CONTI, IR SECRETARY Subject: B-3652 Response to NC Division of Water Quality (NCDWQ) Letter; DWQ Project No. 090676 As you are aware, the NC Department of Transportation submitted a permit application on June 4, 2009 for TIP Project no. B-3654 (DWQ Project no. 090676) to NCDWQ. This letter addresses each item in NCDWQ's June 24, 2009, letter regarding the replacement of the Bridges 29 & 53 over Mingo Swamp on NC 55 in Harnett/Sampson Counties. A copy is attached for your convenience. 1. Permit drawings 11 a and 11 b are provided with this letter depicting the temporary detour impacts. 2. The US Army Corps of Engineers (USACE) will issue a JD at permitting. 3. Geotextile fabric will be place under the temporary fill. 4. Due to the loamy soils in the wetland and unlikeliness of compaction, we feel that the replanted wetland area will be successful. In similar projects, these impacted areas have been allowed to re-vegetate on their own, therefore these plantings will be in addition to any volunteer species that occur. Additionally, the seedlings will be replanted at 680 stems per acre which should be more than sufficient to provide adequate coverage. The trees will be planted between Nov 15-March 15 which is the optimum planting window for these seedlings. The temporary areas will be hand cleared; no grubbing will occur. Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: 1. The permit drawings do not include a plan sheet providing details of the impacts for the temporary detour on Bridge 53, site 2. (The plan sheet for site 1 was provided.) 2. Is there a valid Corps jurisdictional determination for this project? Information provided with the application indicates that the JD expired on January 16, 2008. Please confirm that the delineation as depicted has been approved or will be extended by the Corps of Engineers. 3. Will geotextile fabric be placed under the temporary fill material used in the detours? Though this is a fairly common practice, we found no reference to such a proposal in the application. 4. The PCN explains that "The temporary detours will be removed, graded back to natural contours, and replanted with native vegetation. A monitoring plan is not proposed due to loamy soils in the project area." Success of replanting may be dependent on the time of year the work is completed. Lacking a monitoring plan, what provisions will be made should the plantings fail? 5. Please indicate if the area under the temporary fills will be grubbed. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we will assume you are withdrawing your application and it will be returned. Furthermore, until the information is received by the NC Division of Water Quality, we -request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
