Dear Sir:
As a property owner in Porters Neck, I strongly oppose the intent of a commercial venture to
construct boat ramps off Bald Eagle Lane. The impact on the residential area and adjacent
waters that have been designated as Outstanding Resource Waters would be devastating. The
quality of the waters between Porter's Neck and Wrightsville Beach have noticeably
deteriorated over the past 15 years as more water access points have become available. Efforts
to maintain water quality and protect the environment have not been able to keep up.
The developers have only financial reasons for wanting a boat ramp. The cost the citizens of
North Carolina, in particular Pender and New Hanover counties, will pay is continued
deterioration of ORW with losses of fishing, crabbing and clamming that go with it. Existing
water access at Scott's Hill Marina and Johnson's Marina provide adequate water access that
is State approved and can accommodate many more patrons. Maintaining the ORW with
expanded use of existing approved facilities will be a challenge. The addition of more access
points to an area under adverse environmental pressure to provide financial gain for
developers seems very unwise. The developers' strategy to advertise that they have boating
facilities and fishing access is, in my opinion, unethical and and illegal. I hope and trust that
those people and agencies who have jurisdiction in these matters will do what is right for all
North Carolina citizens and not be pressured by a special interest group.
My own experience with fishing, crabbing, clamming and oystering in the waters between
Porter's Neck and Figure 8 Island has given me cause for concern as the availability of these
natural resources are declining. My belief is that pressure from adverse environmental
sources is a significant contributor to this deterioration. These inland waters are extremely
important to the marine (and water fowl) ecology. Without resources 1lb?e i16se, ine uiure :r
fish and shellfish in this area can not be very optimistic.
I hope you will agree with me and reject the proposal to allow a special interest group, for
solely financial reasons, deprive the people of North Carolina, New Hanover and Pender

Dear Mr. Parker:
Reference the application of the Vort4r_'$.Neck Homeowners' Association for
a Department of the Army permit to construct piers, floating docks, ramps and
parking areas for two community boat access sites on the Atlantic Intracoastal
Waterway (AIWW), Middle Sound, Porters Neck, New Hanover County, North
Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. No vegetated wetlands will be excavated or filled.
b. This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.
C. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
d. If the display of lights and signals on the authorized structure is
not otherwise provided for by law, such lights and signals as may be
prescribed by the U.S. Coast Guard will be installed and maintained by and at
the expense of the permittee.

e. It is possible that the authorized structure may be damaged by
wavewash from passing vessels. The issuance of this permit does not relieve
the permittee from taking all proper steps to ensure the integrity of the
permitted structure and the safety of moored boats. The permittee will not
hold the United States liable for any such damage.
f. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
g. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 50 NTU's or less are not considered significant.

Our Conservancy membership, about 300, consists of persons
who own property in the area between US Highway 17 (north of Wil-
mington) and the ocean and includes the basins of Futch Creek on
the northeast and Howe Creek on the southwest. We have always
been strong supporters of CAMA and DEM efforts to protect the
natural resources of the coast.
Recently our members have become perplexed by inconsistencies
in two DMA, actions.
First, Figure Eight Island was encouraged by CAKA to apply
for a much needed, self financed, beach nourishment project. Yet
when the permit was finally granted, it authorized the excavation
of less than half of the borrow deemed minimally adequate to nour-
ish the beach. This was in spite of the fact that there exists a
1969 Federally approved channel which if reopened could provide
the necessary borrow.
Second, the Conservancy sponsored research which was instru-
mental in the designation of Middle Sound as Outstanding Resource
Waters (ORW). Protection of this ORW was to be assured by the re-
quirement that no more than 25016 of the area within 575 feet of
this ORW be impervious. Yet DCM is processing a major permit which
would allow development of two water accesses at Porters Neck for
autos and boat trailers, attempting to evade this impervious re-
quirement by the absurdity of using pine straw to "pave" the steep
accesses and parking areas. How long will it be before several
truck loads of pea gravel are used to patch the disappearing,
ineffective pine straw?
We cannot fault the developers for attempting to use this as
a sales pitch for the thousand plus lots planned to sell in their
closeby subdivision. However, we hope that DCM and DEM will take
action to assure continued protection of this ORW.

