Dear Mr. Cullipher:
Reference your recent application for Department of the Army authorization
to fill 0.826 acre of wetlands adjacent to Parrot Swamp, in the Foxtrace
subdivision, Section 2, off of Sandridge Road in Hubert, Onslow County, North
Carolina.
In discussing this matter with Mr. Larry Baldwin of Land Management, Inc.,
Mr. Jeff Richter of my staff was informed that previous work within Foxtrace
has impacted 5,101 square feet of jurisdictional wetlands, or approximately
.11 acre. This fill has been authorized by our Nationwide Permit (NWP) 26.
Your request, added to this previous fill, totals less than one acre of
wetlands, and can be authorized by NWP 26. Please be aware that any further
fill requested under this NWP within Foxtrace must be applied for under the
guidelines of our Pre-discharge Notification.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization was provided, pursuant to Section 404 of the Clean Water Act,
for discharges of dredged or fill material into headwaters and isolated
waters.
Your work is authorized by this NWP provided it is accomplished in strict
accordance with the enclosed conditions and provided you receive a Section 401
water quality certification from the North Carolina Division of Environmental
Management and, in the coastal area, a consistency determination from the
North Carolina Division of Coastal Management. You should contact Mr. John
Dorney, telephone [phone], regarding water quality certification, and
Mr. Steve Benton, telephone [phone], regarding consistency
determination. This nationwide permit does not relieve you of the
responsibility to obtain other required State or local approval.

concurrence letter is hereby modified to reflect that fact.

Upon review of your request for 401 Water Quality
Certification to place fill material in 0.83 acres of wetlands or
waters for residential lot fill for Hooks and Kinlaw, Group
Eight, Ltd. located at Foxtrace Subdivision, SR 1501 in Carteret
County, we have determined that the proposed fill can be covered
by General Water Quality Certification No. 2671 issued January
21, 1992. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers' Nationwide Permit No. 26. A sewer extension permit
will be required from the Division of Environmental Management
and this 401 Certification is conditional upon approval of the
sewer permit.

Based on our records, there are no Federally-listed endangered or
threatened species which may occur within the project impact area.
The attached page(s) list(s) the Federally-listed species which
may occur within the project, impact area.
If the proposed project will be removing pines greater than or equal
to 30 years of age in pine or pine/hardwood habitat, surveys should
be conducted for active red-cockaded woodpecker cavity trees in
appropriate-habitat within a 1/2 mile radius of project boundaries.
If red-cockaded woodpeckers are observed within the project area or
active cavity trees found, the project has the potential to
adversely affect the red-cockaded woodpecker, and you should contact
this office for further information.
The Service concurs that the+I proposed project is not likely to
adversely affect Federally-listed endangered or threatened species,
their formally designated critical habitat, or species currently
- proposed for Federal listing under the Endangered--Species Act, as
amended.
Staffing limitations prevent us from conducting a field inspection
of the project site. Therefore, we are unable to provide you with

proposed project and wetland impacts. We feel. that we have
minimized the fill area such that the majority of proposed fill.
