The site contains undeveloped wooded land and agricultural fields. Structures are not located on the site. The site is
located in a residential/rural area of Willard, Pender County, North Carolina.

The purpose of the proposed project is to provide access and interconnection during development and long term
maintenance of the site as a solar farm.

The overall project consists of development of the site with a proposed solar farm. In order to provide safe access and
interconnection of the site, crossings of streams, wetlands and open water ditches are necessary. To facilitate
development of the site and construction of the proposed crossings, grading the site is necessary. Graders, haulers,
excavators and other heavy equipment will be used during site construction.

3i. Comments: The applicant proposes 3 culvert replacements resulting in cumulative permanent stream impact to 100 linear
feet of stream channel and cumulative temporary stream impact to 120 linear feet of stream channel. Of the 100 linear feet of
stream channel impact, 25 linear feet of impact will occur from extension of proposed culvert/earthen fill outside of the existing

culvert footprint and would be a considered a net loss of stream. The remaining 60 linear feet of proposed permanent stream
impact consists of rip-rap stone being keyed into existing stream bed elevation (View Exhibit #110, Stream Crossing Internal
Access Road). Permanent impact to streams associated with keyed in rip-rap to pre-construction stream bed elevations will
allow for aquatic passage and habitat to be maintained following culvert installation. Additionally, the use of rip-rap energy
dissipaters will be beneficial to down-gradient water bodies for reduction of in stream flow velocities, sedimentation in down-
gradient water bodies and enhance stream stability following culvert replacement. Therefore, the permanent impact to
streams associated with stone rip-rap fill is not considered a net loss of stream. Areas of temporary impact will be restored to
similar pre-construction grades and matted/seeded.
Stream Impact #1 (Tributary 16) will permanently impact 15 linear feet of stream channel with culvert fill, permanently impact
25 linear feet of stream channel with keyed in /rip-rap fill and temporarily impact 40 linear feet of stream channel with
associated pump around.
Stream Impact #2 (Tributary 10) will permanently impact 10 linear feet of stream channel with culvert fill, permanently impact
25 linear feet of stream channel with keyed in rip-rap fill and temporarily impact 40 linear feet of stream channel with
associated pump around.

4g. Comments: The applicant proposes 27 cumulative access road crossings at 50 physical locations resulting in ranging
permanent and temporary impact amounts as shown on the attached Open Water Impact Table. The permanent impact to
open water ditches is a result of culvert fill and rip-rap. Rip-rap is proposed to provide inlet and outlet protection and energy
dissipation. Temporary impact to open water ditches is proposed as a result of the use of sediment and erosion control best
management practices.
The open water drainage ditches were previously maintained as part of routine agricultural or silviculture practices. However,
it appears the open water ditches have not been maintained for at least 25 to 30 years, resulting in excessive accumulated
sediments and vegetation within the ditch beds that significantly prohibit flow and proper drainage. The applicant proposes to
complete maintenance activities including removal of sediment accumulation and vegetation removal to ensure adequate
drainage from the site. The maintenance activities are necessary during the duration of construction and following
construction to ensure that access roads and crossings remain in a safe and functioning condition for the long term
maintenance of t heh proposed project. It is the applicant's understanding that proposed maintenance activities are an
exempt activity pending historic depths and widths of the open water ditches are maintained. Therefore, the applicant does
not request written verification of impacts associated with open water ditch maintenance.
Seven of the proposed open water ditch locations have been designed to replace existing culverts. The open water ditch
crossings will utilize Type B sediment dams during installation of the culverts or during culvert replacements to reduce the
potential for sedimentation into down-gradient waters.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Due to the development and use of the site as a solar farm, access roads must be constructed for site construction and long
term maintenance. The road widths have been designed to the minimal width necessary to safely accommodate heavy
equipment and tractor trailers. Crossings have been designed in areas of existing previously impacted crossings for several of
the proposed crossings.
The solar array and necessary infrastructure (overhead/underground voltage lines, inverters, substation, etc.) have been
designed to avoid impacts to jurisdictional streams, wetlands and ponds. The remaining 171.7 acres of wetlands, 11,205 linear
feet of stream channel and 10.01 acres of open water drainage ditches are being avoided.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
The impact limits will be staked and silt fence will be used. Temporary coffer dams will be installed up-gradient of the
proposed culverts at the stream and wetland crossings. During construction, water will be pumped around the construction
footprints. Appropriate bank protection will be provided in the stream channels during construction and all excess excavated
material will be immediately removed from the stream and wetland crossing areas. Upon completion of the culvert
installations, the temporary sand bag coffer dams will be removed and flow will be diverted through the culverts. Following
construction, disturbed stream banks will be restored to similar pre-construction conditions, matted and seeded/live staked.

Type B sediment dams will be temporarily installed up and down-gradient of the proposed culverts at the open water ditch
crossings to reduce potential for sedimentation into down-gradient waters. The Type B sediment dams have been designed to
be within an area of permanent impact for long term maintenance areas for accumulated sediment and vegetation removal.

The applicant does not propose mitigation for the cumulative impact to 75 linear feet of stream channel from the use of keyed
in rip-rap inlet protection and outlet energy dissipater because there is not a net loss of function to stream channel. Rip-rap
will be keyed into pre-construction stream beds/banks elevation and will allow for aquatic habitat to maintain following culvert
replacement. The use of keyed in rip-rap will provide stream stability following construction and will reduce potential
sedimentation into down-gradient waters.
The applicant does not proposed mitigation for the permanent impact to wetlands or open water ditches.

The Stormwater Management Permit Application Form (Form SWU-101 Version Oct 31, 2013) was submitted to the
Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (Stormwater Section) which was
accepted by them on November 19, 2018. The project was designed to comply with 15A NCAC 02H.1019 and be under
the 24% maximum BUA (where panels are not considered impervious) for low density and also provide 50 foot vegetated
setback from perennial waterbodies, perennial streams, and intermittent streams. The design also incorporated the six (6)
recommendations under Part E: Guidance for Specific Types of Sites, E-6 Solar Farms, of the current NCDEQ
Stormwater Design Manual. To date, the stormwater management plan has not yet been approved. Therefore, the
applicant requests a conditional 401 Water Quality Certification pending approval of the stormwater management plan.

Dear Brad:
The Northeast Cape Fear Umbrella Mitigation Bank (Bank) is providing preliminary acceptance to supply
mitigation credits for proposed impacts to streams associated with the Crooked Run Solar Project in Pender
County, NC (conditional upon receipt of payment as outlined below). Please refer to the table below
depicting the type and quantity of credits requested and reserved for your project.

Based upon receipt of your credit request transmitted on December 28, 2018, the Bank will reserve 140
stream credits for a period of up to 90 days from the date of this letter. Note that requests to reserve
credits beyond 90 days will require a deposit. Please contact us if you need a reservation to extend beyond
the 90‐day period.
Upon request for credit transfer, the Bank will issue an invoice in the amount of $71,024.80. Upon receipt
of payment, the Bank will provide an executed Transfer of Credit Certificate for the total amount of credits
