June 29, 1992, for Department of the Army authorization to construct a pier on the Atlantic Intracoastal Waterway (AIWW), Gator Grant Subdivision, Holden Beach, Brunswick County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. PROJECT DESCRIPTION The project is within the Gator Grant Subdivision located off SR 1157 near Holden Beach in Brunswick County. The existing subdivision is adjacent to the Atlantic Intracoastal Waterway. The project site is an easement (197' long x 5' wide) between Lots 9 and 10, Section 1, that has been deeded for common water access for the subdivision property owners. The easement runs from Gator Lane to the AIWW. Adjacent to the highground, there is a fairly broad expanse (approximately 400' wide) of mixed coastal wetland vegetation including both high and low marsh species. Approximately 90 feet of this coastal wetland border is above the MHW contour. The remainder of the distance is primarily cordgrass marsh (Spartina alterniflora) which terminates at the open water edge of the AIWW along a narrow shell bank. The AIWW is approximately 650 feet wide at the project site. There are similar piers, both east and west, of the proposed project. The waters in the area are classified SA by the North Carolina Division of Environmental Management, and are open to the harvest of shellfish. The North Carolina Division of Marine Fisheries has not designated this area as primary nursery area. The applicants are proposing to construct a pier for community use. The pier would be 610 feet long and 5 feet wide. A T-head (16' x 161) is proposed to be centered at the terminal end of the pier. The waterward side of the T-head would be located 85 feet from the near bottom edge of the maintenance prism of the AIWW channel. The structure would extend approximately 195 feet into open water, well within the one-third rule, where the water depth at the end of the T-head would be approximately 2 feet at MLW. The applicants have obtained waivers of riparian access corridor setback requirements from both adjacent property owners to allow the construction of the community pier. No improvements are proposed for the grassed highground accessway. 10. ANTICIPATED IMPACTS Provided the pier is sufficiently elevated over coastal wetland vegetation, no adverse impacts to the marine resources are anticipated. We recommend that the following conditions be included in the State authorization: a. All work authorized by this permit must be performed in strict compliance with the permit plans. lit , , b. The permittee's scheme of development, of which the authorized work is a part, contemplates the presence of structures and their attendant utilities on lands subject to an easement in favor of the United States for the operation, maintenance, improvement, and enlargement of the Atlantic Intracoastal Waterway (AIWW). Accordingly, the permittee will be required to remove such structures and improvements at his own expense in the event that, in the judgment of the U.S. Army Corps of Engineers acting on behalf of the United States, the lands are needed at any time for any purpose within the scope of the easement. Permanent buildings will not be constructed within the easement. C. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. -2- d. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. e. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. f. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work, will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the waterway to its former conditions. If the permittee fails to comply with this direction, the Secretary or his representative may restore the waterway, by contract or otherwise, and recover the cost from the permittee. g. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. h. Approval of the structure was based on determination that there would be no obstruction to navigation. Under conditions existing in the Atlantic. Intracoastal Waterway (AIWW), a possibility exists that the structure may be damaged by wave wash from passing vessels. Unreasonable slowing down of vessel traffic cannot be required because it would tend to nullify the navigational benefits on which the AIWW was justified. Issuance of this permit should not be construed as relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave wash normally to be expected in the AIWW.
