PUBLIC NOTICE
MAINTENANCE DREDGING IN WILMINGTON HARBOR OCEAN BAR CHANNEL
NEW HANOVER AND BRUNSWICK COUNTIES, NORTH CAROLINA
TO WHOM IT MAY CONCERN:
The Wilmington District, Corps of Engineers, Wilmington, North Carolina,
proposes to perform maintenance dredging in the Wilmington Harbor Ocean Bar
Channel (Baldhead Shoal Channel).
PROJECT DESCRIPTION
The work which is to begin in mid-December of 1992 and completed before
April 1, 1993 consists of the removal of all material lying above the plane
of 42 feet below mean low water within the designated limits as shown on the
enclosed sketch. The dredged material will be placed in the Wilmington
Harbor Ocean Dredged Material Disposal Site (ODMDS). The disposal site has
previously been used, and there is no development near the disposal area.
Dredged Material. Approximately 750,000 cubic yards of dredged material are
remove annually during maintenance dredging of the Baldhead Shoal Channel.
The material is mostly silt and clay with some very fine sand.
Dredging Methods. Dredging of the Wilmington Harbor Ocean Bar Channel has
historically en accomplished by ocean-going hopper dredges. The type of
dredge plant used will be based on competitive bidding.
Ocean Dredged Material Disposal Site. The Wilmington Harbor ODMDS covers an
area approximately Z.J square nautical miles and is located approximately
4 miles southwest of the tip of Bald Head Island or just beyond the 3 nautical
mile limit of the territorial sea (figure 2). The boundary coordinates for
the Wilmington ODMDS are: 33°49'30"N 078°03'06"W; 33°48'18"N 078°01'39"W;
33°47'19"N 078°02'48"W; and 33°48'30"N 078°04'16"W. The average depth of
the disposal area is 42 feet. The capacity of the existing disposal area is
large enough to accommodate the dredged material.
Disposal of dredged material in the vicinity of the Wilmington ODMDS has
occurred for several decades from the maintenance of the lower portion of
Wilmington Harbor Federal Navigation Project (approximately 800,000 cubic
yards per year). Since its designation in 1987, the disposal of dredged
material has occurred at the ODMDS from the maintenance of MOTSU (approximately
1,000,000 cubic yards per year) and from continued annual maintenance of the
Wilmington Harbor navigation channel. Future disposal at the ODMDS will
continue indefinitely in quantities comparable to those reported.

No significant mounding or other adverse impacts have been observed iW the
ODMDS. All necessary actions will be taken to ensure that the materials
dredged are appropriately-placed within the ODMDS. Those actions will include
designation of the transportation route to the disposal site, designation of
the specific area within the disposal site to be used for disposal, and thle
requirement that the dredge have a navigation recorder on board to document the
disposal locations.
In accordance with U.S. Environmental Protection Agency's (EPA) Ocean
Dumping Regulations and Criteria (40 CFR Part 227.13), samples of Baldhead
Shoal Channel materials are currently being tested to determine acceptability
for ocean disposal under Section 103 of the Marine Protection Research and
Sanctuaries Act of 1972, as amended. Ocean disposal of Baldhead Shoal Channel
dredged materials will not occur until the sediment tests, which are bioa9say
and bioaccumlation evaluations are completed, the sediments are found
acceptable for ocean disposal, and concurrence from EPA is received.
Dredging Schedule. Dredging must be performed between December 1, 1992 end
March 31, .
PROJECT IMPACTS
The effects of the ro osed dredging by an ocean-certified hydraulic

The proposed discharge of dredged material in the ODMDS from maintenance
dredging of the Ocean Bar Channels by an an ocean-certified hydraulic pipeline
dredge, or bucket and barge dredge, will take place outside of the three
nautical mile limit of the territorial sea, and, therefore, is regulated under
the Marine Proootection, Research, and Sanctuaries Act of 1972, as amended. A
Section 401 Water Quality Certificate under the Clean Water Act of 1972, as
amended, is not required. In accordance with EPA's Ocean Dumping Regulations
and Criteria (40 CFR 220-229), Part 225, an evaluation of dredged material
disposal in the Wilmington Harbor ODMDS under the Section 103 (PL 92-532),
Guidelines of the Marine Protection, Research, and Sanctuaries Act of 1972,as
amended, has been completed and is included in the Environmental Assessment and
Finding of No Significant Impact, Maintenance Dredging in Wilmington Harbor
Ocean Bar Channels. by Ocean-Certified vdraulic Pipeline or Bucket and Barqe
Dredge, with Disposal in the Wilmington Harbor Ocean Dredged Material Disposal
Site, Brunswick County, North Carolina, dated August 1991, as Enclosure I.
The proposed action has been evaluated for adherence to the requirements of
Executive Order 11988, Flood Plain Management. The Wilmington Harbor Ocean Bar
Channels and the Wilmington Harbor ODMDS are not located in the flood plain.
Beach disposal of dredged material on Bald Head Island will involve the
discharge of dredged material in the flood plain. No practicable alternative
to the project being located in the flood plain exists. Every effort will be
taken to minimize potential harm to or within the flood plain. This action is
in compliance with State/local flood plain protection standards.
The proposed action has been evaluated under Executive Order 11990,
Protection of Wetlands. The proposed action will not require dredging or
filling of any wetlands.
No impacts to known archaeological or historic resources are anticipated
from maintenance dredging of the existing Ocean Bar Channels with discharge of
dredged material in the previously used ODMDS. No impacts to known
archaeological/historical resources are expected to. occur as a result of the
discharge of dredged material on the ocean beach of Bald Head Island.
The proposed maintenance dredging of the Wilmington Harbor Ocean Bar
Channel with discharge of dredged material into the Wilmington Harbor ODMDS
will be performed in accordance with the requirements established in the
southeastern regional Biological Opinion provided by the National Marine
Fisheries Service; therefore, significant effects on species listed under the
Endangered Species Act of 1973, as amended, are not expected to to occur. If
variance from procedures outlined in the Biological Opinion prove necessary,
consultation with the National Fisheries Service will be conducted.

