Onslow County, we have determined that the proposed fill can be
covered by General Water Quality Certification No. 2665 issued
January 21, 1992. A copy of.the General Certification is
attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit-No. 13. -

As per our conversations and meetings on 26 January and 8 February we would like
to modify our original request for the bulkhead construction permit at Lot #13, Chadwick
Acres, Sneads Ferry, Onslow County, North Carolina, 28460 to an alternate site. No change
is planned for the pier and boatlift structure so their location will remain the same as in
our original request.
We now request that we be allowed to remove the old bulkhead, construct the new
one in the same location and fill in behind it. The only variance from the old bulkhead and
the new proposed bulkhead is we would like to tie into the adjoining West bulkhead a
maximum of two feet toward the waterway. If this is not allowable we will tie in with the
adjoining bulkhead at the exact same spot.
A drawing is enclosed showing the alternate proposed location of the bulkhead
along with the suggestion you gave me on 26 January 1993. If there are any more

We have received the attach modification to the subject
application. After another visit to the site I have re-evaluated the
significance of the coastal wetland species present on the site. I have
now determined that the loss of the 860 sq. ft. of mixed coastal
species is not considered significant, in that those wetlands are
established as a fringe to the Anderson's high ground property. Upon
reexamination they did not appear to contribute an irreplaceable
wetland function. I recommend that we issue the permit and over rule
the comments of those agencies who also originally objected to the
loss.

Dear Sir:
Reference to your letter dated December 24, 1992, Regulatory Branch, Action I.D.
199200069 citing our application for Department of Army (DA) authorization to construct a pier and
boatlift structure and backfill a bulkhead on the Atlantic Intracoastal Waterway (AIWW), Sneads
Ferry, Onslow County, North Carolina. In this letter you requested further information concerning
the DA and US Environmental Protection Agency (EPA) Memorandum of Agreement (MOA) signed
February 6, 1990 which provides for first, avoiding impacts on water and wetlands through the
selection of least damaging, practical alternatives; second taking appropriate and practical steps to
minimize impacts on water and wetlands; and finally compensating for any remaining unavoidable
impacts to the extent appropriate and practical.
In order to be in full compliance with the MOA we submit the following additional information:
a. Alternative including upland alternatives The two alternate plans which have been'
discussed and could be presented for seawall construction would be:
1) Locate the seawall in its present location and backfill behind it. This was our original
idea and would keep our yard as it has been since the seawall was originally con-
structed in 1973.
2) Locate a new seawall further back in our yard. If a location further back in our yard
were to be used all land beyond the new seawall would soon be lost into the AICC due
to the waves and erosion action caused by the wakes of power boats. I do not see how
locating farther back would be of any benefit as any wetlands created would soon be
washed away and lost forever.
3) I do agree that our proposed bulkhead would take about 1600 square feet of water.
However, this area is not accessible to normal boat travel as it is tucked in an area
protected on the north by an adjacent seawall and on the south by our presently
existing seawall and proposed pier. Being very truthful, we are not really trying to gain
more land, we are trying to protect what we have and build a strong structure that will
not quickly deteriorate due to the pounding a seawall and open shoreline takes from
waves. We hope this proposal will help stabilize the shoreline while protecting our
property. Once this land washes into the AICC it is gone forever.
b. Development and modification of plans. Prior to submitting our application to the DA we
were visited by Mr. Todd Bald, formerly of your office and Mr. Peter Mueller who owns a
marine construction company in our area. Both agreed and recommended that presenting
our application in its present form would be a very practical solution. Back in 1973 when
our shoreline was first being undercut, we did what we thought was the least ecological

