The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. All work authorized by this permit must be performed in strict compliance with the permit plans. b. The permittee's scheme of development, of which the authorized work is a part, contemplates the presence of structures and their attendant utilities on lands subject to an easement in favor of the United States for the operation, maintenance, improvement, and enlargement of the Atlantic Intracoastal Waterway (AIWW). Accordingly, the permittee will be required to remove such structures and improvements at his own expense in the event that, in the judgment of the U.S. Army Corps of Engineers acting on behalf of the United States, the lands are needed at any time for any purpose within the scope of the easement. Permanent buildings will not be constructed within the easement. c. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. -2- d. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. e. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. f. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. g. Approval of the structure was based on determination that there would be no obstruction to navigation. Under conditions existing in the Atlantic Intracoastal Waterway (AIWW), a possibility exists that the structure may be damaged by wave wash from passing vessels. Unreasonable slowing down of vessel traffic cannot be required because it would tend to nullify the navigational benefits on which the AIWW was justified. Issuance of this permit should not be construed as relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave wash normally to be expected in the AIWW. Hurdle and Harrington Bio Report Page Two Site L)escr_iption Th- ar)v).licants (tfurdle and Harrington) own a .62 acre lot (27,]99 ^q. ft.) in, rlizabeth City, near the street intersection of Warrd )nd [)o.i.ndext-or_ adjacent to the Pasquotank River. The project sate is zoned C-4 (Central Business District) but lies outside of:' the Elizabeth City Downtown revitalization area. The adjacent property upriver from the applicants tract is owned by the Roanoke Bible College. Continental Plaza (formally Continental Grain Storage facility) is the adjacent downriver property. A multi--family development with marina is proposed for the Continental Plaza site. The soil on the site is characterized as Augusta, fine sandy loam. The soils on the site have been subject to considerable disturbance and filling. The elevation of the tract varies from three to seven feet above mean sea level. Vegetation on the site consists primarily of common upland weeds, pigweed (Amaranthus retroflexos), switchgrass (Panicum vircratom), ragweed (Ambrosia artemisiifolia) and a facultative wet indication species, giant reed (Phragmites communis). The Pasquotank River is 750 ft. wide in the vicinity of the project and is classified as "Inland Waters" by NC Wildlife Resources Commission and is part of CAMA's Public Trust Area of Environmental Concern (AEC). North Carolina Division of Environmental Management's water quality classification for this portion of the Pasquotank River is SC. The federally maintained Intracoastal Waterway is charted through this segment of the Pasquotank River. Navigation charts show the depth of the channel to be 18 ft. and the width of the channel to be 100 ft. The applicants plan to build eight townhouses on the tract. They propose to construct boat dockage for each townhouse resident. Dockage will consists of a pier 71 ft. x 6 ft. with a "T" head platform 24 ft. x 10 ft. at the terminus of the pier. Four finger piers (each approximately 8 ft. x 4 ft.) and 10 mooring pilings are planned. The structure will provide dockage for 8 boats. Water depths along the proposed pier will vary from approximately 3 ft. at the bulkhead to 8 ft. at a distance approximately 16 ft. waterward of the existing bulkhead. Waterward of 16ft. the river depth exceeds 8 ft. The proposed docking facility will accommodate runabouts and sailboats up to 25 ft. in length. No dredging will be required. The applicant proposes to provide electrical service to the dock but no sewage pumpouts or other sanitary facilities. The Hurdle and Harrington Bio Report: Page Throe appl.i.carnt-.s plan to post "No Sewage Discharge" signs on the pier and make "no sewacve discharge" a part of the development's restrictive covenant:!;. The developers will have a "no overnight and live-aboard" pol.i.cy. They desire authorization for one "No Wake" sign to be pl deed in the center of the most waterward end of the proposed "T" head. Anticipated Impacts The proposed project will create a temporary increase in water turbidity during the construction phase. No dredging will be necessary reducing the potential for suspending solids. Normal marina activity will create the opportunity for additional water pollution. The lack of sewage facilities at the site may encourage boat owners to discharge