Dickson, Incorporated 1924 Cleveland Avenue Charlotte, North Carolina 28203 Dear Mr. Hemker: Reference is made to your application of June, 1992, for Department of the Army authorization to place fill material into waters and wetlands associated with an unnamed tributary to the Tar River to effect installation of a 6-inch diameter gravity force main near Sharpsburg, Nash County, North Carolina. By letter dated June 29, 1992, you were advised that the proposed work could be authorized by a nationwide permit in our regulations (No. 12) provided all permit conditions were adhered to, including our written approval of submitted plans for the project. By letter dated August 31, 1992, you submitted workplans along with a brief description of the proposal. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 404 of the Clean Water Act, was provided for the discharge of material for backfill or bedding for utility lines, including outfall and intake structures, provided there is no change in pre-construction contours. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This nationwide permit does not relieve you of the responsibility to obtain any required state or local approval, including a Section 401 Water Quality Certification. Questions concerning Water Quality Certification should be addressed to Mr. John Dorney, North Carolina Division of Environmental Management, at telephone (919) 733-1786. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity r : to -2- would no longer comply with the terms and conditions of the nationwide permit, activities which have ccmTenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. The gravity sewer is being constructed to eliminate the onsite wastewater treatment of the domestic wastewater generated from the terminal and hanger facilities. The gravity sewer will collect the wastewater and direct it to a lift station adjacent to airport property on NC 97. The lift station will then pump the wastewater to the Town of Sharpsburg for discharge and treatment. To provide gravity sewer service to all possible wastewater generators requires the sewer to cross a storm drainage basin developed for the airport. This basin is considered wetlands, which prompted the design to follow the requirements associated with construction activities located within wetlands and the request for this permit. Attached is a plan of the gravity sewer layout on the airport property, which delineates the wetlands impact. Also enclosed is a joint application form and portions of the design plans on 8-1/2" x 11" photocopies of the "creek crossing" in plan and profile, including details. I n),111.......
