Director Division of Water Quality November 10, 2006 DWQ Project # 2006-0197 • New Hanover County CERTIFIED MAIL: 7005 0390 0001 3200 5373 RETURN RECEIPT REQUESTED Mr. Tim Smith, Manager Helmsdale Investors, LLC Preston Development Company 100 Weston Estates Way Cary, NC 27513 Subject Property: Helmsdale at Landfall REQUEST FOR MORE INFORMATION Dear Mr. Smith: On February 6, 2006, the Division of Water Quality (DWQ) received your application dated February 1, 2006 to impact 0.295 acres of wetlands and 72 feet of stream to construct the proposed 48 lot residential subdivision. On June 7, 2006, DWQ received a response to a request for additional information and the total impacts proposed were reduced to 0.207 acres of wetlands. On September 15, 2006, DWQ received draft restrictive covenants and a preservation map along with a revised impact map and associated cross-sections. While reviewing this information, some discrepancies were identified and discussed with your agent, Kim Williams. Specifically, the wetland impact areas and the preserved wetland areas were listed differently on the provided maps. In addition, it became clear that Helmsdale Investors is only proposing to span the stream at impact #1 and not the wetlands. The riparian wetlands are an importarit aspect of the stream channel and installing the arch culvert as proposed will most likely result in degradation of the channel upstream and downstream of the culvert. Please revise the arch culvert detail to span the entire crossing, upland to upland. Please provide the revised maps. The project will remain on hold until we receive this information. Please respond within three weeks of the date of this letter by sending this information to me in writing and Cyndi Karoly of the DWQ 401 Oversight Unit in the Raleigh Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
