be contacted in advance of these instances of installation and fine tuning for confirmation. Email will satisfy this requirement. 9. The agreed upon penalty for a violation of any of the terms of this agreement, including Interim Limits and milestones of the Consent Agreement for the duration of the Consent Agreement, is $100 per day per violation. 10. AWNC and the City further agree that in the event any provision or requirement of this Consent Order conflicts with any provision or requirement of the IUP Permit, then the provision and requirements of this Consent Order control (until the time this Consent Order expires). 11. The expiration of this Consent Agreement is May 1, 2017. If unforeseen circumstances force AWNC beyond the May 1, 2017 expiration date, it is the sole responsibility of AWNC to request in writing an extension from the City at which time the City will evaluate feasibility. Submittal of the request does not guarantee an extension. 12. All reports and information submitted to the City will preserve, as may be necessary, the protection afforded to AWNC's business confidential or proprietary information as allowed under Division 7 of the City of Durham Sewer Use Ordinance and the Public Records Act. 13.
