L. Stephenson, Neuse Winds Community Dock, for a Department of the Army permit to construct ten-slip, community marina facilities on Orchard Creek, Neuse Winds Community, near Oriental, Pamlico County, North Carolina. The Federal agencies have completed review of the proposal as presented by the revised application and Mr. David Noble's field investigation report of August 17, 1992. By letter of September 11, 1992 (copy enclosed) the National Marine Fisheries Service (NMFS) recommends that the proposed work not be authorized as it would result in degradation of water quality with adverse effects on fishery resources. NMFS indicates that they have coordinated with the North Carolina Division of Health Services (NCDHS) and learned that accomplishment of work would result in the closure of "SA" waters that are currently open for the harvest of shellfish. The North Carolina Division of Marine Fisheries (NCDMF) has informed us that the permit area has no shellfish resources. Although the NMFS wishes to continue to object, they have indicated that they will not pursue denial of authorization. We recommend that the following conditions be included in the State authorization: a. All work authorized by this permit must be performed in strict compliance with the permit plans. b. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. -2- c. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. STEPHENSON, PAMLICO CO. PAGE #2 NOTE: This project was originally circulated in June, 1990, but was put 'on hold' because of insufficient stormwater information. 9. NARRATIVE DESCRIPTION: The applicant's property is a 66 acre tract known as Neuse Winds Subdivision, located on Orchard Creek and the Neuse River, off SR1317, near the community of Pamlico, in Pamlico County. The property is basically undeveloped, except that a road has been constructed and paved. The applicant's proposed project is to construct a 10 slip community dock which would extend approximately 180' into Orchard Creek. The proposed dock will have a 6' x 315' access dock over coastal wetlands. At present, there are no other community docks or marinas in the Orchard Creek area, but there are a few individual docks. Water depths in the project area range from 1-4' NWL. 10. ANTICIPATED IMPACTS: The waters of Orchard Creek are classified as 'SA' by the Division of Environmental Management, open to shellfishing by the Division of Environmental Health and Division of Marine Fisheries, and designated as a Primary Nursery Area by the Division of Marine Fisheries. If the applicant is not claiming to be the owner of said properly, then forward a copy of the decd or other instrument under which the owner claims title, plus written penmission from the owner to carry out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A storrmvater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management. A list of the names and complete addresses of the adjacent waterfront (riparian) landowners. The property is basically undeveloped, except that a road has been constructed and paved. The applicant's proposed project is to construct a 10 slip community dock which would extend approximately 180' into Orchard Creek. The proposed dock will have a 6' x 315' access dock over coastal wetlands. At present, there are no other community docks or marinas in the Orchard Creek area, but there are a few individual docks.