9. PROJECT DESCRIPTION
The Porter's Neck Project is located at two sites on Bald Eagle
Lane in New Hanover County. Bald Eagle Lane is parallel to
Middle Sound at the dead end of Porter's Neck road off of U.S. 17
just north of Wilmington. There are two proposed community
access sites planned - one north of 8340 Bald Eagle Lane, and one
north of 8536 Bald Eagle Lane.
These are high ground, 60' wide sites. Site B, the northern site
(north of 8536 Bald Eagle) has a steep drop to the water. At
this site, there is approximately 20 square feet of Spartina
patens to the north side of the lot at the waters edge. There
are residential piers all along this shoreline.
Site A is the southern site, north of 8340 Bald Eagle Lane. This
too is a high ground site, cleared and mown, which is bulkheaded
at the waters edge. There is a border of approximately 25' of
Spartina alterniflora. The water bottom at both sites is sandy.
The waters of Middle Sound are classified SA-ORW by the Division
of Environmental Management. They are designated Primary Nursery
Area by the Division of Marine Fisheries, and are open to
shellfishing. New Hanover County classifies this area as
Resource Protection, which limits development to 2.5 units per
acre, and provides for preservation and protection of important
natural, scenic, wildlife, and recreational resources.
The two sites have been held for community access since the area
was developed originally. The accesses were originally owned by
the Champ Davis Foundation. By deed, the residents on the west
side of Bald Eagle Lane are granted use of these accesses. The
residents on the east side, or the waterfront properties, were
never legally entitled to use the areas, but have been allowed
use of them as a courtesy. According to the applicant, there is
no intention to change this.
There is a plantation of some 800 acres inland of these sites.
This area has been under development since 1987. The first
section - Creekside - was developed in 1987. The rest of the
acreage was purchased in 1988. The two access sites were a part
of this purchase. Construction began on the remainder of
Porter's Neck Plantation in 1989. There are to be 1000 - 1500
single family homesites in the development when completed. These
residents will also have access to the two sites.
Because of the number of potential users of the sites, the
applicant has supplied an addendum to the application stating the
intent on the part of the Homeowners Association to adopt rules
and regulations governing use, including prohibitions to park on
the street or extended boat trailer parking on the lots. The
addendum states the intent to maintain the community access sites
in a clean and uncluttered condition, and to deny access to
anyone not abiding by the rules.

25' of Spartina alterniflora adjacent to it. There is no ramp
proposed at this site. There is a pier proposed in the center of
the lot, 27.5' from each riparian corridor. The pier is 5' wide
and 60' in length. At the waterward end there is a 5' x 30'
T-head. The widest point of the T-head is 15' from each
riparian corridor. There is a floating dock extending from the
T-head, 4' x 621. At this point, the depth is -2.4' mean low
water. This structure extends 125' from mean high water into a
body of water >600' across. There are piers of similar lengths
and longer along this shoreline. The floating dock will support
dockage of up to 4 boats.
The entrance and drive at this access are formed of asphalt
ending in a cul-de-sac arrangement. The total impervious
coverage is 24%. Only picnic tables will be within the 30'
Outstanding Resource Water buffer.
There are 8 parking spaces at this site, all lain in pine straw.
10. ANTICIPATED IMPACTS
Though there could be some 1,540 homeowners with access to these
sites, the subdivision restrictions prohibiting parking in areas
other than approved sites, together with the parking areas
limited to 17 spaces should prevent overcrowding in a residential
area.
There is a concrete extension of the pier to the ramp at site B.
This is within the 30' buffer associated with ORW's and is thus
prohibited in T15A:07H.0209(f)(B). The applicant has agreed to
change this to an elevated wooden structure. There are no
mooring pilings associated with either structure at this time,
which would make overnight dockage an unappealing option.
The pier at Site B crosses the only access channel existing for
the piers to the north. In effect, this structure would block
navigation from these residences at all but the higher tides.
This is inconsistent with T15A:07H.0208 (B) (6) (C) (ii) .
The boat ramp will incorporate approximately 450 square feet of
shallow, sandy bottom. Pier B will incorporate 375 square feet
of public trust waters. The deck and dock will incorporate 625
square feet of public trust waters This is inconsistent with
T15A: 07H.0208 (B) (6) (B) .

