PROJECT SUMMARY: The applicant is proposing to redevelop an existing marina in the Town of Emerald Isle. The redevelopment would consist of a 65 slip docking facility, a 270 slip dry storage (with travel lift), a ship store, restaurant, bathhouse, maintenance facility, eight elevated wooden parking lots, low pressure sewage treatment, 315' of bulkhead, and the excavation of 17,050 yd' of bottom. 9. NARRATIVE DESCRIPTION: Maritime Siblings, LLC.'s project is located on the northern side of Emerald Isle and western end of Bogue Banks. The project site is found by turning south onto Hwy. 58 at the Hwy. 24 and 58 intersection in Cape Carteret. After crossing the Emerald Isle Bridge continue for approximately 1.5 miles and turn north onto Mangrove Dr. and then an immediate left onto Old Ferry Road. Continue approximately 0.3 miles and turn right onto Marina Drive. The site is currently known and operated as Island Harbor Marina. The subject project would take place on a single 7.6 acre parcel and ranges from +3 ft. to +25 ft. in elevation above NHW. The project area is cleared and maintained; vegetation consists of native grasses and sparse trees. Presently, the parcel consists of an existing 133-slip public commercial marina with associated boat ramp, and 16 mobile homes. The marina incorporates approximately 129,200 ft2 of public trust waters. Currently the marina utilizes an existing asphalt drive and gravel parking facilities. The existing marina and mobiles homes utilize an onsite septic system. Existing impervious on the tract is 43.1%. Adjacent land uses consists of single and multi-family residential and a mobile home park. The undeveloped portion of shoreline contains fringes of coastal and Section 404 Wetlands. None of these wetlands are within the limits of disturbance for the redevelopment of the marina. The width of Bogue Sound at this point is 1.06 miles. The subaqueous substrate is predominately sand the entirety of the shoreline with the exception of the previously excavated areas which are fine silt. The Division of Water Quality classifies this area of Bogue Sound as SA-ORW waters. This area is not a Primary Nursery Area. This portion of Bogue Sound is closed to harvesting of shellfish. The entire parcel is located within the 575' Estuarine Shore AEC adjacent to ORW and therefore is classified in the Emerald Isle LUP as Conservation. 10. PROJECT DESCRIPTION: The applicant is proposing redevelop an existing 133 slip marina on approximately 7.6 acres of highground with 896 ft. of shoreline. 7.5 acres of highground are proposed to be disturbed during the redevelopment process in which a new marina would be constructed with an associated bulkhead for shoreline stabilization, subaqueous and terrestrial excavations, as well as a 270 slip dry stack facility with associated marine accommodations. Proposed excavation totals 17,050 yd' with 7,810 yd3 being considered new excavation. The portions of new excavation are extensions of the existing basin, and cover 60,237 ft2 of undisturbed bottom. Existing water depths in these sections range from -1.4 to -2.2' NLW. Proposed depths, post excavation, are -6.0' NLW. 9,240 yd3 would be excavated as maintenance of the existing marina, which connects to an existing ferry channel with waters depths of -6.4' NLW. 108,146 ft2 of previously disturbed bottom would be excavated during this project. A total of 168,383 ft2 of bottom would be excavated during the marina redevelopment. Excavation would be carried out by bucket and barge, offloaded onsite, and relocated to a preapproved offsite location. There are sparse areas of SAVs on site with none found in the areas to be excavated at the time of site visits. The applicant proposes 315' of vinyl or concrete bulkhead to be constructed below NHW at a maximum of 2' waterward of the existing bulkhead, directly adjacent to the existing marina and boat ramp. No wetlands or SAVS are located within this area to be incorporated by shoreline stabilization measures. A new 65 slip floating docking facility incorporating 168,300 ftz of public trust and estuarine waters consisting of the following configuration is also proposed: • Floating Dock #1- Western structure at site of existing boat ramp. Extends waterward 273' by means of a 273' x 8' pier. At the terminus, a 328' x 9.83' platform extends perpendicularly westward to the access, providing 19 slips with nine 29' x 4.5' finger piers and one 30.40' x 6.17' finger pier. Also proposed on floating dock #1 are gasoline /diesel fueling dispensers and a sewer pumpout center, located on a 12'x13' platform. Dock #1 provides 19 slips with 10 associated mooring pilings and extends 282' waterward of NHW. The structure is 51.32' from the western riparian line. • Floating Dock #2- Central structure extends waterward 260.17' from NHW by means of a 9.83' wide access pier. At the terminus, a 50.33' x 8' platform extends perpendicularly eastward. Two 50' x 6.17' finger piers extend perpendicularly northward, providing