Dear Mt. Shaver and Ms. Steenhuis:
The North Carolina Department of Transportation plans to replace the existing 48" CMP at location Lat:
35.063786 Long: -77.84964 on SR I501 Woodland Church Road 0.24 miles North of SR ] 500 (Tram Road)
with (1) @ 66"x51" CAAP w/HWs x 40 LF (See Attached Documents). NCDOT would like to request a
waiver from the depth specifications of the regional conditions of the Nationwide Permit 3 and the
corresponding General Condition I I of the Water Qoality General Certification No. 4085. Due to the
existing geomorphologic fall of the stream channel, burying the pipe inverts 1' would result in a 9 percent
pipe slope and would create a high flow condition causing scour and destabilization of the stream channel.
The pipe inlet invert will be buried ].5' at 87.75 and be puC on a 3 percent slope to provide and maintain
low flows. The resulting outlet invert will be at 86.55' putting it approximately 0.5' above the downstream
channel stream bed, additional rip rap will be placed 3 LF in the downstream stream bed on a 6:1 slope to
protect from scour and destabilization. (See Attached Permit Drawings).
By copy of this letter and enclosures, NCDOT is requesting issuance of Nationwide 3 approval from the US
Army Corps of Engineers and 401 Water Quality Certification (WQC) #4085 approval from the Division of
Water Resources (DWR). A method of debiting $240 to process the WQC request has been provided as noted
in the subject line of this application.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide information
about natural heritage resources for the project referenced above.
A query of the NCNHP database, based on the project area mapped with your request, indicates that there are
no records for rare species, important natural communities, natural areas, or conservation/managed areas
within the proposed project boundary. Please note that although there may be no documentation of natural
heritage elements within the project boundary, it does not imply or confirm their absence; the area may not have
been surveyed. The results of this query should not be substituted for field surveys where suitable habitat exists.

ACTIVITIES EXEMPT FROM THE PROGRAMMATIC AGREEMENT
The activities in Appendix C are exempted from further review, provided the undertaking meets all of the following conditions:
• is limited to the activities specified;
• is not part of a larger undertaking;
• is not questioned by the owner of a historic property;
• has no known public controversy based on historic preservation issues; and
• is classified as a"categoxical exclusion° (ox state-equivalent) pxoject.
EXEMPT ACTIVITIES
• Mowing, seeding/reseeding, and other ground cover maintenance activities;
• Installation or replacement/repair of fixed static signs, interconnection devices, surveillance cameras, closed circuit TV and other
minor incident management devices, raIlroad warning devices, and improved xail crossing surfaces;
• In-kind replacement, reconstruction, or ordinary repair ox modification of exisdng lighung, guardrails, modern fencing, traffic
signals, curbs and gutters, sidewalks, and variable message signs;
• Activities that do not involve construction or ground disturbance, such as preliminary engineering, training, technical studies,
non-invasive inspections, and educational pxograms;
• Overlay, milling, grooving, repairing (concrete or asphalt patching or slurry seal), striping, or resurfacing of exisung ramp,
roadway, and parking lot surfaces where there will be no new impacts outside an existing faciliry; rumble strips, loop detectoxs,
pavement markings (normal and raised), and snow and ice detectors to the same;
• AcuviUes within the existing disturbed median, including installauon of new or replacement median barriers or guard rail;
• Modernization of an existing transportation faciliry by widening less than a travel lane ox adding lanes, provided such widening
does not extend beyond the limits of existing improved right-of-way (includes shoulder additions to roadways, bridge
approaches, turn lanes within the exisung improved facility);
• Correcting substandard roadway geometrics and intersections (i.e., spot improvements), provided such corrections do not extend
beyond the limits of existing improved right-of-way;
• Minor bridge rehabilitadon, bridge raIls, or substxucture alteradons where the work is confined to the bridge itself, and
a. the bridge is no oldet than 45 yeats at the date of NCDOT's project teview, ox
b. the bridge has been determined ineligible for the National Register of Historic Places;
• Minor safery related drainage improvements, including but not limited to: installation, replacement or removal of culverts and
headwalls; installation, xeplacement and extensions of pipes; and addition of pipe end sections;
• Routine cleaning, maintenance and repair of existing drainage, stoxmwatex management, and water qualiry facilities and devices,
not including projeas that seek to expand or extend such facilities;
• Replacement/relocation of existing underground utilities in kind and within existing footprint and replacement/relocation of
existing utility poles between edge of existing improved right-of-way and road;
• Repair of erosion control and protecuon measures, including but not limited to: slope stabilization, slide repair, rip rap, or
retaining walls and new construcuon of such devices within e�cisting improved right-of-way;
• Rehabilitation of existing at-grade railroad crossings and installation or upgrade of regulatory signs and railroad waming signs
and devices, upgrade of advisory signs, and track and rail bed maintenance, pxovided there is no change in grade;
• ConstrucUon of bicycle and pedestrian lanes, paths, pedestrian signal heads, and facilities, and multi-use paths and faciliUes
provided such construction does not extend beyond the limits of existing improved right-of-way;
• Construction of or improvements to rest areas, truck weigh stations, park and ride lots, and other transportation xelated
maintenance, storage, and office facilities, where no new right-of-way is acquired;
• Landscaping on fill-slopes and back-slopes;
• Disposal of excess state-owned properties;