The pier at Site A will shade 125 square feet of Spartina
alterniflora. It will incorporate 175 square feet of public
trust waters. The T-head and floating dock will incorporate
approximately 398 square feet of public trust waters. There is
24% impervious coverage on high ground.
Projects at both sites meet with the 1/3 rule, the riparian
corridor setbacks, and the 25% impervious coverage allowed within
ORW Estuarine Shorelines.

The Association will adopt rules and regulations
governing the utilization of the common area facilities which
are the subject of the permit application. These rules and
regulations will include prohibitions against parking on the
adjoining street or street right-of-way, and prohibitions
against extended parking of boat trailers on the subject
property. . It is the intent of the Association, and Porters
Neck Company, Inc., to maintain all its recreational
facilities, including water accesses, in a clean and sightly
and uncluttered condition, and the Association will adopt
rules as are necessary to ensure that the water accesses are
managed in a way consistent with the upper scale development
ongoing at Porters Neck.
While the existing owners of the old Porters Neck
development have the right to utilize the water accesses,
these owners are not part of the "Association, nor do they have
a formal and mandatory homeowners association in place, to the
best of the knowledge of the Association. Therefore, the
existing owners cannot be mandated to contribute to the
maintenance and upkeep of the accesses and the improvements
thereon, nor can the Association, directly, enforce its rules
and regulations regarding these existing homeowners. However,
it is the position of the Association' that it can deny
utilization of the accesses to any owners not abiding by the
rules and regulations adopted for the common good of all users
of the facilities, and the Association will exercise its
prerogative to deny access to the access areas to owners,
either members of the Association or not, that refuse to abide
by the rules and regulations adopted for the common good.

9. PROJECT DESCRIPTION
The Porter's Neck Project is located at two sites on Bald Eagle
Lane in New Hanover County. Bald Eagle Lane is parallel to
Middle Sound at the dead end of Porter's Neck road off of U.S. 17
just north of Wilmington. There are two proposed community
access sites planned - one north of 8340 Bald Eagle Lane, and one
north of 8536 Bald Eagle Lane.
These are high ground, 60' wide sites. Site B, the northern site
(north of 8536 Bald Eagle) has a steep drop to the water. At
this site, there is approximately 20 square feet of Spartina
patens to the north side of the lot at the waters edge. There
are residential piers all along this shoreline.
Site A is the southern site, north of 8340 Bald Eagle Lane. This
too is a high ground site, cleared and mown, which is bulkheaded
at the waters edge. There is a border of approximately 25' of
Spartina alterniflora. The water bottom at both sites is sandy.
The waters of Middle Sound are classified SA-ORW by the Division
of Environmental Management. They are designated Primary Nursery
Area by the Division of Marine Fisheries, and are open to
shellfishing. New Hanover County classifies this area as
Resource Protection, which limits development to 2.5 units per
acre, and provides for preservation and protection of important
natural, scenic, wildlife, and recreational resources.
The two sites have been held for community access since the area
was developed originally. The accesses were originally owned by
the Champ Davis Foundation. By deed, the residents on the west
side of Bald Eagle Lane are granted use of these accesses. The
residents on the east side, or the waterfront properties, were
never legally entitled to use the areas, but have been allowed
use of them as a courtesy. According to the applicant, there is
no intention to change this.
There is a plantation of some 800 acres inland of these sites.
This area has been under development since 1987. The first
section - Creekside - was developed in 1987. The rest of the
acreage was purchased in 1988. The two access sites were a part
of this purchase. Construction began on the remainder of
Porter's Neck Plantation in 1989. There are to be 1000 - 1500
single family homesites in the development when completed. These
residents will also have access to the two sites.
Because of the number of potential users of the sites, the
applicant has supplied an addendum to the application stating the
intent on the part of the Homeowners Association to adopt rules
and regulations governing use, including prohibitions to park on
the street or extended boat trailer parking on the lots. The
addendum states the intent to maintain the community access sites
in a clean and uncluttered condition, and to deny access to
anyone not abiding by the rules.

