DEPARTMENT OF ENVIRONMENT, HEALTH AND NATURAL RESOURCES DIVISION OF ENVIRONMENTAL MANAGEMENT WATER QUALITY SECTION AND U.S. ARMY CORPS OF ENGINEERS WILMINGTON DISTRICT CONCERNING 401 WATER QUALITY CERTIFICATIONS AND CORPS OF ENGINEERS ENVIRONMENTAL DOCUMENTS THIS MEMORANDUM OF AGREEMENT, made and entered into this of , 1993 by and between the North Carolina Division of Environmental Management, hereinafter referred to as the "DEM", and the U.S. Army Corps of Engineers, hereinafter referred to as the "COE". WITNESSETH THAT: WHEREAS, the DEM must often issue 401 Water Quality Certifications for COE dredging projects throughout the state of North Carolina and especially in the 20 coastal counties and the COE must prepare environmental documents for those projects, AND DEM is restricted in its ability to issue 401 Certifications until the environmental documentation is complete (15A NCAC ****), AND COE needs assurance from DEM that 401 Certifications can be issued during the environmental document review process, AND THEREFORE, the parties hereto do mutually agree as follows: 1. The COE shall prepare environmental documentation as required under the National Environmental Policy Act (NEPA) and State Environmental Policy Act (SEPA) and distribute those documents via the N.C. Clearinghouse review process, 2. DEM shall review these documents for the need for 401 Certification and any conditions needed to protect water quality standards, 3. DEM shall transmit such comments through the Clearinghouse to the COE, 4. COE shall incorporate all such comments into the final environmental document or resolve any disagreements with DEM in such a manner that DEM amends its review comments in writing, 5. On March 31, 1993, personnel from Wilmington District, Environmental Resources Branch, met with John Dorney and several staff members of the Division of Environmental Management, Water Quality Section, to discuss specific concerns relating to 401 water quality certifications and processing requirements for Federal projects. As a result of this meeting, it was agreed that the field staff from Washington and Wilmington should be involved in working out some of the details discussed. Therefore, a second meeting has been scheduled and will be held in Raleigh on April 27, 1993, at 1:00 p.m. at the Ashley House. Provided below are the topics that will be discussed at the meeting: a. Procedures for submission of applications for Individual 401 Water Quality Certifications for civil works construction projects. b. Standard application form for individual 401 Water Quality Certifications for civil works construction projects. c. Procedures for amending 401 Water Quality Certifications. d. Procedures for requesting renewals of expired 401 Water Quality Certifications. e. Status of General Water Quality Certifications. f. Expiration periods for individual 401 Water Quality Certifications and general water quality certifications. g. Coordinating Federal consistency reviews and applications for Water Quality Certifications. h. DEM's functional authorities in reviewing mitigation plans. i.
