Oak Island Drive Oak Island, NC 28465 sedwards@ci.oak-island.nc.us SUBJECT: Coastal Area Management Act (CAMA) Permit Application Submittals (3) for Town of Oak Island, at 4905, 4907 & 4909 E Beach Drive, Oak Island, Brunswick County Mr. Edwards: This letter is in response to the above referenced CAMA permit applications (3), which were all accepted as complete by the Division's Wilmington office on November 9, 2018. Processing of the applications is ongoing. However, it has been determined that additional information will be required prior to the Division taking final action on your application. These required items are summarized below: . 1) The U.S. Army Corps of Engineers (USACE) has requested additional information by way of the attached USACE letter dated December 17, 2018. Their correspondence requests additional information be provided that demonstrates compensatory mitigation for impacts to wetlands. 2) The Division of Energy, Mineral, and Land Resources have submitted an objection to these three (3) contiguous projects being processed separately. In their comments submitted on November 20, 2018 they indicated that Sedimentation and Erosion Control cannot be circumvented by submitting the projects as separate. Please contact Dan Sams with DEMLR at (910) 796-7326 to determine if a Sedimentation and Erosion Control Plan will be required. Therefore, it is necessary that processing of your permit application be placed in abeyance until such time as you have satisfied the requirements of the USACE and the DEMLR. Beach Drive, in Oak Island, Brunswick County, North Carolina. This letter further notifies you that your DA permit application is insufficient to fully evaluate your proposal. The applications did not contain a mitigation statement/plan. Compensatory mitigation is required for the unavoidable impacts to the aquatic environment. Please see below for further explanation on each item: 1. Compensatory Mitigation: An appropriate compensatory mitigation plan is required to fully offset unavoidable impacts to WOUS in accordance with 33 CFR 332 - Compensatory Mitigation for Losses of Aquatic Resources. The application does not provide a mitigation statement or plan. Once the mitigation proposal is determined by the Corps to be appropriate, the mitigation plan must contain the elements described at 33 CFR 332.4(c)(2) through (c)(14). Additionally, please note the preference for purchasing mitigation bank credits tQ IVE® impacts at 33 CFR 332.3(b). If mitigation bank credit purchase is not proposed, e justification for utilizing other forms of mitigation should be provided.
