Site Description
The applicant, ,a commercial grocery wholesale distributor,
owns approximately .9 acres of land adjacent Camden Causeway
Drawbridge on the Pasquotank River, along North Water Street,
Elizabeth City. This tract consist of four individual lots
17,166.3 sq. ft., 16,098.8 sq. ft., 2,053.0 sq. ft. and 3957.7
sq. ft. respectively. Pell Paper and Box Company is the only
adjacent riparian property owner. The applicant's property lies
outside of the Elizabeth City Downtown revitalization area and is
zoned C-4 (Central Bu!--iness District).
The tract is eF:sentially developed. Buildings and parking
occupy the bulk of the .9 acre site. The owners have left a
narrow 9rasso?l/landscape buffer around the parking area. A
woodon hoardwalk approximately 140 ft. long parallels the
shorol i ri- of the par}; i ng area. Eight derelict pilings which lie
waterwai rl of t-lie ex i meting warehouse are all that remain of a
former dog-1:.
11m Pasquotank Fiver is defined as inland waters starting at
the Camdrin Carseway Bridge and going upriver beyond the
applicant's tract. The North Carolina Division of Environmental
Management water quality classification for this portion of the
Pasquotank River is Sc. The river is part of CAMA's Public Trust
AEC. Th(o f.ecirr.ally maintained Intracoastal Waterway is charted
through this portion of the Pasquotank River. The channel is 100
ft. wide. The river is approximately 530 ft. wide in the project
area.
The applicant proposes to construct a wooden dock 147 ft. x
10 ft. along the alignment of the previous wooden dock. The
existing pilings will be used with the proposed structure. A
stairway leading from the ground level dock to a raised 10 ft. x
6 ft. wooden platform is proposed. No dredging will be required.
The river is approximately 7 ft. 6 in. deep along the alignment
of the existing pilings. Navigation charts show the Pasquotank
River to be 18 ft. deep within the channel. The project will be
approximately 130 ft. landward of the channel's closest edge.
Anticip jged Impacts
This project will result in a minimal increase in river
turbidity during construction. The proposed dock will be more
than 85 ft. from the edge of the Intracoastal Waterway. Increased
boat activity along the proposed pier may cause congestion with
boats idling nearby awaiting a bridge opening.

CAMA Review
No historical or archeological significance is associated
with the project area. Several ship wrecks are located across
from the project area on the Camden County side of the river. No
endangered species habitat or endangered remnant plant
communities exist in the project area.
Land use plan consistency review is underway and will be
submitted concurrently with other reviewing agencies' comments.

8 ADDITIONAL INFORMATION
In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said properly, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management and should be advised by the applicant of
that opportuni t y.

6 ft. wooden platform is proposed. No dredging will be required.
The river is approximately 7 ft. 6 in. deep along the alignment
of the existing pilings. Navigation charts show the Pasquotank
River to be 18 ft. deep within the channel. The project will be
approximately 130 ft. landward of the channel's closest edge.
Anticipated Impacts
This project will result in a minimal increase in river
turbidity during construction. The proposed dock will be more
than 85 ft. from the edge of the Intracoastal Waterway. Increased
boat activity along the proposed pier may cause congestion with
boats idling nearby awaiting a bridge opening.

may have been developed in consultation with the
Division of Environmental Management.

adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management and should be advised by the applicant of

9. NARRATIVE DESCRIPTION: The applicant's property is a 22
acre tract oca e o f SR1334, on Trent Creek, near
Stonewall, in Pamlico County. A wetlands survey has been
conducted and is enclosed. A significant portion of the
property is 1404' wetlands with loblolly pine, red maple,
sweet gum, pond pine, water oak, and black gum being the
dominant species. There is a 30-100' border of Spartina
cynosuroides along Trent Creek.
The applicant proposes to construct 2 fabrication buildings
and a work area near SR1334 (these facilities may already be
under construction, but are not located in an Area of
Environmental Concern). The buildings and stone work area
will occupy approximately 2.75 acres and a 1,325' x 501
stone roadway is proposed leading from the work area down to
a proposed launching area.
The proposed launching area and slip consist of a 701 x 48'
concrete ramp at the head of a 230' x 481 x -8' slip area.
The applicant is proposing to bulkhead the entire
slip/launch area and also proposes a boardwalk down one
side. A 130' x 48-120' x -8' access channel is proposed for
leading into the slip.
The applicant proposes to dredge the access channel with a
hydraulic dredge and pump the dredge spoil to a 300' x 230'
diked spoil disposal area. Existing water depths in the
project area range from Of to -9' NWL.
10. ANTICIPATED IMPACTS: The waters of Trent Creek are
classified as SC by the Division of Environmental
Management and are closed to shellfishinq by the Division of
Environmental Health and Division of Marine Fisheries.
The proposed launching ramp and slip will require the
excavation of approximately 1,400 sq. ft. of S artina
c nosuroides and 1,500 sq. ft. of 1404' wetlan s.
Approximately 4,650 cu. yds. of fine sand and silt will be
dredged from a 10,000 sq. ft. area of estuarine waters and
2,900 sq. ft. of wetlands. An additional 950 cy. yds. of
spoil material will be excavated from approximately 5,000
sq. ft. of highground. Approximately 6 acres total land
area will be graded and disturbed.

