This Office believes that impact to the riparian buffer and stream can be minimized by adding another manhole between manholes 5 & 6 to cross the creek at a perpendicular angle. Please revise the plans to minimize this impact. Numerous meetings and substantial time was spent in obtaining the utility easement. The impacts to the stream and buffer have been minimized to the maximum extent practical and is as close to 90 degrees as possible. (See John Edwards response). 2. Please locate all of the protected riparian buffers as overlays on the site plan, clearly showing Zone 1 and Zone 2 beginning at manhole 1. Impacts from the sewer line are shown on the large plat and on an individually enlarged scale. 3. Please enumerate all buffer impacts of the sewer line on the impact map by number and ensure that they match the PCN buffer tables. See attachments. As shown the proposed sewer line is contained within the utility easement which has already (painstakingly) been recorded (see attached) through the State Attorney Generals Office. 2. The Facilities constructed hereunder shall remain the property of Grantee. For the purpose of constructing, inspecting, maintaining or operating the Facilities, Grantee shall have the right of ingress to and egress from the Easement Area over the Property adjacent to the Easement Area and lying between public and private roads and Easement Area in such manner as shall occasion the least practical damage and inconvenience to Grantor. 3. Grantee shal l repair damage to roads, fences or other improvements and shall pay Grantor for other damage done in the process of the construction, inspection, or maintenance of the Facilities, or in the exercise of its right of ingress and egress. 4. This Easement is granted subject to all existing rights of way and easements within the Easement Area. 5. That Grantee agrees to restore the Easement Area after installation of the Facilities to approximately the same condition as before said installation. 6. Grantee shall dedicate this Easement to the City of Raleigh by the recording of a dedication plat on which the Easement Area is shown or by the recording of such other instrument of dedication in which the Easement Area is described. Upon recording of said plat or instrument of dedication and acceptance of same by the City of Raleigh, this Easement shall be dedicated to the City of Raleigh. Such dedication shall be made without the necessity of any further action on the part of Grantor and shall be effectuated by a note on the plat or instrument of dedication which references this recorded Easement and such other documentation or reference as may be required by the City of Raleigh. 7. That by acceptance of this Easement, Grantee binds itself and its successors, agents and assigns to the foregoing conditions. 8. If the Facilities are not operated within the Easement Area for a continuous period of twelve (12) months, this Easement shall be deemed abandoned. 9. It is further understood and agreed that this conveyance is made subject to the condition that Grantee shall properly obtain all necessary permits required by State and federal -3- (page ! of 7) SK6038 00041i law. Failure to obtain such permits in a timely manna shall be deemed an abandonment of this Easement.