Maintenance dredging of Baldhead Shoal Channel and Smith Island Channel by
hopper dredging is consistent with the approved Coastal Management Program of
the State of North Carolina and local land use plans. Concurrence was received
from the State of North Carolina Department of Environment, Health,and Natural
Resources, on September 23, 1981, for Baldhead Shoal and Smith Island Channels.
Concurrence for maintenance dredging of Battery Island, Caswell-Southport, and
Southport Channels was received on November 28, 1984. A determination that the
maintenance dredging of the Wilmington Harbor Ocean Bar Channels with an;ocean-
certified hydraulic pipeline dredge or bucket and barge dredge, with dis osal
of dredged material in the Wilmington Harbor ODMDS is consistent with the North
Carolina Coastal Management Program was included in the EA/FONSI dated August
1991, for State review and concurrence.
COORDINATION
There is attached a list of State Federal and local agencies with lwhom
this activity is being coordinated.
There is no other known or anticipated relatdd dredging and discharge to be
conducted by others.
The decision to permit this work was based on an evaluation of the probable
impact including cumulative impacts of the proposed activity on the public
interest. That decision reflected the national concern for both protection and
utilization of important resources. The benefit which reasonably may be
expected to accrue from the proposal were balanced against its reasonably
foreseeable detriments. All factors relevant to the proposal were considered,
including the aesthetics, general environmental concerns, wetlands, hi toric
properties, fish and wildlife values, flood hazards, flood plain value , land
use, navigation, shoreline, erosion and accretion, recreation, water supply and
conservation, water quality, energy needs, safety, food and fiber production,
mineral needs, considerations of property ownership, and in general, the needs
and welfare of the people.
The proposed transportation of this dredged material for the purplse of
disposing of it in ocean waters has been evaluated to determine if th
proposed disposal will not unreasonably degrade or endanger human hea th,
welfare, or amenities or the marine environment, ecological systems, or
economic potentialities. In making this determination, the criteria
established by the Administrator, Environmental Protection Agency, pursuant to
section 102(a) of the Marine Protection, Research, and Sanctuaries Act of 1972,
as amended, shall be applied. In addition, based upon an evaluation b f the
potential effect which the failure to utilize this ocean disposal site will
have on navigation, economic and industrial development, and foreign and
domestic commerce of the United States, an independent determination will be
made of the need to dispose of the dredged material in ocean waters,'other
possible methods of disposal, and other appropriate locations for the disposal.

This public. notice is being distributed to all known interested persons in
order to assist in developing facts on which a decision may be made by the
Corps of Engineers with respect to the disposal of dredged material in
navigable or ocean waters. For accuracy and completeness of record, all data
in support of, or in opposition to, the proposed work should be submitted in
writing setting forth sufficient detail to support convictions. Any person
who has an interest which may be affected by the discharge of this dredged
material may request a public hearing. The request must be submitted in
writing to the District Engineer and must clearly set forth the interest which
may be affected and the manner in which the interest may be affected by this
activity. In order for such request to be given appropriate consideration, it
should be mailed or delivered to the U.S. Army Engineer District, Wilmington,
Post Office Box 1890, Wilmington, North Carolina 28402-1890, in time to be
received on or before October 26, 1992. All correspondence should refer to

This public.notice is being distributed to all known interested persons in
order to assist in developing facts on which a decision may be made by the
Corps of Engineers with respect to the disposal of dredged material in
navigable or ocean waters. For accuracy and completeness of record, all data
in support of, or in opposition to, the proposed work should be submitted in
writing setting forth sufficient detail to support convictions. Any person
who has an interest which may be affected by the discharge of this dredged
material may request a public hearing. The request must be submitted in
writing to the District Engineer and must clearly set forth the interest which
may be affected and the manner in which the interest may be affected by this
activity. In order for such request to be given appropriate consideration, it
should be mailed or delivered to the U.S. Army Engineer District, Wilmington,
Post Office Box 1890, Wilmington, North Carolina 28402-1890, in time to be
received on or before October 26, 1992. All correspondence should refer to
the number and date of this notice. For additional information concerning
