Subject: Charles Ulery Project, Watauga County
Last week when we were cleaning out old files, the Charles Ulcry
project for a parking* lot expansion was brought to our attention. At about
the same time last fall that Mr.- Ulery was applying for a 401 Certification,
he also applied to the -'Corps of Engineers for an after-the-fact permit. The
attached letter from the Corps dated October 16, 1992 is hir, Ulery's
Nationwide 26 permit for after=the-fact fill. The DEM Central Office had
sent a .letter to .Mr. Ulery re4uesting more information on Ociober 5, 1992,
but we never received a response. to this letter.
It seems' as though ft. Ulery may have become frustrated with our
letter requesting more information and so he went ahead and filled the
wetland and then requested an after=the-fact permit from the Corps. Since
we determined that the site . had significant wetlands, this project may
require another site visit. to conful m that the fill activity has been
completed. If the site has been filled' without •a 401 Certification,
enforcement action may need. to be taken. Please advise as to how we
should proceed- with this project.

on 30 September 1992, -.Me. Cherri Smith- of my staff and Mr. Ji3n Johnston from
the. Winston-Salem Regional Office of the Division of Environmental management
conducted a site visit of your property '-pursuant to your application for 401
Certifjcation. You propose to fill 0.82 acres of wetlands for parking lot expansion
under Nationwide Permit * 26:. .,As you know a 401 Certification is required for this
project. A 401 Certification is a statement by the' state that the proposed project
will not violate any state water quality standards. As you may not be aware, the
N.C. Wildlife Resources commission must agree with the use of a Nationwide Permit in
mountain counties ineluding••Watauga•'County.
The wetlands on your site are providing significant uses namely wildlife and
aquatic life habitat and (most importantly) pollutant removal from upstream urban
runoff. We -are especially concerned about these pollutants since Hodge's Greek is
classified as trout waters. Please address whether you have alternatives to filling
in the wetland to provide parking for Watauga High School students. Specifically,
can the existing parking lot at the school be expanded into the drainage Swale on
the southwest portion of the existing parking lot xn order to provide parking? If
fill of this wetlanci is truly uriavoidable, stormwater controls may be needed to
protect the downstream uses of Hodges Creek.
Please address whether 1) you have contacted the N.C..Wildlife Resources
Commission to detertni.ne whether they concur that a nationwide permit would. be
applicable and 2) whether there-are practicable alternatives to the proposed parking
lot design. Until these questions have been addressed, I will place this project on

On 5 October 1992, I wrote concerning your plans to fill 0.82 acres of wetlands for a
parking lot on N.C. 105. That letter indicated that DEM needs additional information
concerning alternatives to your planned fill before we can approve your application. An
additional copy of that letter is attached.
You may not be aware that the 404 permit issued by the U.S. Army Corps of
Engineers on 16 October 1992 is not valid without. a 401 Certification. As of today we have
not received a written response from you concerning our need for additional information.
Unless we receive a written response by 30 November 1993, we will consider that you have
withdrawn this application and are not interested in pursuing the project.

Subject: Charles Ulery Project, Watauga County
Last week when we were cleaning out old files, the Charles Ulery
project for a parking lot expansion was brought to our attention. At about
the same time last fall that Mr. Ulery was applying for a 401 Certification,
he also applied to the Corps of Engineers for an after-the-fact permit. The.
attached letter from the Corps dated October 16, 1992 is Mr. Ulery's
Nationwide 26 permit for after-the-fact fill. The DEM Central Office had
sent a letter to Mr. Ulery requesting more information on October 5, 1992,
but we never received a response to this letter.
It seems as though Mr. Ulery may have become frustrated with our
letter requesting more information and so he went ahead and filled the
wetland and then requested an after-the-fact permit from the Corps. Since
we determined that the site had significant wetlands, this project may
require another site visit to confirm that the fill activity has been
completed. If the site has been filled without a 401 Certification,
enforcement action may need to be taken. Please advise as to how we
should proceed with this project.

