ECS Southeast, LLP (ECS) would like to submit this request for buffer authorization for the
Peake Road Farm site. The Peake Farm Road site is located on Peake Road in Oxford,
Granville County, North Carolina. ECS is submitting this request on the behalf of Strata Solar
LLC.
Background
ECS previously conducted a wetland and stream delineation for the original Project Study Area
(PSA) on April 10, 2017. The original PSA was verified by the United States Army Corps of
Engineers (USACE) under SAW -2017-01760 on August 22, 2017 and by the North Carolina
Department of Water Resources (NCDWR) under TPRRO #17-169 on August 1, 2017. A copy
of this correspondence is attached.
Additionally, ECS conducted a wetland and stream delineation for the additional PSA on March
7, 2018. The additional PSA was verified by the USACE under SAW -2017-01760 on October 4,
2018. ECS received email correspondence from NCDWR on March 21, 2018 indicating that
riparian buffers apply to the stream on the additional PSA. A copy of this correspondence is
attached.
The project consists of developing the site with a solar power generating facility. A medium
voltage line will be connected from the solar array field back to Old NC 75 where the tie in to the
power grid system is located. Hand clearing will take place within the buffer areas, and the
medium voltage line will be bored beneath the streams. A vibratory plow will be utilized to bury
the medium voltage line from Old NC 75, through stream buffer areas, and outside of stream
areas.
Initially, the medium voltage line was proposed to be bored under both the stream buffer areas,
and streams. Due to shallow depths to rock encountered in the buffer areas, boring under both
the buffers and streams together was determined to be unfeasible. Subsequently, installation of
the medium voltage line was proposed as aerial overhead lines; however, Granville County
considered the overhead lines in their height restrictions of 15 feet, which is not feasible.
Therefore, hand clearing and installation of the medium voltage line is proposed via a vibratory

plow within the buffer. No impacts to the streams are proposed, as the line will be bored
underneath. The buffer impacts will be temporary. The trench will be backfilled after installation
and the area will be left to regrow.
All construction will be conducted in accordance with NCDWQ standards. All temporary erosion
control measures shall be maintained throughout the construction process. Additional erosion
control measures and/or modifications will be utilized as necessary during the construction
process.

Location description: The site is located approximately 3,000 feet northeast of the Peake Road, Harper Renn Road
intersection, in Granville County, North Carolina and is identified as the Peak Farm Road Site (See attached map).

X There are waters, including wetlands, on the above described project area, that may be subject to Section 404 of
the Clean Water Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC §
403). The waters, including wetlands, have been delineated, and the delineation has been verified by the Corps to
be sufficiently accurate and reliable. Therefore this preliminary jurisdiction determination may be used in the
permit evaluation process, including determining compensatory mitigation. For purposes of computation of
impacts, compensatory mitigation requirements, and other resource protection measures, a permit decision made
on the basis of a preliminary JD will treat all waters and wetlands that would be affected in any way by the
permitted activity on the site as if they are jurisdictional waters of the U.S. This preliminary determination is not
an appealable action under the Regulatory Program Administrative Appeal Process (Reference 33 CFR Part 331).
However, you may request an approved JD, which is an appealable action, by contacting the Corps district for
further instruction.

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in the
review area, and the requestor of this PJD is hereby advised of his or her option to request
and obtain an approved JD (AID) for that review area based on an informed decision after
having discussed the various types of JDs and their characteristics and circumstances when
they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a Nationwide
General Permit (NWP) or other general permit verification requiring "pre- construction
notification" (PCN), or requests verification for a non -reporting NWP or other general permit,
and the permit applicant has not requested an AJD for the activity, the permit applicant is
hereby made aware that: (1) the permit applicant has elected to seek a permit authorization
based on a PJD, which does not make an official determination of jurisdictional aquatic
resources; (2) the applicant has the option to request an AID before accepting the terms and
conditions of the permit authorization, and that basing a permit authorization on an AID could
possibly result in less compensatory mitigation being required or different special conditions;
(3) the applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can accept
a permit authorization and thereby agree to comply with all the terms and conditions of that
permit, including whatever mitigation requirements the Corps has determined to be necessary;
(5) undertaking any activity in reliance upon the subject permit authorization without
requesting an AID constitutes the applicant's acceptance of the use of the PJD; (6) accepting a
permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in
reliance on any form of Corps permit authorization based on a PJD constitutes agreement that
all aquatic resources in the review area affected in any way by that activity will be treated as
jurisdictional, and waives any challenge to such jurisdiction in any administrative or judicial
compliance or enforcement action, or in any administrative appeal or in any Federal court;
and (7) whether the applicant elects to use either an AID or a PJD, the JD will be processed
as soon as practicable. Further, an AID, a proffered individual permit (and all terms and
conditions contained therein), or individual permit denial can be administratively appealed
pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to
make an official determination whether geographic jurisdiction exists over aquatic resources
in the review area, or to provide an official delineation of jurisdictional aquatic resources in
the review area, the Corps will provide an AID to accomplish that result, as soon as is
practicable. This PJD finds that there "may be" waters of the U.S. and/or that there "may be"
navigable waters of the U.S. on the subject review area, and identifies all aquatic features in
the review area that could be affected by the proposed activity, based on the following
information:

