The Application provides adequate assurance that the
discharge of fill material into the waters of New Light Creek
in conjunction with the proposed earthwork in Wake County will
not result in a violation of applicable Water Quality Standards
and discharge guidelines. Therefore, the State of North Carolina
certifies that this activity will not violate Sections 301, 302,
303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set
forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less are not
considered significant).
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.

-Lot owned by Theresa Deatherage at 3101 Edgetone Drive has
some areas which could accept fill with little water
quality impacts. The proposed fill will remain at least
60 feet from the proposed creek channel, so adequate
floodplain buffer will remain. An existing culvert will
be rerouted, but will outlet at non-erosive velocities to
the floodplain and not directly to the creek. The RRO has
no problem with addition of fill material here to within
the confines drawn on the proposed plans.
These wetlands are of moderate value. They are in an area
highly developed for commercial and residential use. To that
extent, they are one of the few remaining wetland areas in the
immediate vicinity. Water quality benefits and wildlife habitat
are both important aspects of the wetlands area.
John, please review these comments and recommendations, and
contact Rick Sago with city of Raleigh at 890-3031. He would like
to hear as soon as possible what decisions will be reached on the
401 certification so he can proceed with his plans. If you have
any questions or see the need to diverge greatly from my
recommendations, please give me a call.
2. New Light Farm; Project No. 92309- Wake County. I visited this
site on June 30, 1992. The applicant proposes to fill in existing
drainage ditches through a pasture and have the Soil Conservation
Service design some grassed waterways to handle the stormwater
flow. This will benefit water quality in the area by removing the
cows from the direct water channel, and by allowing filtration of
stormwater through grassed strips instead of unlined ditches. No
negative impacts are foreseen on this project. A rating sheet was
not done, but the value of the existing ditches is quite low. The
RRO recommends a 401 be issued for the project as soon as
possible. The applicant would like to have all permits in hand
soon so as to begin work in August and seed the waterways before
winter comes. The ditches and pasture drain towards New Light
Creek in the Neuse River watershed- class C NSW.

FOREST, NORTH CAROLINA 27587, has applied for a Department of the Army (DA)
permit TO AUTHORIZE PROPOSED EARTHWORK WITHIN WETLANDS ADJACENT TO NEW LIGHT
CREEK, FOR CONSTRUCTION OF GRASSED WATERWAYS, TILE DRAINS, AND A WATER LINE
-NEAR Wake Forest, Wake County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by representatives
of the U.S. Army Corps of Engineers. Plans submitted with the application
show construction taking place in approximately 4.2 acres of wetlands adjacent
to New Light Creek to effect installation of tile drains and a water line, and
to construct two grassed waterways. With the exception of a portion of the
waterline which will be constructed through existing high woods, all of the
proposed activities will occur within wetland marsh/pasture adjacent to the
creek. The larger grassed waterway will be approximately 1400 feet long and
40 feet wide. The smaller waterway will be 500 feet long and 30 feet wide.
Each waterway will be 1.2 feet deep, and will generally follow the run of the
existing ditches. Approximately 1300 linear feet of 4-inch tile drain will be
installed adjacent to portions of the waterways to collect subsurface
drainage. A construction corridor approximately 50 feet wide would be
disturbed for the waterways and drains. A drop box will be constructed at the
head of the larger waterway to collect drainage from an upstream beaver pond
and pipe it fifty feet directly to New Light Creek. An additional drop box
will be constructed at the head of the smaller waterway to collect drainage
from the existing man-made pond and divert it to the tile drain. A buried
water line will be installed, originating from an existing well on high
ground, through approximately 1800 linear feet of wetlands to provide
livestock watering stations (hydrants) in the pasture. The water line will
require a construction corridor approximately 5 feet wide within wetlands.
The water line corridor will be restored to original grade upon completion of
construction. A 4-strand high tensile electric fence will be installed along
New Light Creek to keep livestock from entering the creek. The purpose of the
work is to improve water quality on the site and downstream, and provide a
clean, reliable livestock watering source. The project was initiated and
designed by the U.S. Department of Agriculture, Soil Conservation Service, and
the Wake County Soil and Water Conservation District. Alternatives considered
and addressed by the applicant include no change to the present conditions,
fencing out ditches and installing water lines with hydrants, and maintaining
the existing ditches to remove accumulated sediments. Plans showing the
proposed construction are included with this public notice.