two slips. Along the eastern side of the access pier are four 39' x 4.5' finger piers providing 10 slips with 6 associated mooring pilings. Dock #2 has 12 slips total and extends a maximum of 330' waterward of NHW. • Floating Dock #3- Eastern structure extends out 285.27' by means of a 9.83' wide access pier. At the terminus is a 93.33' x 8' "T" with two 50' x 6.17' and one 50' x 5' finger piers extending perpendicularly northward providing four slips. On the west side of the access pier are five 39' x 4.5' finger piers providing access for 12 slips. On the east side are four 34' x 4.5'and two 25' x 4.5' finger piers providing access for 13 slips with 15 associated mooring pilings. Dock #3 provides 29 slips and extends a maximum of 345' waterward of the NHW. This structure would be a minimum of 129.52' from the eastern riparian line. • Floating Dock #4- Is positioned along the proposed bulkhead between dock #2 and #3. A total of 154.86' x 8' and utilizing two 39' x 4.5' finger piers. Dock #4 would provide five slips with 3 associated mooring pilings. The 50' wide area between docks #1 and #2 is designated as the staging area for the proposed travel lift. This would be located in the area of the existing commercial public boat ramp, which would be removed to accommodate this amenity. Other activities in the redevelopment would consist of. A restaurant with dimensions of 50' x 70' with an attached 70' x 20' wood deck approximately 50' landward of NHW, ship store with dimensions of 30' x 120' a minimum of 120' landward of NHW, 270 slip dry storage (4 levels in height) with dimensions of 270' x 208' x 50' a minimum of 70' landward of NHW, associated travel lift and 11,500 ftz concrete pad extending to the bulkhead in the location of the existing boat ramp, a 50' x 30' bathhouse, vessel maintenance facility, eight elevated wooden parking lots of various dimensions providing 194 parking places, low pressure wastewater treatment, and three stormwater treatment basins covering 12,130 ft, 3,725 ft', and 1,285 ftz collectively. Basin #1 (12,130 ft) would be located at a minimum of 64' landward of NHW or 34' landward of the 30' buffer. Basin #2 (3,725 ft 2) would be located at a minimum of 50' landward of NHW or 20' landward of the 30' buffer. Basin #3 would be located a minimum of 90' landward of NHW of 60' landward of the 30' buffer. Two retaining walls are also included in the upland development at 190' and 78' in length and 1.5' in height. The 198' retaining wall would be located on the west side of the property, and used to stabilize the area around the proposed parking spaces. The other wall would be located on the east side of the property, near stormwater basin #3 and used to stabilize parking and basin #3. Underground fuel (gasoline and diesel) tanks are also proposed to service the marina and would be located 480' landward of NHW. Also, 516' of wooden sidewalk of 5 and 10' widths are proposed. The entire 7.6 acre tract is within the 575' Estuarine Shoreline AEC adjacent to ORW. The Stormwater plan was permitted as redevelopment by the NC Division of Water Quality on 8/18/08 and is referred to as #SW8 080908. 11. ANTICIPATED IMPACTS: The proposed marina redevelopment would result in 326,700 ft2 of upland disturbance to occur. To aide in the reduction of both frequency and magnitude of sediments being introduced into adjacent waters as a result of the upland disturbance, silt fences would be used throughout the site and a temporary dike would be constructed, parallel to the shoreline, to contain any sedimentation or erosion problems. The amount of impervious surface on the 7.6 acre tract would be decreased by 0.32 %. Total impervious surface within the AEC would be 42.78 % and total for the tract would be 42.78 % since the tract lies within the 575' AEC. The amount of impervious surface within the 30' buffer would also be reduced by 75 %, going from 6,770 ft2 to 1,700 ft2. With properly engineered stormwater basins, very little new stormwater would be expected to have an adverse impact on the adjacent ORW waters. Also, all parking is to be elevated wooden structures, aiding in reducing runoff of pollutants into nearby waters. One new impact would be the proposed new excavation of 60,237 ft2 of shallow bottom; the bottom characteristics in this area are fine sand. The proposal calls for 108,146 ft2 of shallow bottom to be excavated for maintenance. All excavation is proposed to -6.0' NLW. The proposed excavations are part of and connect to an existing historic ferry channel connecting Island Harbor Marina to the AIWW requiring the removal of 17,050 yd' of material from the system and relocated to an offsite spoil disposal area. This area has been previously disturbed and the bottom consists of fine silt and mud. This excavation would result in a temporary turbidity spike in the waters around the disturbance. The site is located about 3 miles from Bogue Inlet to the west. With the proximately to the inlet, the site experiences a relatively high velocity tidal current, and as such any turbidity would be expected to be quickly dissipated. The proposed docking facilities would incorporate 168,300 ft2 of public trust waters, increasing the amount of incorporated waters by approximately 30% over the previous marina. The marina currently has 133 slips and the proposed redevelopment would harbor 65 slips, resulting in a 51 % reduction in total wetslips. 