Location description: Note that this is for the expansion of a preliminary iurisdictional determination that was issued for a
larger and adiacent proiect area by the USACE on 8/22/2017 under the same Action ID. The overall proiect area has been
increased by six acres through a linear corridor that extends from the original proiect area west to Old NC 75. The additional
proiect area for this iurisdictional determination is a linear corridor which is displaved as a bold purple polvgon labeled
"Additional Proiect Site Boundarv" on the attached man entitled "Figure 6: GPS Flagging Location Man." The additional
roiect area is located in Granville County, North Carolina.
Indicate Which of the Following Apply:
A. Preliminary Determination
® There appear to be waters on the above described project area/property, that may be subject to Section 404 of the Clean Water
Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). The waters have been
delineated, and the delineation has been verified by the Corps to be sufficiently accurate and reliable. The approximate boundaries
of these waters are shown on the enclosed delineation map dated 3/16/2018. Therefore this preliminary jurisdiction determination
may be used in the permit evaluation process, including determining compensatory mitigation. For purposes of computation of
impacts, compensatory mitigation requirements, and other resource protection measures, a permit decision made on the basis of a
preliminary JD will treat all waters and wetlands that would be affected in any way by the permitted activity on the site as if they
are jurisdictional waters of the U.S. This preliminary determination is not an appealable action under the Regulatory Program
Administrative Appeal Process (Reference 33 CFR Part 331). However, you may request an approved JD, which is an appealable
action, by contacting the Corps district for further instruction.
❑ There appear to be waters on the above described project area/property, that may be subject to Section 404 of the Clean Water
Act (CWA)(33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). However, since the waters
have not been properly delineated, this preliminary jurisdiction determination may not be used in the permit evaluation process.
Without a verified wetland delineation, this preliminary determination is merely an effective presumption of CWA/RHA
jurisdiction over all of the waters at the project area, which is not sufficiently accurate and reliable to support an enforceable
permit decision. We recommend that you have the waters on your project area/property delineated. As the Corps may not be able
to accomplish this wetland delineation in a timely manner, you may wish to obtain a consultant to conduct a delineation that can
be verified by the Corps.
B. Approved Determination

requirements of Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403) and Section 404 of the Clean Water Act

a period not to exceed five years from the date of this notification.

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in the review
area, and the requestor of this PJD is hereby advised of his or her option to request and obtain an
approved JD (AJD) for that review area based on an informed decision after having discussed the
various types of JDs and their characteristics and circumstances when they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a Nationwide General
Permit (NWP) or other general permit verification requiring "pre- construction notification" (PCN), or
requests verification for a non-reporting NWP or other general permit, and the permit applicant has
not requested an AJD for the activity, the permit applicant is hereby made aware that: (1) the permit
applicant has elected to seek a permit authorization based on a PJD, which does not make an official
determination of jurisdictional aquatic resources; (2) the applicant has the option to request an AJD
before accepting the terms and conditions of the permit authorization, and that basing a permit
authorization on an AJD could possibly result in less compensatory mitigation being required or
different special conditions; (3) the applicant has the right to request an individual permit rather than
accepting the terms and conditions of the NWP or other general permit authorization; (4) the applicant
can accept a permit authorization and thereby agree to comply with all the terms and conditions of that
permit, including whatever mitigation requirements the Corps has determined to be necessary; (5)
undertaking any activity in reliance upon the subject permit authorization without requesting an AJD
constitutes the applicant's acceptance of the use of the PJD; (6) accepting a permit authorization (e.g.,
signing a proffered individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a PJD constitutes agreement that all aquatic resources in the review area
affected in any way by that activity will be treated as jurisdictional, and waives any challenge to such
jurisdiction in any administrative or judicial compliance or enforcement action, or in any
administrative appeal or in any Federal court; and (7) whether the applicant elects to use either an AJD
or a PJD, the JD will be processed as soon as practicable. Further, an AJD, a proffered individual
permit (and all terms and conditions contained therein), or individual permit denial can be
administratively appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it
becomes appropriate to make an official determination whether geographic jurisdiction exists over
aquatic resources in the review area, or to provide an official delineation of jurisdictional aquatic
resources in the review area, the Corps will provide an AJD to accomplish that result, as soon as is
practicable. This PJD finds that there "may be" waters of the U.S. and/or that there "may be"
navigable waters of the U.S. on the subject review area, and identifies all aquatic features in the
review area that could be affected by the proposed activity, based on the following information:

For the Peake Farm Additional Area Buffer Determination Request, there is no stream feature shown on the USGS
Topographic map and one stream feature depicted on the NRCS Soils map. No site visit was conducted for this feature.
However, because this feature is depicted on the NRCS Soils map, it is considered "Subject" to the Tar -Pamlico Buffer
Rules at this time. There may be other streams located on the property that do not show up on the maps referenced
above but may be considered jurisdictional according to the US Army Corps of Engineers. This project may require a
Section 404/401 Permit for the proposed activity. Any inquiries should be directed to the US Army Corp of Engineers
(Raleigh Regulatory Field Office) at (919)-554-4884.
Additionally, I have attached the NCAC 2B Surface Water and Wetland Standards. The 'Table of Uses' begins on page 56
for Neuse River Buffer Rules and on page 127 for Tar -Pamlico Buffer Rules.
