Water main crossing, Scuppernong River Washington County DEM Project 92.135 Upon review of your request for Water Quality Certification to place fill material in 0.03 acres of wetlands and waters for water line installation located at SR 1142, Cresswe.ll, North Carolina, in Washington County, we have determined that the proposed fill can be covered by General Water Quality Certification No.'2664 issued January 21, 1992. A copy of.the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 12. In addition, the seven conditions listed in the 28 April 1992 letter from Alan Keith from Diehl and Phillips shall be followed. Box 29535 Raleigh, NC 27626-0535 Re: Proposed Water Line Construction on SR1142 Washington County, NC Dear Mr. Dorney: This letter is to address issues relating to the proposed water line construction along SR1142 east of Creswell across the Scuppernong River. Soil & Environmental Consultants has requested a decision relating to a Water Quality Certification for the stream crossing in this project. It is our understanding that you require additional information as to the proposed construction methods. Diehl & Phillips will have a construction observer on-site during the stream crossing to monitor the Contractor's work. Mitigating measures that will be applied during the stream crossing are as follows: 1. Sedimentation and erosion control measures will be installed to preclude siltation of the waterbody. 2. Construction will be accomplished as quickly as possible to limit the period of disturbance. 3. Construction will not be allowed during inclement weather - the Contractor must prepare for impending storms. 4. The construction area will be confined to as small an area as is practicable. 5. Disturbed areas will be returned to preconstruction contours and stream banks stabilized as quickly as possible. 6. Any large floatable objects caused by construction will be removed and legally disposed upland. „ A r- 70 Mr. John Dorney April 28, 1992 Page 2 7. Any excess material will be removed and legally disposed upland. As Soil & Environmental Consultants has stated in correspondence in March, 1992, time is of the essence to initiate this project. Our comments are provided in accordance with provisions of sections 401 and 404 of the Clean Water Act (33 U.S.C. 466 et seq.). The applicant has applied for a Nationwide Permit under Section 404 and proposes to install a water main pipe under the stream bed of Scuppernong River at the State Road 1142 crossing. Scuppernong River provides valuable spawning and nursery habitat for numerous species of resident and anadromous fish. Disturbance of sediments associated with installation of this water main will elevate turbidity levels in Scuppernong River which potentially could be lethal to eggs, larvae, and advanced young stages of fish in the project area. In order to prevent these impacts, we request that the Certification for this project be conditioned to disallow construction activities in Scuppernong River from March 1 through September 30. A completed Pre- discharge Notification Application is attached and has been forwarded with all other required information to the proper agencies as noted at the end of this letter. The following are important considerations which should be duly considered in the processing of this application: (1) In order to avoid impacts to wetlands and/or waters of the U.S., the project engineer (Diehl and Phillips) requested that N.C. Dept. of Transportation allow them to connect the line to the existing bridge (see attached letter). This request was denied for reasons discussed in the attached letter from N.C. DOT. (2) All other portions of the project will occur along an existing road shoulder and will have no other impacts to jurisdictional areas. (3) Due to the project engineers past experience and previous Corps and DEM policy, this work has been designed and bid without notification to DEM and the Corps. As soon as the project engineer became aware of the "new" requirements for obtaining written concurrence from appropriate agencies for NWP#12 prior to commencing work, he authorized S&EC to proceed with such notifications. This office has investigated your request for attachment and findsthe following conflicts: a. The bridge was built with a moveable middle span. This moveable span was installed so that it could be removed, if necessary, to allow military owned watercraft to pass through on the river. b. The type overhang used on this moveable span is made of steel with no provisions for attachment. C. The diaphragms located between the beams will not allow adequate space for installation in a bay. d. The bridge is posted for load limitations which cannot be lowered to permit utility attachments. After review of the above listed conflicts, we regret to inform you that the attachment request must be denied. A completed Pre- discharge Notification Application is attached and has been forwarded with all other required information to the proper agencies as noted at the end of this letter.. The following are important considerations which should be duly considered in the processing of this application: (1) In order to avoid impacts to wetlands and/or waters of the U.S., the project engineer (Diehl and Phillips) requested that N.C. Dept. of Transportation allow them to connect the line to the existing bridge (see attached letter). This request was denied for reasons discussed in the attached letter from N.C.. DOT. (2) All other portions of the project will occur along an existing road shoulder and will have no other impacts to jurisdictional areas. (3) Due to the project engineers past experience and previous Corps and DEM policy, this work has been designed and bid without notification to DEM and the Corps. As soon as the project engineer became aware of the "new" requirements for obtaining written concurrence from appropriate agencies for NWP#12 prior to commencing work, he authorized S&EC to proceed with such notifications. This moveable span was installed so that it could be removed, if necessary, to allow military owned watercraft to pass through on the river. b. The type overhang used on this moveable span is made of steel with no provisions for attachment. C. The diaphragms located between the beams will not allow adequate space for installation in a bay. d. The bridge is posted for load limitations which cannot be lowered to permit utility attachments. PERMIT AND WATER QUALITY CERTIFICATION \`i"?_ The Department of Environment, Health and Natural Resources hereby gives public notice as required by.N.C.G.S. 113A-119(b) and 143-215 3(a)(1)(c) that the City of Washington of Washington, N.C. filed an application on 13 December 1991 for a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for certification from the Division of Environmental Management that a discharge of fill material in project wetlands will not violate applicable water quality standards. According to said application, the City proposes to construct a water treatment facility with raw water force mains and a diffuser discharge of wastewater to the Pamlico River. The five sites are located in Beaufort County. A copy of the entire application and additional information may be examined (or copies furnished upon request and payment of reproduction costs) during normal business hours of the Division of Coastal Management, 1424 Carolina Avenue, Washington, N.C., and/or the Division of Environmental Management, 1424 Carolina Avenue, Washington, N.C. The Division of Environmental Management water quality certification on or before Major Development permit and the Section projected date depending upon the nature proposes to take final action on this 8 May 1992. The issuance of the CAMA 401 Certification may deviate from this of the comments submitted and subsequent hearings that may result. All persons desiring to make comments should do so in writing to Mr. Roger Schecter, Director, Division of Coastal Management, P.O.
