In accordance with your January 7, 1992 correspondence requesting additional
information we are providing the following:
In summation, the wetland impact request totals 0.38 acres as it relates to
roadway construction for a residential development.
RE: PRACTICABLE ALTERNATIVES
The wetland crossing at Cannon Road is unavoidable. The County Planning
Department requires we connect to the Cannon Road stub-out in the adjoining
property. With the point of beginning and the connection point already

RE: MINIMIZATION OF WETLAND LOSSES
The crossings will have culverts which will continue to preserve the aquatic
ecosystems. Existing drainage patterns will not be altered or impaired. Lot
lines were modified and adjusted to accommodate the naturally occurring
drainageways.
RE: MITIGATION
0.38 acres of wetlands are impacted while 4.2 acres of wetlands will be
protected as a Conservation Overlay District. These protected wetlands are
the fringe areas of Moore's Creek. No development will occur within this area.
In addition a 25' building setback is also imposed.

CERTIFICATION
THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to Landmark Organization pursuant to an application filed on the
13 day of January, 1992 for roadway construction and other
associated construction.
The Application provides adequate assurance that the
discharge of fill material into the waters of Howe Creek in
conjunction with the proposed roadway construction in New Hanover
County will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of
North Carolina certifies that this activity will not violate
Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if
conducted in accordance with the application and conditions
hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less are
not considered significant).
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.

Reference the application of Landmark Organization, Incorporated, for a
Department of the Army permit to place fill materials in the waters/wetlands
of Howe Creek associated with roadway construction for Gorman Plantation, near
Ogden, New Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report. By letters of February
10 and 26, 1992 (copies enclosed), the U.S. Environmental Protection Agency
(EPA) and the National Marine Fisheries Service (NMFS) recommend that
authorization to place fill material in wetlands be denied due to anticipated
adverse impacts to water quality and fishery resources. We support the
recommendation of these Federal agencies.

9. PROJECT DESCRIPTION
Landmark Organization, Inc. has proposed to add 97 lots to the
existing Gorman Plantation Subdivision on Middle Sound Loop Road
off of U.S. 17 in Wilmington. The 43.3 acre tract is mostly high
ground vegetated with oaks and pines, averaging 5' - 25' above
mean sea level. There is also wooded swamp on the property, and
some coastal marsh as well.
The proposal is to construct the road system, sidewalks, and curb
and gutter stormwater system for the subdivision. The lots will
be sold and developed by the individual owners. The entire tract
is 43.3 acres, with individual lots averaging 9,200 square feet
in size. Density is limited to 2.24 units per acre by the New
Hanover County Land Use Plan Classification of Resource
Protection. This is the westernmost portion of Gorman
Plantation. The property is bordered on the west by Moore's
Creek, a tributary to Howe's Creek. Moore's Creek is
unclassified. This area is wooded swamp, which transitions to
Tvpha spp•, Cladium jamaicense, and Juncus roemerianus as it
enters Howe's Creek.
The southernmost point of the property touches on Howe's Creek.
This waterbody is classified SA-ORW, is Primary Nursery Area, and
is currently closed to shellfishing. Moore's Creek would not be
considered Estuarine, and hence there is no 75' Estuarine
Shoreline. However, the border on Howe's Creek with a 575' ORW
Estuarine Shoreline brings the southwest corner of the project
into the AEC, and the entire project under review.
The gravity sewer line for the subdivision will run under the
road bed, and tie into an existing pump station at Timber Creek
Estates. Storm water will be collected in a curb and gutter
system, discharging into vegetated swales sloping towards Moore's
Creek. There is one catch basin and vegetated swale in the ORW
AEC. This drains directly to Howe's Creek.
There are two road crossings through wooded swamp, which have
received Nationwide 26 approval. The first wetland crossing
(Cannon Road) will fill an area of approximately 300' x 501.
Water flow will be handled by a 15" culvert. The second wetland
crossing (Haynes Road) will fill 250' x 401. This is a lower
area, and flow will be accommodated by a 36" culvert.
Subdivision covenants restrict built upon area on individual lots
to 2,500 square feet. This limits built upon area for the entire
subdivision, including roadways and sidewalks to 21% coverage.
Within the ORW AEC, this coverage is 19%.
A sedimentation/erosion control plan has been obtained through
New Hanover County.
New Hanover County has required all development 25' landward of
the 100' flood elevation line. This maintains all wooded swamp
and marsh area as conservation.

10. ANTICIPATED IMPACTS
Built upon area has been restricted to 21% overall and 19%
within the AEC. Stormwater is allowed to sheet flow through
vegetated swales. The only proposed fill is for road crossings,
and flow is accommodated by culverts. This is a low density,
well planned subdivision that is intended for areas adjacent to
Outstanding Resource Waters.

MOORE'S CREEK AT GORMAN PLANTATION

Project area totals 43.3 acres with a small portion, 5.9 acres, effected by the ORW
setback. Site use is for 97 single family detached residential homes. Site improvements
include roadways and infrastructure.
The ORW-AEC is the main component of this CAMA major permit request. The 75' AEC
along the remainder of Moore's Creek will be encroached upon to a lesser degree. All
improvements will be a minimum 30' from the mean high water line. Two wetland
crossings are required with a total impact of 0.38 acres.
The storm water design will be in accordance with the Low Density Option. Overall site
built upon is 9.0 acres, ie. 21%. ORW-AEC built upon is 1.1 acres, ie. 19%. Curb and
gutter is proposed with inlets located in accordance with NCDOT requirements. Storm
water will discharge into grass-lined swales with 5:1 side slopes. The minimum length
of swales will be 100' from the discharge point to mean high water. Outlet structures will
be properly sized with rip-rap velocity control measures.
Water supply will be provided by Cape Fear Utilities.
Sewer service will be provided by New Hanover County. The proposed design has been
endorsed on a local level. The system design is in keeping with County expansion plans
and makes possible the elimination of a pump station.

Stormwater Regulations, deed restrictions and protective covenants

RE: PRACTICABLE ALTERNATIVES
The wetland crossing at Cannon Road is unavoidable. The County Planning
Department requires we connect to the Cannon Road stub-out in the adjoining
property. With the point of beginning and the connection point already

RE: MINIMIZATION OF WETLAND LOSSES
The crossings will have culverts which will continue to preserve the aquatic
ecosystems. Existing drainage patterns will not be altered or impaired. Lot
lines were modified and adjusted to accommodate the naturally occurring
drainageways.
RE: MITIGATION
0.38 acres of wetlands are impacted while 4.2 acres of wetlands will be
protected as a Conservation Overlay District. These protected wetlands are
the fringe areas of Moore's Creek. No development will occur within this area.
In addition a 25' building setback is also imposed.
Accordingly the broad statutory criteria:

- Economic feasibility
- Technical & logistical feasibility
- Fulfillment of basic project purpose

to place fill materials in the waters/wetlands of Howe Creek associated with
roadway construction for Gorman Plantation, near Ogden, New Hanover County,
North Carolina. Your receipt of this letter verifies your acceptance of a
valid request for certification in accordance with Section 325.2(b)(ii) of
our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the
same law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is a reasonable time for State action.
Therefore, if you have not acted on the request by March 9, 1992, the
District Engineer will deem that waiver has occurred.