waste illegally. Historically large commercial barges were brought to the adjacent property (Continental Plaza) by tugboat. The proposed project may interfere with this type of activity. However, the owners of Continental Plaza have stated they will no longer have barge traffic. Other commercial barge activity continues to navigate past the proposed project site. The applicants project may pose a hazard to such traffic. The distance between the proposed pier and the edge of the federally maintained channel is greater than 85 ft. The project should pose a minimal risk to ordinary private vessel traffic. CAMA Review No archeological./historical significance has been associated with this site. Several ship wrecks have been identified nearby. No unique remnant species of geologic formations are known to be involved with the project site. PROJECT SUMMARY: A_pp]_i_cant proposes building a pier (71-..ft. x 6 ft _1_ nlaf"fnrm f I A f'4- Hurdle and Harrington Bio Report Page Two Site Description The applicants (Hurdle and Harrington) own a .62 acre lot (27,199 sq. ft.) in Elizabeth City, near the street intersection of Ward and Poindexter adjacent to the Pasquotank River. The project site is zoned C-4 (Central Business District) but lies outside of the Elizabeth City Downtown revitalization area. The adjacent property upriver from the applicants tract is owned by the Roanoke Bible College. Continental Plaza (formally Continental Grain Storage facility) is the adjacent downriver property. A multi-family development with marina is proposed for the Continental Plaza site. The soil on the site is characterized as Augusta, fine sandy loam. The soils on the site have been subject to considerable disturbance and filling. The elevation of the tract varies from three to seven feet above mean sea level. Vegetation on the site consists primarily of common upland weeds, pigweed (Amaranthus retroflexos), switchgrass (Panicum virgatom), ragweed (Ambrosia artemisiifolia) and a facultative wet indication species, giant reed (Phraamites communis). The Pasquotank River is 750 ft. wide in the vicinity of the project and is classified as "Inland Waters" by NC Wildlife Resources Commission and is part of CAMA's Public Trust Area of Environmental Concern (AEC). North Carolina Division of Environmental Management's water quality classification for this portion of the Pasquotank River is SC. The federally maintained Intracoastal Waterway is charted through this segment of the Pasquotank River. Navigation charts show the depth of the channel to be 18 ft. and the width of the channel to be 100 ft. The applicants plan to build eight townhouses on the tract. They propose to construct boat dockage for each townhouse resident. Dockage will consists of a pier 71 ft. x 6 ft. with a "T" head platform 24 ft. x 10 ft. at the terminus of the pier. Four finger piers (each approximately 8 ft. x 4 ft.) and 10 mooring pilings are planned. The structure will provide dockage for 8 boats. Water depths along the proposed pier will vary from approximately 3 ft, at the bulkhead to 8 ft. at a distance approximately 16 Et. waterward of the existing bulkhead. Waterward of 16ft. the river depth exceeds 8 ft. The proposed doc)cing facility will accommodate runabouts and sailboats up to 25 ft. in length. No dredging will be required. The applicant proposes to provide electrical service to the dock but no sewage pumpouts or other sanitary facilitie s. The N? %p Hurdle and Harrington Bio Report Page Three applicants plan to post "No Sewage Discharge" signs on the pier and make "no sewage discharge" a part of the development's restrictive covenants. The developers will have a "no overnight and live-aboard" policy. They desire authorization for one "No Wake" sign to be placed in the center of the most waterward end of the proposed "T" head. No dredging will be nece?-;sary reducing the potential for suspending solids. Normal marina activ.it-y will create the opportunity for additional water pollution. Tire lack of sewage facilities at the site may encourage boat owners to discharge waste illegally. Historically large commercial barges were brought to the adjacent property (continental Plaza) by tugboat. The proposed project may interfere with this type of activity. However, the owners of Continental Plaza have stated they will no longer have barge traffic. Other commercial barge activity continues to navigate past the proposed project site. The applicants project may pose a hazard to such traffic. The distance between the proposed pier and the edge of the federally maintained channel is greater than 85 ft. The project should pose a minimal risk to ordinary private vessel traffic. LAMA Review No archeological/historical significance has been associated with this site. Several ship wrecks have been identified nearby. No unique remnant species of geologic formations are known to be involved with the project site.