315' of shoreline would also be stabilized with a bulkhead system. The proposed bulkhead would be positioned 2' waterward of an existing bulkhead thereby requiring approximately 825 ft2 of open water to be filled. Highground disturbance for the installation of the bulkhead system is included in the 7.5 acres on overall disturbance. This area is void of wetlands and SAVs. Also of concern would be the proposed vessel maintenance facility. Vessel maintenance could cause the introduction of numerous harmful substances into nearby waters, which should be addressed with the proposed catch basin used to funnel pollutants away from the shoreline. Another concern is the sewage pumpout and vessel fueling stations located along the docking facility. It is possible to have sewage or fuel spills due to equipment failure or user accidents causing the spillage of petroleum products or raw sewage to the adjacent ORW waters. This should be addressed by current USCG standards for fueling and pumpout facilities. No coastal marsh or Section 404 Wetlands would be filled or excavated during this project. A local concern has arisen during the comment section for this project. Island Harbor Marina has been a fixture of the community for decades and houses the only commercial public boat ramp on Emerald Isle. The ramp would be lost during the redevelopment of the marina, therefore eliminating commercial public boating access for the Town of Emerald Isle. The property is located at 510 West Marina Drive (off NC Hwy 58), Emerald Isle, Carteret County (P.I.N. 5384.20.80.0196) approximately three (3) miles southeast of the intersection of NC Highways 24 and 58. The parcel is zoned MV, marina village, and is within the jurisdiction of Emerald Isle. This tract of land comprises 7.6 acres and is located within the White Oak River Basin. It has been evaluated by the Army Corps of Engineers and determined the presence of a wetland fringe along parts of the shoreline as depicted on the plans. The site is presently serviced by Bogue Banks Water Corporation for domestic water supply and an on-site septic system is proposed on-site to handle the sewer. 133 The existing marina has approximately one-htff ed wet slips. The proposed demolition and reconstruction/reconfiguration of the marina will reduce this number to sixty-five (65) floating slips. The appendages include a ship store, patron's locker room with bathing facilities and boat maintenance department. A restaurant is also proposed for the development and is sited at the north east corner of the property. Fuel and sewer pump-out facilities are located on Floating Dock #1. Appropriate emergency spill kits are to be provided as well. Dredging is required for the functionality of the marina. A dredging limit as delineated by Tere Barrett of the NC Division of Coastal Management and surveyed by Stroud Engineering is shown on the attached drawings. All proposed dredging has been contained within the allowable area and excavated to a matching depth of the connecting water. The site presently drains north into Bogue Sound, which is Class "SA-ORW", Stream Index # 20-36-(0.5). The site has been submitted and permitted as a Redevelopment State Stormwater (SW8 080908) project, with impervious areas totaling less than the existing coverage of the tract. The existing impervious area for the site is 43.10% and the proposed impervious area for the project, including the existing to remain, is 42.78%. Since the tract is adjacent to outstanding resource waters, the requirements of the 575' Area of Environmental Concern and 30' CAMA buffer are applicable. Some of the existing impervious will be removed from the 30' buffer and only water dependant structures are proposed as being reconstructed within the buffer. There are three infiltration basins proposed within this redevelopment plan as being graded to hold and infiltrate the runoff from the drainage area. These BMP's are proposed to reduce the stormwater runoff from impervious surfaces draining into Bogue Sound, while satisfying the NC Division of Marine Fisheries. The site is proposed at 8.42% with the construction of these infiltration areas. The impervious area treated by these infiltration areas decreases the runoff by 35% from the current site conditions. This plan provides greater stormwater control than what currently exists and has been designed for a 2" rain, exceeding the 1.5" NCDENR requirement. Level spreaders are also proposed to aid in diffuse flow of excess stormwater providing further treatment through the grassed buffer.