9. PROJECT DESCRIPTION - Continued:
The proposal for the north site (site B) is to construct a boat
ramp for launching. This ramp will be constructed of poured
concrete, 15' wide, extending 30 feet beyond mean high water to
the 2' mean low water contour.
There is a fixed pier, 15' from the northern riparian corridor,
and greater than 15' from the southern corridor. The pier will
be 5' wide by 75' in length. This will join a deck with gazebo,
18' x 191. The pier will then extend approximately 7' past the
gazebo to support a ramp down to a floating dock, 62' x 41. This
dock will support up to 4 boats. From mean high water, the total
structure extends 147' into a body of water >700' across. This
deck and dock comprise 625 square feet.
At this site, there is an area that must be considered the
channel for access by boats moored at the piers to the north. As
the aerial photography shows, there is a channel providing
singular access to deep water along this shoreline. Though the
channel is shoaled from the project southward, it is still
approximately 1' deeper than the adjacent shoaled areas to the
east and north of this channel.
The channel drops to approximately 1' lower in elevation for a
span of 20 - 25' before beginning to shallow again. This drop
begins approximately 65' - 70' from mean high water.
As proposed, this project will extend over and beyond the
channel, blocking access.
There is an area extending from the ramp inland, constructed of
asphalt for vehicular access. Because of the 30' buffer
associated with Outstanding Resource Waters, this structure is a
continuation of the ramp, 15' wide, until it reaches 30' from
mean high water. There is then an area of asphalt coverage for
gear drop and turn around, and 3 car parking areas. Total
impervious coverage is <24%.
The pier is proposed to continue around from the landward end to
the boat ramp as concrete. The applicant has agreed to change
this to a raised wooden continuation of the pier, once again to
accommodate the 30' buffer:
The entrance drive to the site and the 6 trailer parking spaces
are to be lain in pine straw.
Site A is the southern access, north of 8340 Bald Eagle Lane.
This too is a high ground site, with mown lawn grasses. There is
a bulkhead at the site presently, with a fringe of approximately

25' of Spartina alterniflora adjacent to it. There is no ramp
proposed at this site. There is a pier proposed in the center of
the lot, 27.5' from each riparian corridor. The pier is 5' wide
and 60' in length. At the waterward end there is a 5' x 30'
T-head. The widest point of the T-head is 15' from each
riparian corridor. There is a floating dock extending from the
T-head, 4' x 621. At this point, the depth is -2.4' mean low
water. This structure extends 125' from mean high water into a
body of water >600' across. There are piers of similar lengths
and longer along this shoreline. The floating dock will support
dockage of up to 4 boats.
The entrance and drive at this access are formed of asphalt
ending in a cul-de-sac arrangement. The total impervious
coverage is 24%. Only picnic tables will be within the 30'
Outstanding Resource Water buffer.
There are 8 parking spaces at this site, all lain in pine straw.

The pier at Site A will shade 125 square feet of Snartina
alterniflora. It will incorporate 175 square feet of public
trust waters. The T-head and floating dock will incorporate
approximately 398 square feet of public trust waters. There is
24% impervious coverage on high ground.
Projects at both sites meet with the 1/3 rule, the riparian
corridor setbacks, and the 25% impervious coverage allowed within
ORW Estuarine Shorelines.

chartered for the purpose, among others, of establishing rules
and regulations governing the use of common areas and
facilities. By Restrictive Covenants for Porters Neck
Plantation recorded in Book 1555, Page 957 et seg., New
Hanover County Registry, .the Association is given express
authority to adopt rules and regulations for the benefit of
the owners within Porters Neck Subdivision.

