Army Corp of Engieers Public Notice Action ID. 199203390 dated September 10, 1992 which describes a project proposal by Richard G. Jennings of Canton. The project involves the placement of pre-cast concrete medians in Big Snowbird Creek for access at a previously permitted trout hatchery, near Robbinsville, in Graham County. During the course of the re,;:'.ew, significant-,;comments aimed at pre,,,enting stream blockage were submitted by the Wildlife Resources Commission. The Wildlife Commission recommendations are supported by this viewpoint position and are as follows: 1) The applicant must provide for fish passage at the diversion dam through either a fish ladder approved by the N. C. Wildlife Resources Commission (NCWRC) or by constructing only a partial dam across the stream. A complete block to fish passage is not acceptable to the NCWRC on this high quality stream. 2) Residual flow in the.stream below the intake must be of sufficient magnitude to prevent destruction or serious diminution of downstream fishery habitat. Under no conditions may the entire flow of a stream be diverted to supply a fish propagation facility. 3) Temporary ground cover (e.g., hardwood mulch, straw, etc.) must be placed on all bare soil during construction. Per- manent vegetation in these same areas must be established within 15 days of ground-disturbing activities to provide long term erosion control. If Commission representatives can work out a slight modification allowing for applicant access as well as fish passage, we will likewise support such change. P.O. FT) 5e ? k Site description and notes: Snowbird Creek is a swift flowing, rocky bottom stream approximately 25 feet wide and 1-2 feet deep whose drainage encompasses portions of Nantahala National Forest and the Snowbird Sassafras Ridge and ending with its confluence with the Cheoah River at Lake Santeetlah. Snowbird Creek is classified C-Trout at the proposed 401 site. The creek carries a HQW designation from the headwaters to Polecat Branch approximately 0.4 mile above the 401 site. The proposed 401 site is located on Snowbird Creek approximately 1.0 mile above its confluence with Little Snowbird Creek. The certification request involves construction of a low water bridge to access a trout farm yet to be constructed. The water intake structure denoted on the plans has already been constructed. No impact is anticipated from the above activities provided equipment is kept out of the stream during installation of the pre-cast concrete blocks. Standard sedimentation and erosion control measures such as silt screens and seeding should be applied to stream bank areas disturbed during installation procedures. JENNINGS, JENNINGS SUNBURST TROUT COMPANY, Route 3, Box 513, Canton, North Carolina 28716 has applied for a Department of the Army (DA) permit TO COMPLETE CONSTRUCTION OF A COMMERCIAL TROUT REARING FACILITY ON BIG SNOWBIRD CREEK APPROXIMATELY 1.75 MILES UPSTREAM FROM THE CONFLUENCE WITH LITTLE SNOWBIRD CREEK NEAR ROBBINSVILLE, Graham County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the U.S. Army Corps of Engineers (USACE). Plans submitted with the application show the existing intake structure which was constructed in 1985 under DA permit number CESAW-CO85-N-038-026, as well as work proposed to complete the facility. The project permitted in 1985 was not completed prior to the expiration of the permit. To complete the project, the applicant now proposes to discharge approximately 14 cubic yards of concrete and rock within the creek channel. Two parallel lines of pre-cast concrete medians, 12-foot apart, will extend from the riverbank to the existing concrete intake box. Each median will be 10-foot long, 1-foot high, and taper from a 5-foot bottom width to a 2-foot top width. The interior area will be filled with riprap and railroad ballast. A steel grill will be welded to the top of the intake box. Existing 16-inch PVC pipes will provide flow to eight 50-foot by 8-foot by 12-inch deep raceways, adjacent to the creek, to grow 1- to 3-pound rainbow trout. Settling ponds will be constructed at the end of the raceway system before the water returns to Big Snowbird Creek. The purpose of the work is to complete an operational commercial trout rearing facility as well as to provide vehicular access to the remainder of the property. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any comments received will be considered by the USACE to determine whether to issue, modify, condition, or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this DA permit will not be made until the NCDEM issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serve as application to the NCDEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, NCDEM, Salisbury Street, Archdale Building, Raleigh, North Carolina. For activities involv'ng the placement of dredged or fill'materials in waters of the United State , a permit will be denied if the discharge that would be authorized by s ch permit would not comply with the Environmental Protection Agencies' 404(b)( ) guidelines. Subject to the preceding sentence and any other applic le guidelines or criteria, a permit will be granted unless the DE dete ines that it would be contrary to the public interest. The USACE is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties i or er to -3- consider and evaluate the impacts of this proposed activity. This is true because the approach route will be a series of three sets of parallel cement slabs, already cast, placed by a crane, placed directly on the creek bottom with clean rip-rap placed between them in such a manner as to create a stable ford. The pipeline from the intake structure to the raceways and the receways themselves will all be put in place well above any possible flood plane and without any potential erosion back into the Snow Bird Creek. ITEM B: There are no wetlands near this proposed site. ITEM C: Since there are no wetlands near the proposed site, no mitigation would be indicated.
