Mr. Temple has elected to pursue an after the fact permit for the restoration project that was
completed on his property. While we acknowledge that the stream alignment changed from what was
permitted, we believe that there is strong justification for leaving the stream as is. The alignment
constructed is stable and functioning as evidenced by; the persistent high flows/lack of erosion, and the
formation of floodplain benches. Please note that while the alignment has changed from the plans
submitted, the impact length remains the same. In the attached packet is a after the fact PCN, photos,
planting plan, and as built conditions survey. We have noted a robust vegetation with 40' buffer (25' +
and 15') on the channel that Mr. Temple will implement with your approval. This plan and submittal
requests to leave the channel as is with the addition of the plantings described in the plans and above.
While we realize that this is not an ideal situation please be aware that neither myself nor Mr., Temple
were aware that the site work had not been constructed per the permits until you sent over the plans
that were submitted. A plan that does match the current alignment was created by my office, but never
got sent in.
We acknowledge the Corps and DWR believe that there were .31 acres of wetland impact.
However based on my site visit to the site, knowledge of the site, and Mr. Temple's conversations with
Corps staff on the site, it was a site that was actively changing and had significant cobble deposits in the
old pond bed. The channel had cut itself through the old pond bed and was not actively flooding. We do
not believe that there were any wetlands impacted as a result of this project.
