Upon review of your request for 401 Water Quality
Certification to place fill material in the stream channel of
Raven Fork Creek,.Straight Fork Creek and Oconaluftee River for
emergency streambank stabilization located near Cherokee in Swain
County, we have determined that the proposed fill can be covered
by General Water Quality Certification No. 2745 issued May'l,
1992.' A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers' Nationwide Permit No 37.

Raven Fork River is not a Designated Public Mo ntain
Trout Water (DPMTW). It is managed by the Eastern ?d of
The Cherokee Indians as a put-and-take stocked stream. This
stream offers good habitat for trout and supports a small
wild trout population as well as populations of other fish
species. No federal or state listed threatened or
endangered species are known to be present at this site.
The aquatic life of the river suffered a great deal of
damage-during the flood. Fish were killed by the force of
the water and the bottom was scoured by sand.and gravel.
The placement of gabion baskets'on the river bank will
probably have a minimal effect on aquatic organisms
remaining in the river. However, we believe that quarrying
rock out of the river will have long-term negative effects
on the aquatic organisms of the river. This will result in
shallow areas in the river, while the present rock bars
create areas of deep water which fish populations need and
the anglers that the Cherokee stocking program attracts
prefer. More importantly we believe that this
channelization part of the project will increase, not
decrease, the chance of catastrophic flooding.in the future.
Rock bars are laid down in rivers as a way of reducing the
water velocity of the stream. When they are removed, water
velocity increases. This destabilizes the system and causes
bank erosion downstream as the stream starts creating
meanders. This situation is worse during storm events when
the water velocity is even higher, resulting in greater
erosion and storm damage. This precipitates the need for
other actions such as bank stabilization. We strongly
recommend reconsidering those actions which will change the
river morphology and to consider better flood plain
management to reduce future storm damage, which is
inevitable as long as the flood plain is developed.
The NCWRC is concerned over potential adverse impacts
to aquatic resources in this drainage. The NCWRC will not
object to the issuance of the permit provided the following
conditions are met by the applicant:

acquired from a high ground source and not quarried
from the river.

DESCRIPTION OF EXISTING HAZARD
Job 1: Big Cove Loop. Old bridge with blockage of trees, moots, etc.
channel change because of flash flood. Camper home washed, owne r
had to jump from home as it washed down the river. Automobile
washed away also. Approximately 500 feet of river work. Home
destroyed. (Dump truck, loader track hoe)
Job 2: Shear Drop. 500 feet of river bank washed out with a shear drop of
7 feet next to a paved road. Homes are approximately 200 feet from
the river. (Dump truck, track hoe, dozer, gablon baskets)
Job 3: Swimming Hole. Trees, roots, debris, rock bar to be removed from
channel approximately 400 feet. (Track hoe loader, dump truck)
Job 4: Cherokee Trout Farm Water Intake. Intake still in tack. River
washed around system leaving trout farm waterless. Shear Drop 20
feet. Total wash out (Gabian baskets)
Job 4: Shear Drop. Across from Cherokee Trout Farms 16 feet approximately
300 feet up stream of lower raceways. Site is approximately 150
feet long. Ceremonial dance grounds are at this site. Cherokee
Trout Farm lost all trout. 3 raceways destroyed. Pump house
destroyed. (Gabion baskets, track hoe, dump truck, dozer loader)
Job 5: Cherokee Trout Farms. Shear drop approximately 250' upstream of
lower raceways. Sita is. approximately 2000 feet long. Ceremonial
dance grounds at this site. Trout farm lost ail trout and 3
raceways were destroyed. (Gabian baskets, track hoe and dump truck
loader)
Job 6: Settling Panda Rock Bar, trees, roots. Channel full, approximately
300 feet. (Track hoe, loader, dump truck, dozer)
Job 7: Home beside river. Trees and root mats to be removed sediment load

Faust, Madison and Yancey Counties, North Carolina.
For the purposes of the U. S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was provided for work done by or
funded by the Soil Conservation Service (SCS) qualifying as an "exigency"
situation (requiring immediate action) under its Emergency Watershed
Protection Program (7 CPR, Part 624).
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain other
required State or local approval.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization

expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,

Job 1: Big Cove Loop. Old bridge with blockage of frees, roots, etc.
channel change because of flash fIaad. Camper home washed, owner
had to Jump from home as it washed down the river. Automobile
washed away also. Approximately 500 feet of river work. Rome
destroyed. (Dump truck, loader track hoe)
Job 2: Shear Drop. 500 feet of river bank washed out with a *hear drop of
7 feet next to a paved roast. Homes are approximately 200 feet from
the river. (Dump truck, track hoe, dozer, gablon baskets)
Job 3: Swimming Nele. Trees, roots, debris, rock bar to be removed f ray
channel approximately 400 f QQt. (Track has loader, dump truck)
Job 4z Cherokee Trout Faro Water Intake. Intake still in tack. River
crashed around system leaving trout farm waterless. Shear Drop 20
feet. Total wash out (Gabion baskets)
Job 4: Shear Drop. Across from Cherokee Trout Farms 18 feet approximately
S00 meet up stream of lower raceways. Site is approximately 850
fact long. Ceremonial dance grounds are at this site. Cherokee
Trent Farm lost aI i trout. 3 racewave destroyed. Pump house
destroyed. (Gabian baskets, track has, dump truck, dozer loader)
Job 5: Cherokee Trout Farms. Shear drop approximately Z50' upstream of
lower raceways. Situ Is approximately 2000 feet long. Ceremonial
dance grounds at this site. Trout farm lost all trout and 3
receweye were destroyed. (Gabion baskets, track hoe and dump truck
1 oader)
Job fi: Settling Panda Rock Bar, trees, roots. Channel full, approximately
300 feet. (Track hoe, loader, dump truck, dozer)
Job 7: Nome beside river. Trees and root mats to be removed sediment load
to be removed. Debris to be removed. Approximately 2000 feet.

Job 13: Pentecostal Church. Rock bar, trees 1000 feet <Trask hoe, do2a r,

Job 14: Yogi Bear Campground. Shear Drop (400 feet gabion baskets needed)
Lout 25 sites. Clearing and snagging. 4000 feet rook bar removed
and filtering needed. (Track hoe, loader, dozer, dump truck)
People; had 10 minutes to evacuate. One meator home washed away.
Job IS:-Church of Christ. River Blockages rock. trees# approximately 2000
foot. (Track hoe, loader, dump truck, dozer) S houses endangered.
