Please note that the PCN for the referenced project was submitted on 12/26/2018 through the NC DEQ online portal. Please let me know if you have any questions or need any additional information. I will be away from internet service from 12/28/2018 through 01/01/2019, so if it's urgent, please direct the attention to Ronnie Dilbeck during that time period. I have a meeting with David Brown on -Site on 01/03/2019 at 9am to review the full JD for both parcels owned by Kenjack Farms. I didn't respond all to David's request, so I wanted to make sure I brought that back into this thread. David, I look forward to meeting you on January 3rd. After review and evaluation of the submitted documents the Corps is requesting the following additional information in order for us to consider the application to be complete, per 33 CFR section 325.1(d)(1). 1) Submit a request for a jurisdictional determination (JD) with all supporting information for the entire proposed project area (see figure of Kenjack Farms Project Area). The JD of the entire project area is required in order for the Corps to issue a Public Notice (PN). Please be aware based on the proposed project, the Corps will likely request a JD to be completed on the entire Kenjack Farms LLC property totaling approximately 43 acres (see figure of Kenjack Farms Parcels), PINS 7552-29-2872 & 7553-20-6376. The JD covering both parcels will be necessary later in the permitting process for conductance of alternatives analysis and an evaluation of avoidance and minimization of impacts to waters of the U.S. You may want to submit a single request for JD covering the entire property, instead of submitting a request for only the project area and at a later date submitting another request for the entire property. Once the request for JD is received the Corps will review the request and schedule a field verification. 2) After field verification of the JD for the entire project area or the entire Kenjack Farms LLC properties, provide a map/figure of the entire project area with all potential jurisdictional areas shown and clearly depict all proposed impacts to jurisdictional areas. Also, provide a table summarizing the impacts to jurisdictional areas. The Corps will generally not make a final permit decision until the North Carolina Division of Water Resources (NCDWR) issues, denies, or waives the state Certification as required by Section 401 of the Clean Water Act (PL 92- 500). The Corps recommends submittal of the 401 permit application to NCDWR prior to the Corps publishing the PN. If this is done, then the Corps will issue the PN as a joint PN for both agencies. Please provide the information requested by October 31, 2018, or your application will be withdrawn. Once the Corps receives the additional information and verifies the JD of the entire project area we can continue to process your application. If you have any questions please contact me.
