Highway 24, adjacent to and above the headwaters of Bearskin Swamp, near Snow Hill, Sampson County, North Carolina. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material greater than 1 but not more than 10 acres into headwaters and isolated waters of the United States. Your work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions. This verification will be valid for 2 years from the date of this letter unless the NWP authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. 'S SIG AT . 0,40 Notes: ITEM 15: A determination of the presence or potential for state- or federally-listed species to occur on the site was conducted, by a biologist with Sirrine Environmental Consultants, Cary North Carolina. The determination was performed through a review of records at North Carolina Natural Heritage Program (NCNHP) and a reconnaissance of the property. Two federally-listed animal species occur within Sampson County. These two species are the American alligator (Alligator mississippiensis) and the red-cockaded woodpecker (Picoides borealis). No habitat suitable for use by either of these two species was observed on the site or adjacent to the site. Only one federally-listed plant species is known to occur within Sampson County. This species is southern spicebush (Lindera melissifolia). This small shrub occurs in bays, sandy sinks and pond margins. The NCNHP has one recorded occurrence of the southern spicebush, approximately one-half mile northeast of the site. This spicebush is located in a small Carolina bay community north east of the site. No habitat suitable for the southern spicebush was observed on the landfill property. ITEM 16: An archaeological survey was conducted by Garrow & Associates, Raleigh, North Carolina.
