On 15 April 1993, you requested a 401 Water Quality
Certification from the Division of Environmental Management for
your project located at U.S. 17 in New Hanover County. We wrote
to you on 2 June 1992 discussing concerns that we have regarding
the design of the project and placing it on hold until those
concerns are addressed. As of today, we have not received a
response to our earlier letter. Unless we receive a written
response from you by 29 October 1993, we will consider that you
have withdrawn this application and are not interested in
pursuing the project at this time.

REFERENCE: DEM ID 92-199, Nationwide Permit Application for an

Dear Mr. Hollis:
The NC Division of Coastal Management has reviewed the above
referenced application for a Nationwide Permit pursuant to Section
307 of the Coastal Zone Management Act of 1972 as amended. Based
upon our review, we have determined that the project may require a
Major Development permit from the Division of Coastal Management.
The information provided to us is not sufficient for us to
determine if the project is located within a designated Area of
Environmental Concern (AEC). However, if the project is located
within 575 feet of the mean high water mark along Howe Creek, a
CAMA Major Development is required.
In addition, if the proposed filling of the wetlands is deemed
to be significant, the project could be inconsistent with the New
Hanover County Land Use Plan. The New Hanover County Land Use Plan
recommends against activities which result in significant damage or
alteration of the natural function of wetlands in an AEC.

Dear Mr. & Benson:
The NC Division of Coastal Management has reviewed the above
referenced application for a Nationwide Permit dated 04/15/92 pursuant to
Section 307 of the Coastal Zone Management Act of 1972 as amended. Based
upon our review, we have determined that the proposed activity is
consistent with the North Carolina Coastal Management Program provided the
following conditions are met.
1. The activity described in the above referenced application qualifies
to receive one of the Nationwide Permits described in 33 CFR Part 330 with
the exception of numbers 17, 21, 24, and 34 which were found inconsistent
with the North Carolina Coastal Management Program.
2. A 401 Water Quality Certification is received, where required, from
the NC Division of Environmental Management.
This letter does not relieve you of the responsibility to insure that
all other State authorization and/or permit requirements are met prior to
implementation of the project. Please feel free to contact Mr. Steve

Gentlemen:
On behalf of Mr. Bill Benson, I am submitting the enclosed
pre-discharge notice and information in support of our request for your
concurrance that this work is authorized under Nationwide Permit 26 and
the related state Water Quality Certification.
This property in question consists of about 46 acres of which
approximately 8 acres are jurisdictional wetlands. 6.2 acres of these
wetlands are high quality riparian bottomland hardwood wetlands adjacent
to "Big Branch", a tributary of Howe Creek. The remaining 1.7 acres of
wetlands are of poor to marginal quality and appear to be a product of
the historic use of the property as a borrow pit. The Soil Conservation
Service publication, "Soil Survey of New Hanover County" identifies the
western two thirds of this proprty as a "borrow pit", which is evident
from an observation of the irregular terrain and scraped ground surface.
Only those small isolated wetlands located at some distance from Big
Branch are proposed to be filled.

Our regional office has reviewed the above mentioned project
which has recently been out to public notice. Before we can
issue the 401 Certification, we will need to have an overall site
plan and stormwater management plan for the site. We have no
objections to the fill of 1.7 acres of isolated wetlands.
However due to our concerns about the impact of stormwater runoff
from the site to the Howe Creek (designated as Outstanding
Resources Waters) you will need to submit a site plans and
stormwater management plans.

PROJECT DESCRIPTION: The applicant proposes to fill
approximately 1.7 acres of disturbed, isolated wetlands within
the Howe Creek Drainage Basin.
ADJACENT WATER BODY: Howe Creek
CLASSIFICATION: SA ORW
The project has been reviewed to determine impacts to water
quality. The following comments have been provided.
Because the project is in an "SA" "ORW" watershed, the
project will require a individual 401 Water Quality
Certification.
A preliminary review of the subject project indicates that
development plans for the site are incomplete at this time. In
order for this office to provide comments on the potential water
quality impacts this project may have on the Outstanding Resource
Waters of Howe Creek, an overall site plan of all proposed
development, including a stormwater management plan, should be
submitted by the applicant. The filling of 1.7 acres of isolated
wetlands should not in itself have a significant impact on water
quality, however, the applicant should provide plans of the
proposed development and demonstrate compliance with applicable
stormwater management regulations so that impacts from the entire
development can be evaluated.
