Dear Mr. Ray:
Subject: Proposed Fill in Wetlands or Waters
Commercial development
Onslow County - DEM Project # 92733
Upon review of your request for Water Quality Certification
to place fill material in 3.0 acres of wetlands or waters in an
unnamed tributary of Mill located at Western Blvd. extension in
Onslow County, we have determined that the proposed fill can be
covered by General Water Quality Certification No. 2671 issued
January 21, 1992. A copy of the General Certification is
attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 26. An
additional condition is that a stormwater pond shall be
constructed and maintained on the site following written approval
by DEM.
If you have any questions, please contact John Dorney at
919/733-1786.
Sincerely,

relatively dense rutting caused by heavy skidder traffic when it was last timbered. Though as
significant body of evidence ( ie. well structured Ap epipedon with Munsell value >3.5, eluviation of
relic gleying in E & Btg1 horizons, eluviation of Btg ped faces, soil saturation > 18" of depth , dead
root channels eluviated & oxidized etc.) indicated the inter-rut areas do not qualify as hydric soils, the
rut inverts did often have a gleyed surface skim and saturation < 18" deep. Based on the high density
of rutting and the question of how this may be effecting hydric hydrology, the owner agreed to
include the area of the transition zone in this application. After canvassing the area with Mr Richter
(Army Corps Of Engineers), it was agreed that the total area (delineation + transition zone) does not
exceed 3 acres.

14. S'L'ATE REASONS WHY THE APPLICANT BELIEVES THAT THIS ACTIVITY MUST BE CARRIED OUT IN WETLANDS.
ALSO, NOTE MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS.
This site is located in the zoning_iurisdiction of the City Of Jacksonville. Regulatory requirements
include parking space quantity and geometry requirements, layout mandates, and similar urban
design regulations The proposed high density use storm water detention building size lot
geometry, and alignment agreement with proposed Lowes store requires total use of the available
tract This severely limits alternatives for minimizing the quantity of wetland impacts. The existing
wetlands are providing minimal water quality or other public domain uses A stormwater
management system is proposed to mitigate the quality of runoff from the developed site The existing
ditch traversing the front of the parcel is a relic remnant of prior farm drainage.

MEMORANDUM
TO: John Dorney, Division of Environmental Management
Water Quality Planning, DEHNR
FROM: Dennis Stewart, Manager AUV
Habitat Conservation Program
DATE: February 7, 1993
SUBJECT: Division of Environmental Management 401 Certification
for Mr. Richard Ray, Mill Creek, Onslow County, North
Carolina.
Professional biologists from our staff have reviewed the
subject application and conducted a site investigation on January
26, 1993 to assess project impacts on wildlife and fisheries
resources. This correspondence is provided in accordance with
certain provisions of the Fish and Wildlife Coordination Act (48
Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the North
Carolina General Statutes (G.S. 113-131 et seq.).
The applicant is requesting authorization to fill
approximately 3 acres of forested wetland for commercial
development. The project site is vegetated by a plantation of
loblolly pine with infusions of sweetgum, red maple and black
gum, providing habitat for a limited variety of wildlife species
utilizing single age pine stands.
Although the site wildlife habitat is currently of limited
value, the project should be evaluated quantitatively, in light
of foreseeable development in close proximity to this project.
Due to the nature of the project and location of the wetland area
wetland wildlife habitat values will eventually be reduced for
some species by the surrounding development. For other species,
habitat value will increase as adjacent areas are developed.
Filling 3 acres of wetlands will certainly remove any water
quality functions since water currently retained will enter
receiving waters sooner. We cannot approve of the destruction of
wetland habitat. Due to the current ability of the area to
function as wildlife habitat we could accept the project provided
that an acceptable mitigation plan is developed and implemented.
Inclusion of mitigation in project plans to offset the loss of
vegetated wetlands is recommended as a condition to authorizing
the project.
Thank you for the opportunity to review and comment on this
project. If you require additional information or need to
discuss these comments, please call Mr. Brent Wilson, Wildlife
Biologist at (919) 638-3475.

9. HAVE ANY SECTION 404 PERMITS BEEN PREVIOUSLY REQUESTED FOR USE ON THIS PROPERTY-?
YES( ) NO(X) IF YES, EXPLAIN
10. ESTIMATED TOTAL NUMBER OF ACRES OF WETLANDS LOCATED ON PROJECT SITE. 0.58 acres of positively
identified wetlands have been delineated and surveyed This area is bordered to the North and West
by a diffuse transition zone dominated by marginal soils (taxadjuncts midway between the Augusta &
Tomotly Soil Series Aeric Ochraauult & Typic Ochraguult respectively) The area is severely cut up by
-2_
relatively dense ruttina caused by heavv skidder traffic when it was last timbered. Thouaha
significant body of evidence ( ie. well structured Ap epipedon with Munsell value >3.5, eluviation of
relic gleying in E & Btg1 horizons, eluviation of Btg ped faces, soil saturation > 18" of depth , dead
root channels eluviated & oxidized etc.) indicated the inter-rut areas do not qualify as hydric soils, the
rut inverts did often have a gleyed surface skim and saturation < 18" deep.
11. NUMBER OF ACRES OF WETLAND IMPACTED BY THE PROPOSED PROJECT:
FILLED:
DRAINED:
FLOODED:
EXCAVATED:
TOTAL IMPACTED: <3 acres
12. DESCRIPTION OF PROPOSED WORK (ATTACH PLANS): (See attached map. WETLANDS
TOPOGRAPHIC SURVEY, by John L Pierce-Survevina). 180' by 270' Proposed Food Lion retail
store. Building, parking spaces, loading dock. & paved areas (- 6 acres) aligned to conform with
adjacent proposed Lowes shopping center. Remainder reserved for stormwater detention basin,
storm water collection system, and buffer needed to accommodate extensive grading to establish
stormwater outfall to rear of parcel.
13. PURPOSE OF PROPOSED WORK. Retail shopping center (locate store from less successful location)
14. STATE REASONS WHY THE APPLICANT BELIEVES THAT THIS ACTIVITY MUST BE CARRIED OUT IN WETLANDS.
ALSO, NOTE MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS.
This site is located in the zonina iurisdiction of the Citv Of Jacksonville._Reaulatorvrequirements
include parking space quantity and geometry requirements, lay out mandates, and similar urban
design regulations. The proposed high density use, storm w ater detention, building size, lot
geometry, and alignment agreement with proposed Lowes store requires total use of the available
tract. This severely limits alternatives for minimizing th e quantity of wetland impacts. The existing
wetlands are providing minimal water quality or o ther public domain uses. A stormwater
management sy stem is proposed to mitigat e the quality o f runoff fro m the developed site. The existing
ditch traversing the front of the parcel is a rel ic remnant of prior farm drainage
