The Application provides adequate assurance that the discharge of fill material into the waters of Carolina Beach Yacht Basin in conjunction with the proposed boat ramp and breakwater in New Hanover County will not result in a violation of of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the stream is 25 NTU's or less are not considered significant). 2. All concrete poured below MHW shall be poured at low tide and the forms dewatered. No wet concrete shall be placed in surface waters. 3. Rip rap shall be of sufficient size so as not to be carried off by wave action and shall be free of toxic materials. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 12th day of February, 1993. PROJECT SUMMARY: Applicant proposes to reconfigure his existing boat ramp, and place a breakwater and riprap to the north of same. Norris, Danny Page 2 9. PROTECT DESCRIPTION 12/30/92 The site is a residential lot on the north end of Carolina Beach at 311 Florida Ave. This lot sits on the Carolina Beach Boat Basin immediately east of Snows Cut. The lot begins a residential section of homes south of the Coquina Harbor Marina. This is a large protected basin with rip rap placed around it. The lot is approximately 120' x 146', and averages 5' in elevation. There is a single family residence on the site presently. A bulkhead provides for shoreline stabilization for the southern portion of the lot, but does not extend northward beyond the pier. There exists presently a pier with dock and boathouse, and a ramp north of this. This area of Carolina Beach is classified as Developed in the Local Land Use Plan. The Division of Environmental Management classifies the waters of the basin as SB. The area is not designated as a Primary Nursery Area, and is closed to the taking of shellfish. The applicant is proposing to continue his bulkhead northward to his property line, aligning it landward of the line staked by Jeff Richter (U. S. Army Corps of Engineers) as the 404 wetland line. This is approximately 61 linear feet. The yard will be backfilled landward of this. There is very little Borrichia frutescens, SSpartina patens, and Distichlis snicata mixed in with the high ground grasses and weeds in this yard and the berm adjacent to the water. This has been determined to be incidental to the boatramp allowing extreme tides to access the high ground that is not accessible by any other route. It has been determined by the DCM field representative along with the U. S. Army Corps of Engineers Representative that these three species are out of the active zone, and are not to be considered to be significant. The applicant proposed relocating his boatramp in a more southerly direction in order to have safer and more convenient access from his drive. Most of this area currently is filled with a cement ramp. There are approximately 70 square feet of sparse artina alterniflora in the southwest corner of the proposed ramp. On the northeast side, there are approximately 240 square feet of sandy bottom to be filled with the new structure. The present structure would be broken and removed from this portion of the project, exposing approximately 64 square feet of bottom that is currently filled. The proposed ramp is 12' x 35', and would extend to low water, or approximately 20' beyond mean high water on the south side, and approximately 34' beyond mean high water to the north. Because of the proximity of the project area to Snows Cut to the west and to the extensive rip rap system to the north, the current ramp receives intense undercutting. The applicant proposes to protect the new project with a breakwater and rip rap. The breakwater would parallel the boatramp to the north. It would extend the length of the ramp, 35', plus an additional 5' onto high ground. This would place the proposed breakwater approximately 34' waterward of mean high water. This structure would elevate approximately 1' above the mean high water elevation. Norris, Danny Page 3 9. PROTECT DESCRIPTION - Continued: Lastly, the applicant proposes to use the broken concrete from the existing ramp to form rip rap along the north side of the breakwater. This would once again parallel the structure for the length of the structure, and approximate 4' in width. The applicant has received permission from the Town of Carolina Beach (the adjacent property owner to the north) to place the breakwater on the property line, and the rip rap 4' into the Town's riparian corridor. 10. ANTICIPATED IMPACTS The project as proposed would cause to be filled approximately 5040 square feet of high ground mixed with few straggling wetland species that have been determined to be inactive. The ramp would cause to be filled approximately 70 square feet of sparse Spartin alterniflora. The ramp and rip rap would fill approximately 490 square feet of sandy bottom, 250 square feet of which is currently filled. There would be approximately 48 square feet of currently filled bottom area permanently exposed by the removal of the present ramp. The breakwater should pose no water quality concerns as it extends 1' above high water in a very active zone. By the same token, it should pose no hazard to navigation by its height as it should be exposed during all but the most extreme tides. It does extend approximately 35' beyond mean high water. