One was the apparent failure of a stormwater infiltration system receiving runoff from Howe Point Place which discharges overflow water into the drain at the front of the Lewchuk Property. The other was the applicants proposal to reroute stormwater through the subject property and discharge it into Howe Creek. During early meetings with the applicant and Landfall representatives it was stated that for this office to make positive recommendations on this project the infiltration system would have to be corrected and the process of rerouting stormwater through the property would have to afford equal or better treatment of the stormwater than that which the wetlands on the property were currently providing. Per the attached memo, it is my understanding these two issues have been resolved. Project Summary AREA Dredged Filled Other the sideline of his property in order to lessen the potential threat to the proposed residence from water underneath. 9. PROJECT DESCRIPTION The proposed project is located within the Pembroke Jones Park portion of the Landfall Subdivision on Howe Point Place on an upper arm of Howe Creek. This area is within the outstanding Resource Water (ORW) Area of Environmental Concern Classification. There is an existing drain on the property which extends landward from the waters' edge. This drain separates the lot into two segments of highground divided by the wetland pocket. There is an existing border of Spartina alterniflora along the shoreline of the property crossing the drain. Just landward of this species there is a fringe of Juncus romerianus across the drain. Still further landward in the drain are several stems of Scirpus step. This species can be confused with Spartina alterniflora on casual observation. Other non- identified fresh water species have developed in the drain above the Scirpus. These higher wetlands are under the exclusive jurisdiction of the Corps of Engineers. In fact, a Nationwide Permit #26 was issued for a retaining wall on the property to be aligned approximately 50' landward of the mean high water contour. The letter of authorization for this document was dated December 31, 1992. The existing drain on the property has been described by some as a significant feature and the implication has been that it is a natural feature which drains a significant area. My field observations indicate, as well as the Corps Nationwide Permit issued for areas above headwaters, that the drain stops at the road. The topography across the road is such that it does not appear likely that any significant upstream alteration resulted from the creation of the road. The origin of the water in the drain appears to be linked to two sources. The first is seepage from the slopes of the property. The other is a drain which apparently connects to an infiltration trench located across the road. There was a slow but steady flow observed from this drain which suggested that the infiltration system is not functioning correctly.. This fact has been established by a study done at the request of the Division of Environmental Management by Landfall Associates and reported to DEM in early June. A copy of this report has just become available to this Division, although an earlier memo had been received referring to the infiltration system and the acceptance by DEM of the upgrade of the system proposed by Landfall Associates. This portion of the Creek is classified as SA and is open to shellfishing. The area is also designated primary nursery area. The applicant is proposing to construct a retaining wall across the existing drain and backfill landward of the structure. In order to accomplish this proposed work he also proposes to re-route the existing drain ditch toward the southern property line. A residence and drive is also proposed. The drainage ditch will consist of an excavated trench approximately 21" wide at the bottom. The trench will be lined with rip rap stone encased by a filter cloth lining. A perforated pipe will convey the existing discharge from the infiltration system drain down the course of the trench over the rip- rapped material. A 18" radius plastic porous safety cap will be placed over the trench. Fill material will be used above this pipe to create a vegetated swale which will convey the run-off from the adjacent lot to the south and ground seepage run-off originating on the lot toward the existing creek. (Figure 4). The structure will terminate just waterward of the proposed bulkhead into a rip-rapped area. The retaining wall will be approximately 50' landward of the mean high water (mhw) contour. This structure will also be approximately 20' landward of the mixed high marsh area. The residence is proposed to be located approximately 75' landward of the mhw contour.This locates it approximately 25' landward of the proposed bulkhead. The house plan on figure 2 shows the house as approximately 2700 s.f. in area. The drive and walks will be approximately 3000 s. f. and the detached garage will be approximately 770 s.f. The total built upon area will be approximately 6470 s.f. The applicant has calculated a lot size of approximately 26,293 s.f. upon which to base his density calculation. In a separate action the developers have indicated that additional infiltration line will be added to the existing system across the existing road. This should significantly reduce the amount of water now entering the applicants property through the existing drain. 