Mr. Richter determined that your lot, approximately 100 feet long by 200 feet deep, has been altered by various types and amounts of fill material. However, there remain areas of wetlands subject to our regulatory jurisdiction, pursuant to Section 404 of the Clean Water Act. Mr. Richter determined that there is less than one acre of wetland, and the property is located in the headwaters of Telfairs Creek. Therefore, your work may be authorized by our Nationwide Permit No. 26. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. The discharge does not cause the loss of more than 10 acres of waters of the United States; b. The permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. The discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. You may wish to contact Mr. Jim Gregson, North Carolina Division of Environmental Management to discuss possible Water Quality Certification authorization. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. PROJECT DESCRIPTION The applicant owns 5.8 acres at the end of Dunbar Road, off State Road 1403 in New Hanover County. This is adjacent to Page's Creek. This land is currently being subdivided into five lots for a very low density, single family subdivision. There are currently three homes - one owned by the applicant, that were originally part of this tract. The eight homes together will constitute the subdivision. When the New Hanover County subdivision review is complete, the applicant will be providing a 12,000 square foot gravel road to access the lots. This is the only improvement the applicant will make to the subdivision. Individual buyers will be responsible for obtaining all permits. Homes in the area are served by septic systems. The applicant is deeding a common area fronting Page's Creek to the Subdivision. In this area he has a pier and dock which he proposes to expand to serve the eight lots. Page's Creek Management. The applicant is proposing to keep the pier and T-Head as is, and expand the floating dock system. The existing dock will be lengthened from 18' to 56' . There will be a dock added to the east, 56' x 5' . The project extends 58' into a body of water approximately 850' across. However, oyster bars prevent navigation beyond approximately 1701. The structure terminates in -4' mlw. The riparian corridors shown on the survey dated February 6, 1992, and stamped received on February 7, 1992, are those agreed upon by the WiRO field staff to give fair access to landowners along this shoreline. The project will cross into the legal corridor of lot 8, but remain 15' from the next corridor. The applicant, as present owner of lot 8, has written permission that will follow the deed to have the structure into this riparian corridor. The purpose of the structure will be to serve the needs of the eight property owners. There will be docking along side the floating docks for eight boats, with no mooring pilings associated. The Page's Creek shoreline is presently dotted with single family piers, some community piers, and some marinas. Claud O'Shields Page three 10. ANTICIPATED IMPACTS The existing pier could be considered to be in the channel, which would be inconsistent with T15A:07H.0208(b)(6)(C)(ii). The project was permitted by the local permit officer for New Hanover county in conjunction with the Wilmington Field office. It was determined at this time that because of the depth of the channel, the -4' mlw contour should be used to define the channel for the purpose of structure location. An exemption was issued referencing the -4' mlw contour line, but no condition exists that the structure stay out of the channel. This exemption is enclosed. Though the project may not appear to be fully consistent with CAMA rules and guidelines, it was permitted after scrutiny unusual for exemptions. It does not appear to inhibit navigation in the area. Directly west of the applicant's property is a shoal on the near channel edge. For this reason, the far side of the channel is the one used by boaters. PROJECT DESCRIPTION The applicant owns 5.8 acres at the end of Dunbar Road, off State Road 1403 in New Hanover County. This is adjacent to Page's Creek. This land is currently being subdivided into five lots for a very low density, single family subdivision. There are currently three homes - one owned by the applicant, that were originally part of this tract. The eight homes together will constitute the subdivision. When the New Hanover County subdivision review is complete, the applicant will be providing a 12,000 square foot gravel road to access the lots. This is the only improvement the applicant will make to the subdivision. Individual buyers will be responsible for obtaining all permits. Homes in the area are served by septic systems. The applicant is deeding a common area fronting Page's Creek to the Subdivision. In this area he has a pier and dock which he proposes to expand to serve the eight lots. Page's Creek is classified SA by the Division of Environmental Management. This area of Page's Creek is designated Primary Nursery Area by the Division of Marine Fisheries. The area adjacent to the project location is open to shellfishing; however, immediately west of the property, shellfishing is prohibited. There is presently a pier, 63' x 41, with a T-Head 14' x 101, and one float, 51x 18' existing on the lot. The applicant is proposing to keep the pier and T-Head as is, and expand the floating dock system. The existing dock will be lengthened from 18' to 561. There will be a dock added to the east, 56' x 51. The project extends 58' into a body of water approximately 850' across. However, oyster bars prevent navigation beyond approximately 1701. The structure terminates in -4' mlw. The riparian corridors shown on the survey dated February 6, 1992, and stamped received on February 7, 1992, are those agreed upon by the WiRO field staff to give fair access to landowners along this shoreline. The project will cross into the legal corridor of lot 8, but remain 15' from the next corridor. The applicant, as present owner of lot 8, has written permission that will follow the deed to have the structure into this riparian corridor. The purpose of the structure will be to serve the needs of the eight property owners. There will be docking along side the floating docks for eight boats, with no mooring pilings associated. The Page's Creek shoreline is presently dotted with single family piers, some community piers, and some marinas. Claud O'Shields Page three 10. ANTICIPATED IMPACTS The existing pier could be considered to be in the channel, which would be inconsistent with T15A:07H.0208(b)(6)(C)(ii). The project was permitted by the local permit officer for New Hanover County in conjunction with the Wilmington Field office. It was determined at this time that because of the depth of the channel, the -4' mlw contour should be used to define the channel for the purpose of structure location. An exemption was issued referencing the -4' mlw contour line, but no condition exists that the structure stay out of the channel. This exemption is enclosed. Though the project may not appear to be fully consistent with CAMA rules and guidelines, it was permitted after scrutiny unusual for exemptions. It does not appear to inhibit navigation in the area. Directly west of the applicant's property is a shoal on the near channel edge. For this reason, the far side of the channel is the one used by boaters. The project will incorporate 470 square feet of open water.
