DEM policy is to issue Certifications to the present landowner since the responsibility to follow Certification conditions relates to the landowner. I would suggest that you obtain from Mr. Hoffman a written agreement to follow the conditions of the 401 Certification (and subsequent CAMA/COE permit). This measure should clarify the responsibility of any persons who act on your behalf to fill the property and conduct wetland mitigation. Once Mr. Hoffman obtains the property, the 401 Certification and its conditions (such as mitigation) will become his responsibility as landowner. Another approach would be to have Mr. Hoffman purchase the property before the fill occurs. Then DEM could modify the Certification to apply to the new landowner. The Application provides adequate assurance that the discharge of fill material into the waters of wetlands adjacent to Burnt Mill Creek in conjunction with the proposed lot fill in New Hanover County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. The applicant is also proposing to create approximately 1000 sq. ft. of new wetlands and upgrade approximately 2000 sq. ft. of existing wetlands on the property. ADJACENT WATER BODY: Burnt Mill Creek CLASSIFICATION: CSw The project has been reviewed to determine impacts to water quality. The following comments have been provided. The project will require an individual 401 Water Quality Certification. Due to the disturbed nature of the wetlands on the project site, the filling of 0.04 acres of these wetlands should have minimal impact on water quality. The fact that the applicant is proposing to create/enhance 3000 sq. ft. of wetland areas should offset any habitat loss, however the applicant should be required to submit a detailed mitigation plan to this division for review prior to final decision on the 401 Certification. MARC HOFFMAN, AGENT FOR MS. AGNES WOODRUFF, Post Office Box 3325, Wilmington, North Carolina, 28406 has applied for a Department of the Army (DA) permit TO PLACE FILL MATERIAL IN WETLANDS ADJACENT TO BURNT MILL CREEK, OFF 21ST STREET, IN WILMINGTON, New Hanover County, North Carolina. .The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the U.S Army Corps of Engineers. Plans submitted with the application show that the agent plans to build houses on four lots at this site. Two of these lots include wetlands which are to be impacted by the proposed project. A total of 1900 square feet (0:04 acre) of wetlands are to be impacted by this work. The site is considered adjacent wetlands, even though the past construction of a sewer line of the placement of spoil disposal resulting from a channelization project along Burnt Mill Creek has cut off a direct connection to the creek. The site is located below headwaters. The area in question has been disturbed to some degree by various activities including road construction and subdivision development. Vegetation on the site includes cypress, tulip poplar, poison ivy, wild grape, smilax, and ligustrum. Soils are hydric, characterized by a mixture of organics, sand, clay and muck. This mix is possibly a result of past disturbance. Upon completion of the proposed work, the applicant has proposed to create some wetlands. This proposal would involve the removal of earthen material to wetland elevations, followed by the planting of wetland species of vegetation. The applicant proposed mitigating approximately 3,000 square feet of land. However, a portion of the mitigation site includes area previously designated as wetlands. As a result, approximately 1,000 square feet of new wetlands will be created, with the remainder probably an upgrade of wetland values within existing wetlands. The purpose of the work is to create suitable building sites in wetlands. Plans showing the work are included with this public notice. The applicant has determined that the proposed work is consistent with the North Carolina Coastal Zone Management Plan and has submitted this determination to the North Carolina Division of Coastal Management for their review and concurrence. This proposal shall be reviewed for the applicability of other actions by North Carolina agencies such as: r ?r 'low -2- a. The issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the North Carolina Division of Environmental Management.; b. The issuance of a permit to dredge and/or fill under North Carolina General Statute 113-229 by the North Carolina'Division of Coastal Management. c. The issuance of a permit under the North Carolina Coastal Area Management Act (CAMA) by the North Carolina Division of Coastal Management or their delegates. d. The issuance of an easement to fill or otherwise occupy State-owned) submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11, and 146-12 by the North Carolina Department of Administration and the North) Carolina Council of State. e. The requested DA permit will be denied if any required State or local authorization and/or certification is denied. No DA permit will be issued until a State coordinated viewpoint is received and reviewed by this agency.! Recipients of this notice are encouraged to furnish comments on factors of concern represented by the above agencies directly to the respective agency,', with a copy furnished to the U.S Army Corps of Engineers. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. -3- The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The U.S Army Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the U.S Army Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. i .I ' -4- Generally, the decision whether to issue this DA permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serves as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, DEM, Salisbury Street, Archdale Building, Raleigh, North Carolina. Price range of existing homes is between 40 and 60 thousand dollars. Square footage range is between 850 to 1300 sq. ft. The project homes to be constructed will be between 900 to 1100 sq. ft. The project goal is to offer affordable housing to the community. The builder proposes to fill and place a concrete foundation in the existing wetland -area (see diagram). This will be approximately 1800 to 2000 sq. ft. The builder will then mitigate approximately 3000 sq. ft. to be designated as new wetlands. Our review has indicated that the proposed project does not violate any mandatory and enforceable provisions of the North Carolina Coastal Management Program, and we agree with the applicant's certification that the proposed activity is consistent with the North Carolina Coastal Management Program provided that: 1. A 401 Water Quality Certification is issued for the project by the North Carolina Division of Environmental Management. 2. A Sedimentation and Erosion Control Plan, if required, is filed with the Division of Land Quality within 30 days prior to the onset of work. During the course of our review we did receive comment from the North Carolina Wildlife Resources Commission pertaining to the proposed mitigation plan. The current plan calls for mitigation of the loss of the 1l(X) square feet of wetlands by reducing the elevation of 3000 square feet and the planting of wetland species. The Wildlife Resources Commission considers this proposal to be inadequate since some of the mitigation area is already designated wetlands.