10. ANTICIPATED IMPACTS The proposed project is located within an ORW Area of Environmental Concern. The activity requires major CAMA permit authorization. The fact that a Corps Nationwide #26 was required for the retaining wall has elevated the action to the major permit category. The retaining wall alignment will consume approximately 1500 s.f. of high 11404" wetlands. The Nationwide permit authorizes this action. There may be a conflict with this action and the land use classification of resource protection. The project is also within the county's conservation overlay district with respect to zoning. There is a requirement of a 75' "no-build" area within this special zoning area. There is an apparent dispute between the applicant and the New Hanover County Zoning Office concerning the application of this setback. The applicant has requested a variance from the zoning board of adjustment for a change in the reference point from which to measure the 75' and also for a variance to alter the drainage way. His request was denied and is presently being adjudicated in Superior Court. The proposed project appears consistent with CAMA regulations as they guide development within the ORW AEC. The built- upon area does not exceed 25%. The re-routing of the drainage way is not a storm water management scheme. Corps authorization has been obtained to fill their jurisdictional wetlands. We employed Soil Tech Engineering to determine soil and water table conditions. A copy of Soil Tech's report is attached. The soils investigation indicated that the infiltration system is not emptying properly due to a poorly drained clayey sand surrounding the bottom half of the infiltration line. As expected due to the topography, there was no indication of groundwater influence on the system. The current infiltration system consists of 240 if of 24-inch perforated pipe laid in an 8' ,de by 4' deep stone trench. It is our plan to improve the infiltration by extending a new line parallel to Howe's Point Place toward soil boring locations 2 and 3. Since the bottom half of the existing line is not functioning properly, we propose to extend 120 if of 24-inch perforated pipe in an 8' by 4' stone bed. This will add 50 percent to the capacity of the existing system and essentially replace the bottom half of that system. We are proceeding to obtain quotes for the proposed work. The purpose of this evaluation was to determine the subsurface conditions along to a stormwater- discharge line and to determine the suitability of the subsurface soils for stormwater infiltration in adjacent areas. On May 21, a test pit was excavated next to the existing infiltration discharge line. The line is a 24 inch diameter perforated pipe which appeared to be laid on, North Carolina Department of Transportation (NCDOT) graded #57 stone. Our investigation found that the upper- 5 feet of subsur ace soils was .a tan relatively clean sand which was underlain to tihe dept`; oF the ex, aviation with red/gray mottled firm ciayey sand. We also observed the discharge pipe was half full of water discharge water. It is our opinion that the lower firm clayey sand is preventing the infiltration of the collected stormwater at an acceptable rate. Although some. infiltrating is occurring, collected stormwater is being held within the existing discharge pipe longer than the, maximum 5 days specified under the current state regulations for the collection and discharge of stormwater. On May 22, 1992, an additional study of the soils in the vicinity of the existing infiltration line was conducted. The purpose of this study was to locate suitable soils for additional infiltration of the collected stormwater. At five randomly-Se„ected locations along the western edge of Hcwes Point Drive, a hand auger probe was advanced to six feet below the present ground surFace. At each, location the various soils encountered were classified by depth and" samples of each strata was delivered to our laboratory. Once received, selected samples were tested for grain size analysis in accordance with the American Society for Testing- and Materials (ASTM) procedures entitled ASTM D-422, "Particle Size Analysis of Soils." However, at Location #4 similar soils as those found adjacent to the existing discharge pipe were encountered. It is our opinion that without actual infiltration testing an accurate rate of infiltration of stormwater can riot be determined. It is our opinion that by adding additional infiltration discharge lines from the present catch basin collection point, that this additional line will allow discharge of the collected waters. The area along Howes Point Drive south of the catch basin appears to be the best area to infiltrate collect-Pd stormwater. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. b. It is necessary for you to have taken all appropriate and practical steps to minimize wetland losses. Please disregard our letters to you of July 28, 1992. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP) Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. The discharge does not cause the loss of more than 10 acres of waters of the United States; b. The permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. The discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Your work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the N.C. Division of Environmental Management and, in the coastal area, a consistency determination from the N.C. Division of Coastal Management. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. -2- This verification will be valid for 2 years from the date of this letter unless the NWP authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization.
