On January 1, 1992, we renewed general permit No. CESAW-CO82-N-000-0030 (enclosed) that authorizes construction activities in waters of lakes and reservoirs in the State of North Carolina, owned, operated, and/or regulated by public utility companies under license from the Federal Power Commission/Federal Energy Regulatory Commission (FERC) and all lakes or reservoirs in the State of North Carolina owned and operated by the Tennessee Valley Authority (TVA). The proposed Boy Scout project is authorized if they can comply with all permit conditions. Please have them read the enclosed permit to prevent an unintentional violation of Federal law. As this Department of the Army general permit does not relieve them of the responsibility to obtain any other required approvals, they should contact appropriate State and local agencies before beginning work. Winefordner and Dorney: 7 q26s ZNofv492 2 WULAKMIS RE: Installation of Fish Attractors in Hyco Reservoir As discussed with you by Mr. Buzz Bryson of my staff in a telephone conversation on October 27, 1992, CP&L is sponsoring a Roxboro Boy Scout in a project to meet his Eagle Scout requirements. His project involves using old automobile tires to construct a small artificial reef in Hyco Reservoir to serve as a fish attractor. The reef will consist of twelve nine-tire units which will be placed in the South Hyco arm of the lake. The configuration and location of the proposed reef are shown in attachments to this letter. CP&L has previously installed similar tire reefs in Hyco and nearby Mayo Reservoir under the regional permit relating to FERC-regulated impoundments (see attached letter). CP&L is requesting that you review this proposal to ensure that it is covered under this regional permit or under NWP #4, and that it also satisfies the requirements for 401 certification (the joint application form is attached). Because the Boy Scout wishes to complete the project this fall, we would appreciate your reviewing the project at your earliest convenience. Two of these 3-tire assemblies are then roped together to form a base of six tires. A third assem- bly is then lashed on top to form a pyramid. Six No. 10 cans filled with concrete are forced between the sidewalls of the base tires to anchor the unit. The upper tread portions of all but the middle tire of the top assembly are drilled to allow air to escape. The air trapped in the undrilled tire assures that the, unit will sink in an upright position. 5. Four holes are drilled in the upper sidewall, dividing the tire into quarters. The holes are then enlarged by cutting out a wedge toward the center of the tire with a saber saw (use knife blade insert). Four 10-foot (3 m) long sections of reinforcing bar are inserted into the holes of the base tire. Each bar is bent toward the center of the tire and then an acety- 6 Figure 5.
