Dear Mr. Dickerson:
On October 6, 2000, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification
to 6110.078 acre of wetland and 357 linear feet of stream in order to construct the Hasentree
Subdivision in Wake County. In order to meet the diffuse flow requirements for this project under
the Neuse Riparian Buffer Protection Rule (15A NCAC 2B .0233), a diffuse flow plan, dated June
30, 2009, was received by the DWQ on June 30, 2009. The DWQ has determined that your diffuse
flow plan was incomplete as discussed below.
Additional Information Requested:
1. Please submit a PCN form (with all required information for a Buffer Authorization) to
request the riparian buffer impacts that are necessary to provide the bypass channel for
the proposed level spreader.
2. Please address the following deficiencies with the level spreader design:
a. The proposed topographic lines for the bypass channel must be shown on the
plans.
b. The bypass channel may not pass through any portion of the filter strip.
c. The level spreader may not be located upslope of a draw.
d. A photograph of the vegetation in the filter strip must be provided. If the filter
strip contains wooded vegetation in Zone 1, then the length of the level spreader
lip must be adjusted accordingly.
The DWQ will require the above additional information to finalize review of the diffuse flow plan
for the subject property. Please provide the following information so that we may continue to review