damaging. At that time we built a seawall, with backfill, following the shoreline. It was not
as strong as a straight seawall because the weak points (e.g., points not parallel to the
AICC, points that form 90 degree angles to adjacent seawalls) gave way or allowed waves to
splash over the seawall causing erosion to take place behind our seawall and in our yard.
We really want to protect our yard and feel that constructing a seawall that is on line with
the adjacent one on the north side of our property would prevent the deterioration and
erosion a seawall takes at these stress points. We also feel that this would help protect the
environment as it would prevent further erosion and loss of land. We do not plan on using
any earth moving equipment or equipment that would be hannful to adjacent environment.
Our pier and boatlift structures would be for family and friends use and would not extend
out more than localized structures or up or down the waterway.
c. Appropriate and practical mitigation. We are not proposing that a large dock or marina be
built. We are looking for a practical and economical way to prevent the erosion of our yard
and provide a way for our family to enjoy the resources of the AICC. I will be happy to meet
with anyone, anytime and anyplace to discuss this proposal and try to reach a practical
common sense solution.

8. PROJECT SUMMARY: The applicants propose to construct a bulkhead with fill aligned
along the shoreline of their property. Approximately 174 linear feet of structure a maximum
of approximately 22' below the mean high water (mhw) contour is proposed. The applicants
also propose to construct a dock with boatlift in order to re-establish boat access.

9. PROTECT DESCRIPTION
The project is located within Chadwick Shores subdivision in Onslow County. The AIWW is
adjacent to the property. A review of the aerial photography for this site indicates that a
bulkhead without backfill was present in 1984 and 1989. The 1978 photograph also shows
the bulkhead. It appears at that time there was either no fill or a very limited amount present.
The existing structure functioned as a breakwater and now has failed to the point that some
bank erosion is occurring due to boat wave action. There is a fringe of mixed high marsh,
with scattered SSpartina alterniflora interspersed within it, along the shoreline which ranges
from approximately 7' wide down to 0' wide. The waters within the project area are
classified as SA and are open to the taking of shellfish. The area is designated as a primary
nursery (PNA).
The applicants propose to construct a new bulkhead which would be aligned between the
ends of the existing west end of the present structure and which would connect to the end of
the existing wall on the property to the east. Approximately 174' of wall would be
constructed and would be aligned a maximum of approximately 23' off shore. A simple pier
with " T-head " and a boatlift are also proposed. The pier is shown as 6' x 8' and the "T" as
8' x 10'. The boatlift is shown as 12' x 12'.
10. ANTICIPATED IMPACTS
If the projec± is constructed as proposed the activity will caul: to be consumed approximately
860 sf of mixed coastal wetlands as well as approximately 2052 sf of open water. It appears
unlikely that the existing structure has ever had a significant amount of fill associated with it.
Its' primary function seems to have been to serve as a breakwater and the recent
deterioration has resulted in the erosion of the bank. The present request appears to be an
attempt to create new property rather than shoreline stabilization. The pier and " T-head "
are consistent with the regulations and will cause no adverse impacts. It is recommended that
the proposed bulkhead be re-installed as a breakwater. However if the applicants wish to fill
landward of the wall it must be re-aligned landward of the coastal marsh.

Reference the application of Mr. Dallen Anderson and Ms. Eleanor Anderson
for a Department of the Army permit to construct a pier and boatlift structure
and construct and backfill a bulkhead on the Atlantic Intracoastal Waterway
(AIWW), Sneads Ferry, Onslow County, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. The existing structure may be repaired as a breakwater structure,
without backfill material and with a minimum of 20 percent total open space to
allow the ingress and egress of aquatic organisms; or if the permittee elects
to construct and backfill a bulkhead, the bulkhead will be aligned landward of
any coastal marsh. To prevent an unintentional violation of this
authorization, representatives of the North Carolina Division of Coastal
Management and the Corps of Engineers will be available to stake the
breakwater/bulkhead alignment prior to construction.
b. All work authorized by this permit must be performed in strict
compliance with the permit plans except with respect to the
breakwater/bulkhead structure.
C. No vegetated wetlands will be excavated or filled.
d. If the permittee elects to construct and backfill a bulkhead, the
bulkhead will be positioned landward of all coastal marsh.
e. If the permittee elects to construct and backfill a bulkhead, all
backfill materials will be obtained from a highground source and confined
landward of the permitted bulkhead.

f. If the permittee elects to construct and backfill a bulkhead, the fill
material will be clean and free of any pollutants except in trace quantities.
Metal products, organic materials, or unsightly debris will not be used.
g. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
h. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
i. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 25 NTU's or less will not be considered significant.

