Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less.are not considered significant). 2. Design shall be as shown on your 2 October 1992 letter with the boat basin beginning near the junction of the canals and ditch. Violations of any condition herein set forth shall result in revocation of this Certification. The Federal agencies have completed review of the proposal as presented by the application and Mr. David Moye's revised field investigation report, dated August 12, 1992. We recommend that the following conditions be included in the State authorization: a. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. b. The bulkhead and riprap material will be positioned in strict accordance with permit plans. To prevent an unintentional violation of this authorization, representatives of the North Carolina Division of Coastal Management and the Corps of Engineers will be available to stake the bulkhead and riprap alignments prior to construction. c. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. d. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. e. All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands. !44 OW -2- f. Excavation will not exceed 4 feet below the elevation of mean low water (MLW). g. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. h. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. i. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transfered to a third party. j. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less are not considered significant. As you are aware DEM issued a 401 Water Quality Certification for a similar project with less wetland and water impact on 29 April 1992. That project did not present a significant water quality issue since the fill was small and unavoidable. However your present project proposal requests significantly more fill than that earlier project (e.g., 0.25 acres of wetland fill compared to 0.04 acres of fill). In addition the new location of your proposed boat basin is of concern regarding flushing since it would be located on a small existing ditch rather than the larger canal. Finally we are concerned that your new location of the fill adjacent to the Albemarle Sound would remove a significant amount of water which is classified as B waters (swimming). ° '41P Mr. Roger Scheel September 24, 1992 Page 2 We are uncertain why you have applied for additional fill and for the new configuration of the boat basin. Please inform us of the purpose of your new design. We also need answers to the questions outlined above. An existing wooden groin will be repaired and two pile supported breakwaters are proposed offshore. s • " 9 VW w Charles Roger Scheel, Jr. Tyrrell County Project Setting The applicant's property is located in Tyrrell County off SR 1213 on the south side of Albemarle Sound at Edgewater Estates north of Columbia, North Carolina. The property is bordered on the east and west by developed and bulkheaded lots. The lot to the west is separated from the applicant's lot by a manmade canal. Both adjoining lots are vegetated with upland vegetation including lawn grass, pines, mixed hardwoods and ornamental shrubs. The site varies from 2' to 5' above mean sea level. The northern portion of the property fronts Albemarle Sound and is a highly eroded and unprotected shoreline. The eastern third of the property is highground vegetated with upland grasses and pines. The western two thirds of the property is designated as 404 wetland by the U.S. Army Corps of Engineers. The 404 wetland area is vegetated with mixed hardwood including cypress (most of which has been recently cut) and other various species of wetland vegetation. The western edge of the property borders a manmade agricultural drainage ditch and has a ±10' wide spoil bank with several openings into the 404 wetland area. Albemarle Sound is classified as SB waters by the Environmental Management Commission. Project Description - Revised The applicant proposes to excavate an approximately 50' by 150' boat basin adjacent an existing manmade canal by excavating an old spoil bank and 404 designated wetlands. The boat basin will be bulkheaded and a 6' wide dock will be placed adjacent the bulkhead. The remaining 10,833.75 ft' of 404 designated wetland will be filled and sloped to a grade of ±4' above MSL. The adjacent highground is to be graded behind a proposed retaining wall, constructed along the highground interface line approved by the U.S. Army Corps of Engineers, at ±5' above MSL. An existing spoil pile approximately 35' by 93.75' will be excavated to a ±4' elevation above MSL. The project includes additional bulkhead and rock riprap for shoreline stabilization and reclamation of land lost to erosion. The average distance offshore for this section of bulkhead is proposed to be 80' but will still be landward of the existing adjacent bulkheads. The section of this bulkhead adjacent the sound, will be armored with rock riprap extending 8' waterward of the bulkhead and tying into the existing wooden groin. Other structural features proposed include: a ±35' long by 6' wide pier with a 12' by 18' T-head, a 6' wide by 200' long dock adjacent the proposed boat basin, and two 12' long wooden breakwaters ±60' offshore. The applicant proposes to repair and/or replace an existing 135' long wooden groin of which ±80 will function as a bulkhead. An additional ±75' of bulkhead is proposed along the existing canal bank. • f ' w A Charles Roger Scheel, Jr. Tyrrell County Anticipated Impacts - Revised The project as proposed would result in the excavating of approximately 4,500 square feet of 404 designated wetland and 1,600 square feet of canal bottom. The project would also result in the filling of approximately 10,833.75 square feet of 404 designated wetland and 7,500 square feet of sound bottom. The applicant's property is located in Tyrrell County off SR 1213 on the south side of Albemarle Sound at Edgewater Estates north of Columbia, North Carolina. The property is bordered on the east and west by developed and bulkheaded lots. The lot to the west is separated from the applicant's lot by amanmade canal. Both adjoining lots are vegetated with upland vegetation including lawn grass, pines, mixed hardwoods and ornamental shrubs. The site varies from 2' to 5' above mean sea level. The northern portion of the property fronts Albemarle Sound and is a highly eroded and unprotected shoreline. The eastern third of the property is highground vegetated with upland grasses and pines. The western two thirds of the property is designated as 404 wetland by the U.S. Army Corps of Engineers. The 404 wetland area is vegetated with mixed hardwood including cypress (most of which has been recently cut) and other various species of wetland vegetation. The western edge of the property borders a manmade agricultural drainage ditch and has a ± 10' wide spoil bank with several openings into the 404 wetland area. Albemarle Sound is classified as SB waters by the Environmental Management Commission. Project description The applicant proposes to excavate an irregularly shaped 3,638 square