Neil is utilizing NWP 13 (attached). The placement of riprap shall be limited to the areas depicted on submitted work plan drawings. For stabilization of less than 500 if of stream bank the Corp does not require a formal notification through the PCN process. Likewise we have not assigned a specific ID# number nor created a project file. Please keep a copy of this email in your files should a question about the permitting of this project come up in the future. In your application it states that you are rerouting the stream in addition to adding rip-rap to the banks. Is this true or are you just adding rip-rap? If it's just rip-rap to stabilize the stream bank, then you are applying for a NW13 from the Corps so you'll need to check the 404 box and you'll need to check the 401 box and the buffer authorization box. 1 If you stablize more than 500 linear feet of stream bank then you need to pay the permitting fee of $240 for the 401. If you are rerouting the stream and not just adding rip-rap, I'll need an email from Jamie Shern stating which Nationwide permit your site would be covered under. I only see in the plan sheet that rip-rap is being added. I don't see where it's being rerouted. Under section la of the application you need to check buffers. Under section 6f and 6g you need to put in the square footage of buffer impacts (area of the rip-rap in the buffer). Under section section 3g it states you are impacting 220 linear feet of stream. Are you adding rip-rap into the stream channel? If not, then there shouldn't be any stream impacts unless you are moving the stream. Please clarify this.