The Association will have as members homeowners
within that portion of the Porters Neck Development developed
by Porters Neck Company, Inc. Porters Neck Company, Inc. is
the owner of approximately 800 acres of property. The two
waterfront tracts which are the subject of this permit
application were conveyed for the express purpose of providing
water access to the tract being developed by Porters Neck
Company, Inc.
The golf course within Porters Neck Plantation has
been constructed, and the first phase of the development has
begun. While future phases are not yet planned in detail, it
is currently contemplated that the 800 acres will ultimately
include a golf course (now constructed), other recreational
amenities and facilities, including tennis courts, swimming
pool and a clubhouse, all to serve an estimated 1,000 single
family homeowners. The development itself is solely
residential, to consist of single family lots and patio/club
homes. It is currently estimated that the development will
ultimately include between 1,000 and 1,500 homes.
The development will be served by New' Hanover County
water and sewer. The main extensions have already been
installed. The project was reviewed for stormwater management
purposes by D--.M prior to commencement of construction, and
wetlands were delineated and avoided in the development
process.
The engineering firm of McKim & Creed has acted as
project engineers. McKim & Creed will review the plans which
are the subject of the permit application to ensure that there
is no excessive stormwater runoff into adjoining waters.

The Association will adopt rules and regulations
governing the utilization of the common area facilities which
are the subject of the permit application. These rules and
regulations will include prohibitions against parking on the
adjoining street or street right-of-way, and prohibitions
against extended parking of boat trailers on the subject
property. It is the intent of the Association, and Porters
Neck Company, Inc., to maintain all its recreational
facilities, including water accesses, in a clean and sightly
and uncluttered condition, and the Association will adopt
rules as are necessary to ensure that the water accesses are
managed in a way consistent with the upper scale development
ongoing at Porters Neck.
While the existing owners of the old Porters Neck
development have the right to utilize the water accesses,
these owners are not part of the 'Association, nor do they have
a formal and mandatory homeowners association in place, to the
best of the knowledge of the Association. Therefore, the
existing owners cannot be mandated to contribute to the
maintenance and upkeep of the accesses and the improvements
thereon, nor can the Association, directly, enforce its rules
and regulations regarding these existing homeowners. However,
it is the position of the Association' that it can deny
utilization of the accesses to any owner-s not abiding by the
rules and regulations adopted for the common good of all users
of the facilities, and the Association will exercise its
prerogative to deny access to the access areas to owners,
either members of the Association or not, that refuse to abide
by the rules and regulations adopted for the coimnon good.

Enclosed is the application of Porters Neck Homeowners Association,
Incorporated, for Department of the Army authorization and a State Water
Quality Certification to construct piers, floating docks, ramps and parking
areas for two community boat access sites on the Atlantic Intracoastal
Waterway (AIWW), Middle Sound, Porters Neck, New Hanover County, North
Carolina. Your receipt of this letter verifies your acceptance of a valid
request for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is a reasonable time for State action.
Therefore, if you have not acted on the request by June 29, 1992, the District
Engineer will deem that waiver has occurred.

Reference your application for a Department of the Army permit to
construct piers, floating docks, ramps and parking areas for two community
boat access sites on the Atlantic Intracoastal Waterway (AIWW), Middle Sound,
Porters Neck, New Hanover County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. CESAW-C080-N-000-0291.
Therefore, you may commence construction activity in strict accordance with
applicable State authorization, the enclosed plan and McKim and Creed plans,
entitled Porters Neck Southern Riparian Access and Porters Neck Northern
Riparian Access. Failure to comply with the State authorization or conditions
of the general permit could result in civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.
