Copeland Apex Nurseries, Inc. 2925 NC Hwy 751 Apex, NC 27523 NORTH CAROLINA Environmental Quality January 14, 2019 Subject: Rescission Denial of NPDES Stormwater Permits Apex Nurseries, Inc. Permit Numbers: NCG210436 and NCG210437 Chatham County Dear Mr. Copeland: On August 15, 2016, the Division of Energy, Mineral and Land Resources (DEMLR) received your request to rescind coverage for your site under general stormwater permit NCG210000. Department of Environmental Quality staff contacted the U.S. Environmental Protection Agency (EPA) for guidance on permitted industrial activities. EPA confirmed the stormwater discharges coming from your site are regulated under the Clean Water Act NPDES Stormwater Program and are subject to North Carolina's NPDES delegated program. Prior to rescinding the permit, all industrial materials with the potential to come into contact with stormwater must be removed. As a part this rescission request, please respond to this letter detailing how this may be achieved. Until the time that a rescission request is approved, your permits will remain in effect and you must comply with the permit condition requirements therein. If you have questions about this matter, please contact Annette Lucas at (919) 707-3639 or Alaina _ Morman at (919) 707-9236. Sincerely S.