the United States, a permit will be denied if the discharge that would be
authorized by such permit would not comply with the Environmental Protection
Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
The U.S. Army Corps of Engineers is soliciting comments from the public;
Federal, State, and local agencies and officials; Indian Tribes, and other
interested parties in order to consider and evaluate the impacts of this 4
proposed activity. Any comments received will be considered by the U.S. Army
Corps of Engineers to determine whether to issue, modify, condition, or deny a
permit for this proposal. To make this decision, comments are used to assess
impacts on endangered species, historic properties, water quality, general
environmental effects, and the other public interest factors listed above.
Comments are used in preparation of an Environmental Assessment and/or
Environmental Impact Statement pursuant to the National Environmental Policy
Act. Comments are also used to determine the need for a public hearing and to
determine the overall public interest of the proposed activity.
Generally, the decision whether to issue this DA permit will not be made
until the North Carolina Division of Environmental Management (DEM) issues,
denies, or waives State certification required by Section 401 of the Clean
Water Act. The DEM considers whether or not the proposed activity will comply
with Sections 301, 302, 306, and 307 of the Clean Water Act. The application
and this public notice for the DA permit serves as application to the DEM for
certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, DEM,
Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such
materials will be furnished to any person requesting copies upon payment of
reproduction costs.
The DEM plans to take final action in the issuance of the Clean Water Act
certification on or after June 29, 1992.
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to the DEM, Post
Office Box 27687, Raleigh, North Carolina 27611-7687, on or before June 22,
1992, Attention: Mr. John Dorney.

Discussion of Alternatives
1. No Change.
Currently the cattle drink directly from the ditches. As
the cattle go to water they break the banks of the ditches and
tread up the vegetation that holds the soil. They stand in the
water while they drink, muddying it and urinating and deficating
directly into the water which flows into the New Light Creek.
Many health problems are associated with cattle watering in such
unsanitary conditions. Leptospirosis is one of the most
prominent diseases transmitted by cattle drinking contaminated
water.
The ditches fill with silt and periodically have to be
cleaned out with a backhoe. When this is done the mud from the
ditches must be left in large piles alongside the ditches until
it dries out enough to be spread and vegetation can be re-
established. At this time a severe flood would have the
potential to carry much of this silt down stream.
Finally the ditches create a physical barrier which makes it
impossible to provide adequate shade in all paddocks. In mid-
summer alleys must be run to shady loafing areas alongside the
creek. The turf in the alleys and loafing area is destroyed
making it vulnerable to erosion in times of flooding.
Furthermore the cattle deposit large amounts of manure and urine
in the loafing area instead of distributing this nutrient-rich
material throughout all the paddocks as they would if there were
adequate shade in each paddock.

This alternative would solve the health problems caused by
the cattle drinking from the ditches. It woi_iid al?,O eliminate
the problem of cattle !3efccating and urinating directly into Une
water, as well as the destruction of vegetation alongside the
ditches. However, it would not SOlv!? the problem of the ditches
filling w1th silL and neei?ing to be cleant-ll peril?!3ir_'ally wit'!1 a
backtloe. Nor would it address the need for shade in each paddock
in the summer.