The Division of Environmental Management (DEM) has reviewed your
application for 401 Water Quality Certification to construct a bulkhead a
maximum of 22 feet waterward of Mean High Water (MHW) as well as to construct
a dock and boat lift. A Water Quality Certification is a statement by DEM
that no water quality standards will be violated. We have no objection to the
dock and boat lift.
However the bulkhead as presently planned will remove about 2000 square
feet of open SA water (classified for Commercial Shellfishing) and 860 square
feet of salt marsh vegetation. This action would be in violation of our
Antidegradation water quality standard (15A NCAC 2B. 0201) which states that
existing uses of water must be protected unless there is no practicable
alternative. The existing uses in this instance are aquatic life habitat,
wildlife habitat, pollutant removal, and water storage. We believe that the
bulkhead can be relocated generally landward of all marsh vegetation and/or by
constructing a breakwater along the proposed bulkhead alignment. This
redesign would result in protection of water quality and still provide
shoreline protection as you desire.

On February 6, 1990, the DA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MOA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the proposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives, including upland alternatives, to the work for which you have
applied and provide justification that your selected plan is the least
damaging to water or wetland areas.
b. It is necessary for you to have taken all appropriate and practical
steps to minimize wetland losses. Please indicate all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to minimize adverse impacts.
c. The MOA requires that appropriate and practical mitigation will be
required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Please indicate your plan to
mitigate for the projected, unavoidable loss of waters or wetlands or provide
information as to the absence of any such appropriate and practical measures.

This information is essential to our expeditious processing of your
application and it should be forwarded to us by January 22, 1993. Also, a
copy of this information must be sent to the North Carolina Division of
Environmental Management to enable them to adequately evaluate your
application for a Water Quality Certification pursuant to Section 401 of the

The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that Dallen and Eleanor
Anderson of Onslow County, filed an application on December 3, 1992, for a permit from
the Division of Coastal Management to develop in an Area of Environmental Concern and
for certification from the Division of Environmental Management that a discharge of fill
material in project wetlands will not violate applicable water quality standards.
According to said application Dallen and Eleanor Anderson propose to construct a
bulkhead with fill aligned along the shoreline of their property. Approximately 174 linear
feet of structure a maximum of approximately 22' below the mean high water (mhw) contour
is proposed. Also a dock with a boatlift in order to re-establish boat access at Chadwick

maximum of 22 feet waterward of Mean High Water (MHW) as well as to construct
a dock and boat lift. A Water Quality Certification is a statement by DEM
that no water quality standards will be violated. We have no objection to the
dock and boat lift.
However the bulkhead as presently planned will remove about 2000 square
feet of open SA water (classified for Commercial Shellfishing) and 860 square
feet of salt marsh vegetation. This action would be in violation of our
Antidegradation water quality standard (15A NCAC 2B. 0201) which states that
existing uses of water must be protected unless there is no practicable
alternative. The existing uses in this instance are aquatic life habitat,
wildlife habitat, pollutant removal, and water storage. We believe that the
bulkhead can be relocated generally landward of all marsh vegetation and/or by
constructing a breakwater along the proposed bulkhead alignment. This
redesign would result in protection of water quality and still provide
shoreline protection as you desire.
Please respond to this letter within two weeks of its receipt. Until
this matter is resolved, I hereby request that the Division of Coastal
Management and U.S. Army Corps of Engineers place this project on hold due to
insufficient information concerning alternatives. I can be reached at 919-

