Cobey, Jr., Secretary Regional Manager March 20, 1992 Mr. Rick Young Young's Auto Center and Salvage Route 3, Highway 117 Dudley, N.C. 28333 SUBJECT: 401 Water Quality Certification Wayne County Project #92-019-I Dear Mr. Young: On March 12, 1992 this office investigated your site at Young's Auto Center and Salvage in Wayne County for unauthorized fill activity within wetlands. This office was advised of this activity by the U.S. Army Corps of Engineers. The present filled area is greater than one third of an acre but less than one acre which requires submittal of an application to the Division of Environmental Management for a 401 Water Quality Certification. This fill has been performed without the required state authorization. This office has made the recommendation to the U.S. Army Corps of Engineers that the present fill material need not be removed if all debris and solid waste is removed from the fill material and taken to a permitted landfill. Any and all fill material in wetlands must be clean soil, free from any contamination. This, however, does not alleviate your responsibility for completing the application and acquiring the necessary 401 Water Quality Certification,. It should be noted that any further fill activity on this site, including the dispersing of the present fill material, will require further notification to this Division. Additional, acreage must be requested in the application prior to commencement of the activity. P.O. These copies must be submitted by the Division of Environmental Management to various state and federal agencies. Therefore, please complete the attached form and send six (6) additional copies [a total of seven (7) copies] of your 401 Certification application so we can initiate the comprehensive review required by our rules. A copy of the. General Certification is attached. This Certification maybe used in qualifying for overage under Corps of Engineers' Nationwide Permit No. 26.
