As shown on the enclosed, revised permit area map, we are now requesting authorization for placement of dredge or fill material on 0.53 acres in Phases 2A and 3A of Sandy Springs. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. Any plots for lots with unfilled wetlands must contain deed restrictions which prevent additional fill unless specifically authorized by COE and DEM. Re: 2 Date Based on our records, there are no Federally-listed endangered or threatened species which may occur within the project impact area. The attached page(s) list(s) the Federally-listed species which may occur within the project impact area. If the proposed project will be removing pines greater than or equal to 30 years of age in pine or pine/hardwood habitat, surveys should be conducted for active red-cockaded woodpecker cavity trees in appropriate'habitat within a 1/2 mile radius of project boundaries. If red-cockaded woodpeckers are observed within the project area or active cavity trees found, the project has the potential to adversely affect the red-cockaded woodpecker, and you should contact this office for further information. The service concurs that the proposed project is not likely to adversely affect Federally-listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for Federal listing under the Endangered Species Act, as amended. Staffing limitations prevent us from conducting a field inspection of the project site. Therefore, we are unable to provide you with site specific recommendations at this time. Based on this review, we have identified significant uses which would be removed by this project. These are wildlife habitat and dispersal, water storage and.pollutant removal. Furthermore, insufficient evidence is present in our files to conclude that your project must be built in wetlands. Therefore, we are moving toward denial of your 401 Certification. However, since this is a Nationwide 26 project I will have to p,-ft out a Public Notice before DEM can deny the Certification. Until we receive this information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your project on administrative hold. Please provide us with information supporting: your position that your project must be constructed.in wetlands. Specifically can you construct your residential lots on nearby upland or prior converted farmland? Any documentation such as maps and narrative which you can supply to address upland alternatives may be helpful in our review of your 401 Certification. Please respond within two weeks of the date of this letter. The following information is submitted for your records, as well as a copy of the rating sheet and topo map (attached): 1. The wetlands rated at 26 points (47 percent). The wetlands are characterized mainly by floodplains adjacent to tributaries of Basal Creek (class B NSW). The floodplains are typically 50 to 100 feet wide with poorly drained, nearly level soils. The most significant value would be realized with water storage and resulting nutrient/sediment/pollutant removal. This benefit would be even more valuable once the upland portions of the tract are developed. 2. It is unclear with the plans how much of the wetlands will be impacted and if there are planned structures for stormwater control. In addition, other areas of wetlands exist on the total tract in addition to the map of Phase 2 which I was sent. 3. Some areas of wetlands have already been filled prior to my visit. Have these been permitted? I could not assess an accurate acreage of existing fill. One of these areas in particular has a tributary (possibly intermittent) channelized with no silt fence or other safety feature to prevent sediment from entering the watercourse. 4. A small area of fill is requested in Phase three. There does not appear to be reasonable justification for the roadway requiring this fill. The road does not serve any lots and dead- ends at the property line.