9. 1 PROJECT DESCRIPTION
The project is located within Chadwick Shores subdivision in Onslow County. The AIWW is
adjacent to the property. A review of the aerial photography for this site indicates that a
bulkhead without backfill was present in 1984 and 1989. The 1978 photograph also shows
the bulkhead. It appears at that time there was either no fill or a very limited amount present.
The existing structure functioned as a breakwater and now has failed to the point that some
bank erosion is occurring due to boat wave action. There is a fringe of mixed high marsh,
with scattered Spartin alterniflora interspmrsed within it, along the shoreline which ranges
from approximately 7' wide down to 0; wide. The waters within the project area are
classified as SA and are open to the taking of shellfish. The area is designated as a primary
nursery (PNA).
The applicants propose to construct a new bulkhead which would be aligned between the
ends of the existing west end of the present structure and which would connect to the end of
the existing wall on the property to the east. Approximately 174' of wall would be
constructed and would be aligned a maximum of approximately 23' off shore. A simple pier
with " T-head " and a boatlift are also proposed. The pier is shown as 6' x 8' and the "T" as
8' x 10'. The boatlift is shown as 12' x 12'.
10. ANTICIPATED IMPACTS
If the project is constructed as proposed the activity will cause to be consumed approximately
860 sf of mixed coastal wetlands as well as approximately 2052 sf of open water. It appears
unlikely that the existing structure has ever had a significant amount of fill associated with it.
Its' primary function seems to have been to serve as a breakwater and the recent
deterioration has resulted in the erosion of the bank The present request appears to be an
+attempt to create new property rather than shoreline stabilization. The pier and " T-head "
are consistent with the regulations and will cause no adverse impacts. It is recommended that
the proposed bulkhead be re-installed as a breakwater. However if the applicants wish to fill
landward of the wall it must be re-aligned landward of the coastal marsh.

8. PROJECT SUMMARY: The applicants propose to construct a bulkhead with fill aligned
along the shoreline of their property. Approximately 174 linear feet of structure a maximum
of approximately 22' below the mean high water (mhw) contour is proposed. The applicants
also propose to construct a dock with boatlift in order to re-establish boat access.

9. PROJECT DESCRIPTION
The project is located within Chadwick Shores subdivision in Onslow County. The AIWW is
adjacent to the property. A review of the aerial photography for this site indicates that a
bulkhead without backfill was present in 1984 and 1989. The 1978 photograph also shows
the bulkhead. It appears at that time there was either no fill or a very limited amount present.
The existing structure functioned as a breakwater and now has failed to the point that some
bank erosion is occurring due to boat wave action. There is a fringe of mixed high marsh,
with scattered Spartin alterniflora intersp-rsed within it, along the shoreline which ranges
from approximately 7' wide down to 0' wide. The waters within the project area are
classified as SA and are open to the taking of shellfish. The area is designated as a primary
nursery (PNA).
The applicants propose to construct a new bulkhead which would be aligned between the
ends of the existing west end of the present structure and which would connect to the end of
the existing wall on the property to the east. Approximately 174' of wall would be
constructed and would be aligned a maximum of approximately 23' off shore. A simple pier
with " T-head " and a boatlift are also proposed. The pier is shown as 6' x 8' and the "T" as
8' x 10'. The boatlift is shown as 12' x 12'.
10. ANTICIPATED IMPACTS
If the project is constructed as proposed the activity will cause to be consumed approximately
860 sf of mixed coastal wetlands as well as approximately 2052 sf of open water. It appears
unlikely that the existing structure has ever had a significant amount of fill associated with it.
Its' primary function seems to have been to serve as a breakwater and the recent
deterioration has resulted in the erosion of the bankd`I'he present request appears to be an
+attempt to create new property rather than shoreline stabilization. The pier and " T-head "
are consistent with the regulations and will cause no adverse impacts. It is recommended that
the proposed bulkhead be re-installed as a breakwater. However if the applicants wish to fill
landward of the wall it must be re-aligned landward of the coastal marsh.

Anderson for Department of the Army authorization and a State Water Quality
Certification to construct a pier and boatlift structure and construct and
backfill a bulkhead on the Atlantic Intracoastal Waterway (AIWW), Sneads
Ferry, Onslow County, North Carolina. Your receipt of this letter verifies
your acceptance of a valid request for certification in accordance with
Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by February 22, 1993, the District Engineer will deem that
waiver has occurred.
