Strickland Post Office Box 321 Salemburg, North Carolina 28385 Dear Mr. Strickland: On June 24, 1992, you met with Ms. Jean Benton of my staff on your property located off a private farm road, off S.R. 1322, approximately 100 to 200 yards north of S.R. 1233, above the headwaters of an unnamed tributary to Rye Swamp, near Salemburg, Sampson County, North Carolina to determine our regulatory jurisdiction pursuant to Section 404 of the Clean Water Act. Your primary application submitted to this office by the Soil Conservation Service indicated that approximately 8 acres of wetlands would be impacted by your proposed construction of turkey houses. Further examination by Ms. Benton revealed that no more than 2.5 acres would be impacted by your project. This activity may be permitted by Nationwide Permit No. 26 through submission and approval of a Pre-Discharge. Notification application. During this meeting, you indicated to Ms. Benton that you were responsible for the mechanized land clearing that had already occurred. Ms. Benton informed you that this activity within a wetland without a permit constitutes a violation of our regulations. Therefore, she advised you to refrain from any further activities until proper authorization from State agencies and our office was obtained. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material greater than 1 but not more than 10, acres into headwaters and isolated waters of the United States. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit -2- authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. Strickland Proposed Turkey Houses Near Salemburg, Sampson County The purpose of this project is to clear and fill an area totalling approximately 8 acres and construct a series of turkey houses. Of this acreage, an estimated 2.5 acres has been designated as wetlands by the COE. Due to tornado damage several years ago (around 1984), most of the usable timber on this site has been removed. Extensive field ditches separate the subject area from adjacent row crop lands. These same ditches have successfully removed most of the moisture from the site. As a result, most of the vegetation observed was of the upland variety. Due to the very low wetland values associated with this site, and the absence of any significant uses, it is the recommendation of this office that the requested certification be granted.