Furthermore this option imposes several burdens on the farm
operator which make it unacceptable. First, the amount of land
lost in the 10' buffer zones amounts to approximately 10" of the
acreage affected by this project. This loss in itself is deemed
too great an economic burden for this option to be acceptable.
Second, the buffer zones and fence 'Lines would havt to be
maintained. It would be undesirable to allow them to grow up in
trees and brush as this would short out the fences, shade the
pastures, and make it impossible to maintain the ditches.
Presently the cattle keep the vegetation in this area under
control by grazing. If the cattle were Eenced out it would have
to be kept mowed or cleaned with herbicides. This would require
either a high labor cost if done by hand, or an investment in
specialized mowing and/or spraying equipment. Third, the ditches
could not be cleaned with the fences in place as the backhoe
normally requires more than 10' to operate, and typically the
pile of mud and dirt from the cleaning operation ends up about
where the fence line would run. Thus the fences on at least one
side of the ditch would have to be moved when the ditch was
cleaned, and reinstalled after the dirt had been spread out and
the area had been replanted (typically several months later).
In conclusion our proposal is the best option because it
improves water quality by changing the discharge of rainwater
from this pasture from point-source to non-point-source
discharge. This will not be accomplished by the other two
options. The grassed waterway would function as a nutrient
filter. Water from the intermittent stream, pond overflow, and
springs would flow directly to the New Light Creek through the
lines without accumulating nutrient or silt burden from the
surface as it will flowing through open ditches in the other
options. The animals would have easy access to shade and clean
water. Maintenance would be easily accomplished by controlled
grazing or mowing for hay.
Our plan of operations calls for the project to be
completed in a manner that will pose as little threat of damage
to the watershed as possible. The work will begin in late July
or August, and should be completed by mid to lai:e September which
will be the ideal planting date for re-establishing /eyet,1ti(Jn oz:
the grassed waterways and over other disturbed areas. This is
also the time of year when major flooding is least likely.
While a significant amount of soil will be disturbed to
complete this plan, it won't be mud 'Like that removed from ti-I e
ditches when they're cleaned. It won't have to sit and dry out
before it can be moved and grass can be re-established. The
danger of silt being washed down stream will be less from thi:_•
entire project than from the routine maintenance uE !.he ,litc1it-s.
Moreover the ditches require cleaning every couple of year: while
tYze maintenance requirt_d by this project will be minimal.

The grassed waterway and tile system to replace the open ditch system
was designed by the Soil Conservation Service and the Wake Soil and
Water Conservation District. All construction will be supervised and
approved by SCS and the Wake SWCD.
Grassed waterway #1 will be 1400 ft. long, 40 ft. wide and 1.2 ft. deep.
Using soil from either side of the open ditch the waterway will be
constructed and the ditch filled in, balancing cut and fill. See diagram.
The tile line will be installed next to the open ditch to replace the
subsurface drainage provided by the ditch in part of the pasture. No tile
line is needed in most of the pasture. Approximately 1300 ft. of 4" tile
line will be installed.
Grassed waterway #2 will be 500 ft. long, 30 ft. wide and 1.2 ft. deep. A
drop box will be constructed at the top of this waterway to collect the
pond overflow from the principal spillway pipe and divert it to the tile
laze.
A second drop box will collect runoff from the beaver pond and pipe it
safely to the New Light Creek approximately 50 ft. away.
4.a. 3
Water lines with hydrants will be run through the pastures throughout
the farm to provide water to the cows. Each hydrant will be spaced to
provide water for up to 4 paddocks.

A 4 strand high tensile electric fence will be installed 10 ft. from creek to
keep cows out of the creek.

Dear Dr. Wright:
In keeping with your request, this office has circulated to interested
state review agencies U. S. Army Corps of Engineers Public Notice Action ID.
199202093 dated June 4, 1992 which describes a project proposal by New Light
Farm represented by Jim Wallace of Wake Forest. The project, located on
wetlands adjacent New Light Creek near Wake Forest in Wake County, involves
construction in 4.2 acres of wetland marsh and pasture.
Based on a coordinated agency review with all agencies responding by July
27, the state interposes no objection to the project nor offers any
substantive conditions.
For the record, the Division of Environmental Management issued the
required Section 401 Water Quality Certification No. 2754 on July 22, 1992.
Additionally, the Division of Earth Resources, Land Quality Section,
found the project exempt from the Sedimentation Pollution Control Act of 1973.
That agency did, however, strongly recommend the use of appropriate
sedimentation and erosion control practices to prevent off-site sedimentation.
The appropriate use of temporary stone check dams, construction sequencing,
and properly designed channel-lining are recommended.
Should you require additional input from the state on this matter, do not
hesitate to contact this office or the commenting agencies.