The Department of Environment, Health & aturalljWurces
hereby gives public notice as required by NC S 113A-119(b) and
1-43-215 3 (a) (1) (c ) that JENNETTE FRUIT AND O E DS GROUP
Pasquotank County, filed an application on J 1 11ACVb"k CTi0h1
for a permit from the Division of Coastal Management to
develop in an Area of Environmental Concern and for
certification from the Division of Environmental Management
that a discharge of fill material in project wetlands will
not violate applicable water quality standards.
According to said application JENNETTE FRUIT AND
PRODUCE proposes building a 147 ft. x 10 ft. wooden dock
along the alignment of existing pilings on the Pasquotank
River. The project site is located adjacent to the Camden
Causeway drawbridge over the Pasquotank River on North Water
Street, Elizabeth City.
A copy of the entire application and additional information
may be examined (or copies furnished upon request and payment of
reproduction costs) during normal business hours at the office of
Richard L. Watts, Division of Coastal Management, located at
the Division of Coastal Management, 1367.US 17 South,
Elizabeth City, N.C., 919/264-3901, and/or the office of
Deborah Sawyer, Division of Environmental Management, DEHNR
Regional Field Office, Washington, N.C., (919) 946-6481.
The Division of Environmental Management proposes to take
final action on this water quality certification on or before
August 31, 1992. The issuance of the CAMA Major Development
permit and the Section 401 Certification may deviate from
this projected date depending upon the nature of the
comments submitted and subsequent hearings that may result.
All persons desiring to make comments should do so in
writing to Roger Schecter, Director, Division of Coastal
Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
August 26, 1992 for consideration in the CAMA permit
decision, and to Mr. John Dorney, Division of Environmental
Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
August 21, 1992 for consideration in the water quality
certification decision. Later comments on the.CAMA
application will be accepted and considered up to.the time
of permit decision. Project modifications may occur based
on review and comment by the public and state and federal
agencies. Notice of the permit decision in this matter will
be provided upon request.

On February 11, 1991, we renewed general permit No. CESAW-C080-N-000-0291
(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received August 4, 1992, for Department of
the Army authorization to construct a wooden dock on the Pasquotank River,
adjacent to the Camden Causeway Drawbridge, Elizabeth City, Pasquotank County,
North Carolina, indicates it to be a candidate for Federal authorization under
this general permit. Accordingly, the administrative processing of your
application will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be furnished to the
State.
If your application must be withdrawn from this general permit process for
any reason, you will be informed regarding its further management. If there
are no unresolved differences in State-Federal positions or policies, the
final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the Rivers and Harbors Act,
has been assigned Action ID No. 199203134 and will be coordinated by Ms. Laura

Reference the application of Jennette Fruit and Produce, Incorporated, for
a Department of the Army permit to construct a wooden dock on the Pasquotank
River, Atlantic Intracoastal Waterway (AIWW), adjacent to the Camden Causeway
Drawbridge, Elizabeth City, Pasquotank County, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.
c. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
d. The permittee must install and maintain, at his expense, any signal
lights and signals prescribed by the U.S. Coast Guard, through regulations or
otherwise, on authorized facilities.
e. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.

f. Approval of the structure was based on determination that there would
be no obstruction to navigation. Under conditions existing in the Atlantic
Intracoastal Waterway (AIWW), a possibility exists that the structure may be
damaged by wave wash from passing vessels. Unreasonable slowing down of
vessel traffic cannot be required because it would tend to nullify the
navigational benefits on which the AIWW was justified. Issuance of this
permit should not be construed as relieving the permittee of taking proper
steps to insure the structure and moored boats will not be damaged by wave
wash normally to be expected in the AIWW.