On 30 September 1992, Ms. Cherri Smith of my staff and Mr. Jim Johnston from
the Winston-Salem Regional Office of the Division of Environmental Management
conducted a site visit of your property pursuant to your application for 401
Certification. You propose to fill 0.82 acres of wetlands for parking lot expansion
under Nationwide Permit # 26. As you know a 401 Certification is required for this
project. A 401 Certification is a statement by the state that the proposed project
will not violate any state water quality standards. As you may not be aware, the
N.C. Wildlife Resources Commission must agree with the use of a Nationwide Permit in
mountain counties including Watauga County.
The wetlands on your site are providing significant uses namely wildlife and
aquatic life habitat and (most importantly) pollutant removal from upstream urban
runoff. We are especially concerned about these pollutants since Hodges Creek is
classified as trout waters. Please address whether you have alternatives to filling
in the wetland to provide parking for Watauga High School students. Specifically,
can the existing parking lot at the school be expanded into the drainage swale on
the southwest portion of the existing parking lot in order to provide parking? If
fill of this wetland is truly unavoidable, stormwater controls may be needed to
protect the downstream uses of Hodges Creek.
Please address whether 1) you have contacted the N.C. Wildlife Resources
Commission to determine whether they concur that a nationwide permit would be
applicable and 2) whether there are practicable alternatives to the proposed parking
lot design. Until these questions have been addressed, I will place this project on

Dear Mr. Ulery:
Reference your recent after-the-fact application for Department of the
Army authorization to fill approximately 36,000 square feet of headwater
wetlands adjacent to Hodges Creek, just east of NC Highway 105, near Boone, in
Watauga County, North Carolina. The purpose for the fill was to construct a
parking lot. This project has been coordinated with the NC Wildlife Resources
Commission (WRC).
For the purposes of the U. S. Army Corps of Engineers' Regulatory Program,
Title 33, code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization was provided, pursuant to Section 404 of the Clean Water Act,
for discharges of dredged or fill material into headwaters and isolated waters
provided:
a. The discharge does not cause the loss of more than 1 acre of waters of
the United States;
b. The permittee notifies the District Engineer if the discharge would
cause the loss of waters of the United states greater than one acre in
accordance with the "Notification" general condition. For discharges in
special aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and
c. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.
Your work is authorized by this nationwide permit provided it is
accmplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain any
required State or local approval. It is recommeded that you contact Mr. John
Dorney with the State of North Carolina, at telephone [phone],
to insure that you have complied with state water quality certification
requirements.

This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to coatmexx:e in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
or revoke the authorization.

Subject: Parking Lot Expansion at Watauga High School, Watauga Co.
On September 30, 1992 Jim Johnston from the Winston-Salem
Regional Office and I visited the proposed site for the expansion of a
parking lot for Watauga High School. The expansion would impact
approximately 0.8 acres of wetland most closely characterized as a
freshwater marsh. The area has apparently become wetter from
drainage blocked by the existing parking lot.
The closest stream is Hodges Creek which is classified as C-trout.
The wetland is hydrologically connected to this body of water. As far
.as I know, the Wildlife Resources Commission has not been contacted.
Apparently only the Corps of Engineers and DEM are aware of this
project.
A "Wetland Rating System Worksheet" was filled out and the
wetland received a score of 22/55 (see attached worksheet). The
principle values of this area are for amphibian habitat and water
quality. Urbanization is occurring relatively rapidly in the
surrounding watershed and, therefore, this wetland is probably
storing substantial amounts of sediment.
If more parking spaces are needed for Watauga High School, then
there is an alternative to expanding into the wetland. It appears that
expansion into the drainage Swale on the southwest portion of the
existing parking lot would provide as much area for additional

parking spaces than expansion into the wetland. The water in the
swale could be culverted through the parking lot. It is also my
understanding that the school owns this property so it should be
available for this purpose.
I recommend that this project be placed on hold until the
applicant can demonstrate that the parking lot must be expanded
into the wetland. Moreover, the wetland is providing significant
functions that should be protected if at all possible.