foot boat basin protected by a proposed rock riprap breakwater on one side and the remaining area stabilized by bulkhead. The riprap breakwater will have a 27' toe to toe width and will extend 5' above the NWL. The basin is to be excavated to 4' below the NWL. The landward side of the basin will be stabilized with bulkheading which will be adjacent the 404 wetland and will be 105' long and will not project above the adjacent wetland elevation. The project includes additional bulkhead and rock riprap for shore stabilization and reclamation of land lost to erosion. The maximum.distance offshore for this section of bulkhead is proposed to be 30' and will extend 5' above the NWL. The section of this bulkhead adjacent the sound will also be armored with rock riprap extending 15' waterward of the bulkhead and tying into the proposed breakwater. Remaining highground on the project site is to be filled to increase the elevation above the NWL. This fill area will be confined by a combination of the 5' high section of bulkhead and a proposed retaining wall to be constructed along the highground wetland interface line approved by the U.S. Army Corps of Engineers. This area will be stabilized via sloping and seeding. An old spoil bank on the property is proposed to be excavated to the 3' contour above the NWL and the resulting material will be used as fill. Other structural features proposed include: a ± 75' long by 6' wide pier with a 12' by 18' T-head, a ± 150' long by 6' wide dock constructed landward of the bulkhead, and two 20' long wooden breakwaters ± 90' offshore. The applicant proposes to repair and/or replace an existing.135' long wooden groin. Anticipated impacts - The project as proposed would result in the covering of approximately 3,594 square feet of sound bottom with riprap. Approximately 1,800 square feet of sound bottom and 1,838 square feet of 404 wetland will be excavated for the boat basin. The project would result in localized turbidity associated with dredge and fill activities as well as with construction activity. The goal of the proposed project is the stabilization of an existing canal mouth and the creation of a protected basin. David W. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. c. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. d. All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands. e. Excavation will not exceed 4 feet below the elevation of mean low water (MLW). f. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. r,10 -2- g. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. h. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transfered to a third party. i. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less are not considered significant. An existing wooden groin will be repaired and two pile supported breakwaters are proposed offshore. 1 At Charles Roger Scheel, Jr. Tyrrell County Project Setting The applicant's property is located in Tyrrell County off SR 1213 on the south side of Albemarle Sound at Edgewater Estates north of Columbia, North Carolina. The property is bordered on the east and west by developed and bulkheaded lots. The lot to the west is separated from the applicant's lot by a manmade canal. Both adjoining lots are vegetated with upland vegetation including lawn grass, pines, mixed hardwoods and ornamental shrubs. The site varies from 2' to 5' above mean sea level. The northern portion of the property fronts Albemarle Sound and is a highly eroded and unprotected shoreline. The eastern third of the property is highground vegetated with upland grasses and pines. The western two thirds of the property is designated as 404 wetland by the U.S. Army Corps of Engineers. The 404 wetland area is vegetated with mixed hardwood including cypress (most of which has been recently cut) and other various species of wetland vegetation. The western edge of the property borders a manmade agricultural drainage ditch and has a ±10' wide spoil bank with several openings into the 404 wetland area. Albemarle Sound is classified as SB waters by the Environmental Management Commission. Project Description - Revised The applicant proposes to excavate an approximately 50' by 150' boat basin adjacent an existing manmade canal by excavating an old spoil bank and 404 designated wetlands. The boat basin will be bulkheaded and a 6' wide dock will be placed adjacent the bulkhead. The remaining 10,833.75 ft' of 404 designated wetland will be filled and sloped to a grade of ±4' above MSL. The adjacent highground is to be graded behind a proposed retaining wall, constructed along the highground interface line approved by the U.S. Army Corps of Engineers, at ±5' above MSL. An existing spoil pile approximately 35' by 93.75' will be excavated to a ±4' elevation above MSL. The project includes additional bulkhead and rock riprap for shoreline stabilization and reclamation of land lost to erosion. The average distance offshore for this section of bulkhead is proposed to be 80' but will still be landward of the existing adjacent bulkheads. The section of this bulkhead adjacent the sound, will be armored with rock riprap extending 8' waterward of the bulkhead and tying into the existing wooden groin. Other structural features proposed include: a ±35' long by 6' wide pier with a 12' by 18' T-head, a 6' wide by 200' long dock adjacent the proposed boat basin, and two 12' long wooden breakwaters ±60' offshore. The applicant proposes to repair and/or replace an existing 135' long wooden groin of which ±80 will function as a bulkhead. An additional ±75' of bulkhead is proposed along the existing canal bank. According to said application, Mr. Scheel proposes to excavate a 4,500 sq. ft. boat basin adjacent an existing canal. Bulkhead and stone riprap is proposed to reclaim land lost to erosion. Existing highground and approximately 10,800 sq. ft. of adjacent 404 designated wetland is to be filled to increase elevation above the Normal Water Level. A pier with T-head as well as a dock is proposed. An existing wooden groin will be repaired and two pile supported breakwaters are proposed offshore. A copy of the entire amended application and additional information may be examined (or copies furnished upon request and payment of reproduction costs) during normal business hours of the Division of Coastal Management, 1424 Carolina Avenue, Washington, N.C., and/or the Division of Environmental Management, 1424 Carolina Avenue, Washington, N.C. The Division of Environmental Management proposes to take final action on this water quality certification on or before 26 September 1992. The issuance of the CAMA Major Development permit and the Section 401 Certification may deviate from this projected date depending upon the nature of the comments submitted and subsequent hearings that may result. All persons desiring to make comments should do so in writing to Mr. Roger Schecter, Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C. 27611 prior to 18 September 1992 for consideration in the CAMA permit decision, and to Mr. John Dorney, Division of Environmental Management, P.O.