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding ,impacts to waters and wetlands through the selection of the least damaging, ,practical alternative; second, taking appropriate and practical steps to ;minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are !available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. b. PROJECT SUMMARY: Applicant proposes to reconfigure his existing boat ramp, and place a breakwater and riprap to the north of same. Norris, Danny Page 2 9. PROTECT DESCRIPTION 12/30/92 The site is a residential lot on the north end of Carolina Beach at 311 Florida Ave. This lot sits on the Carolina Beach Boat Basin immediately east of Snows Cut. The lot begins a residential section of homes south of the Coquina Harbor Marina. This is a large protected basin with rip rap placed around it. . The lot is approximately 120' x 146', and averages 5' in elevation. There is a single family residence on the site presently. A bulkhead provides for shoreline stabilization for the southern portion of the lot, but does not extend northward beyond the pier. There exists presently a pier with dock and boathouse, and a ramp north of this. This area of Carolina Beach is classified as Developed in the Local Land Use Plan. The Division of Environmental Management classifies the waters of the basin as SB. The area is not designated as a Primary Nursery Area, and is closed to the taking of shellfish. The applicant is proposing to continue his bulkhead northward to his property line, aligning it landward of the line staked by Jeff Richter (U. S. Army Corps of Engineers) as the 404 wetland line. This is approximately 61 linear feet. The yard will be backfilled landward of this. There is very little Borrichia frutescens, Spartina patens, and Distichlis s ip cata mixed in with the high ground grasses and weeds in this yard and the berm adjacent to the water. This has been determined to be incidental to the boatramp allowing extreme tides to access the '-,h, ground that is rct. acs: ssible by any other route. It has been -' t?rr-?ned by t'je DCM field representative along with the U. S. Army Corps of Engineers kepresentative that these three species are out of the active zone, and are not to be considered to be significant. The applicant proposed relocating his boatramp in a more southerly direction in order to have safer and more convenient access from his drive. Most of this area currently is filled with a cement ramp. There are approximately 70 square feet of sparse SSpartina alterniflora in the southwest corner of the proposed ramp. On the northeast side, there are approximately 240 square feet of sandy bottom to be filled with the new structure. The present structure would be broken and removed from this portion of the project, exposing approximately 64 square feet of bottom that is currently filled. The proposed ramp is 12' x 35', and would extend to low water, or approximately 20' beyond mean high water on the south side, and approximately 34' beyond mean high water to the north. Because of the proximity of the project area to Snows Cut to the west and to the extensive rip rap system to the north, the current ramp receives intense undercutting. The applicant proposes to protect the new project with a breakwater and rip rap. The breakwater would parallel the boatramp to the north. It would extend the length of the ramp, 35', plus an additional 5' onto high ground. This would place the proposed breakwater approximately 34' waterward of mean high water. This structure would elevate approximately l' above the mean high water elevation. Norris, Danny Page 3 9. PROTECT DESCRIPTION - Continued: Lastly, the applicant proposes to use the broken concrete from the existing ramp to form rip rap along the north side of the breakwater. This would once again parallel the structure for the length of the structure, and approximate 4' in width. The applicant has received permission from the Town of Carolina Beach (the adjacent property owner to the north) to place the breakwater on the property line, and the rip rap 4' into the Town's riparian corridor. 10. ANTICIPATED IMPACTS The project as proposed would cause to be filled approximately 5040 square feet of high ground mixed with few straggling wetland species that have been determined to be inactive. The ramp would cause to be filled approximately 70 square feet ' of sparse Spartina alterniflora. The ramp and rip rap would fill approximately 490 square feet of sandy bottom, 250 square feet of which is currently filled. There would be approximately 48 square feet of currently filled bottom area permanently exposed by the removal of the present ramp. The breakwater should pose no water quality concerns as it extends 1' above high water in a very active zone. By the same token,. it. ,holild pose no h.-varO to navigation by its height as it should be exposed during all but the most extreme tides. It does extend approximately 35' beyond mean high water. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge.
