Dear Mr. Hodges:
Reference your September 2, 1992 application for Department of the Army
authorization to construct a road crossing consisting of two side by side
200 foot long by 8 foot diameter culverts in an unnamed tributary of laurel
Fork Creek, near Boone, in Watauga County, North Carolina. Both ends of the
culverts will be riprapped and a riprap dissipater will be placed at the
downstream end of the pipes. The purpose for the project is to gain access to
an upland commercial site. No wetlands will be impacted. This project has
been coordinated with the NC Wildlife Resources Comm-ssion (WIC).
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was provided for fills for roads
crossing waters of the United States (including wetlands and other special
aquatic sites) provided:
a. The width-, of the fill is limited to the minimum necessary for the
actual crossing;
b. The fill placed in waters of the United States is limited to a filled
area of no more than one-third acre. Furthermore, no more than a total of 200
linear feet of the fill for the roadway can occur in special aquatic sites,
including wetlands;
c. The crossing is culverted, bridged or otherwise designed to prevent
the restriction of, and to withstand, o pected highflows and the movement of
aquatic organisms;
d. The crossing, including all attendant features, both temporary and
permanent, is part of a single and omplete project for crossing of a water of
the United States; and
e. For fills in special aquatic sites, including wetlands, the permittee
notifies the District Engineer in accordance with the "Notification" general
condition.

Your work is authorized by this nationwide permit provided it is
accorplished in strict accordance with the enclosed conditions and with the
conditions outlined in the enclosed September 22, 1992 WRC letter. This
nationwide permit does not relieve you of the responsibility to obtain any
required State or local approval. It is recammended that you contact
Mr. John Don-ley of the State of North Carolina, at telephone [phone],
to insure that you have ccnplied with state water quality certification
requirements.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions-of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to conw-rx::e in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the-nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

Certification to place fill material in 0.5 acres of wetlands or

Bypass in Watauga County, we have determined that the proposed
fill can be covered by General Water Quality Certification No.
2671 issued January 21, 1992. A copy of the General
Certification is attached. This Certification may be used in
qualifying for coverage under Corps of Engineers' Nationwide
Permit No. 26.

Subject: Review of an application by Mr. Jimmy Hodges to
place culverts in an unnamed tributary to Laurel
Fork Creek, Watauga County
Dear Mr. Johnson:
Mr. Jimmy Hodges (P. 0. Box 2137, Boone, NC 28607) is
requesting a letter of concurrence from the North Carolina
Wildlife Resources Commission (NCWRC) to obtain a 404 permit
from the U.S. Army Corps of Engineers. These comments are
provided in accordance with provisions of the Clean Water
Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661-667d).
Mr. Hodges is proposing to place two eight-foot
culverts in an unnamed tributary to Laurel Fork Creek in
order to expand a previously filled uplands area. Both ends
of the culverts will be riprapped, and a riprap dissipater
will be placed at the downstream end of the pipe. The
purpose of this project is to create access to a
commerical/industrial site.
The site was visited by staff biologists on September
15, 1992. The unnamed tributary to Laurel Fork Creek is a
tributary to the Watauga River, which is Designated Public.
Mountain Trout Water. A fish sample collected on September
15, 1992 revealed that populations of stocked brown trout,
wild brook trout and blacknose dace reside at the site
location. It should be noted that approximately 200 meters
upstream of the site, the stream forks and flows through
numerous culverts above this point. No fish were found in
the left fork approximately 1.0 km above the site. No
wetlands are present and habitat conditions that would
likely support any endangered, threatened or special concern
species were not observed.
Based on the fact that this stream appears to contain
only a remnant population of brook trout in a heavily
developed watershed, the NCWRC will not object to the
project as proposed provided that the following stipulations
are implemented:
1) Work is prohibited in the stream from November 1
through April 1 in order to protect spawning stages of
trout.
2) Culverts should be buried one foot into the stream
bottom to maintain fish passage.
3) Erosion controls must be implemented where soil is
disturbed and maintained until project completion.
4) No heavy equipment should be operated in the stream in
order to minimize sedimentation and prevent
introduction of other pollutants.
