Pittman Transcontinental Gas Pipe Line Corporation Z 2800 Post Oak Boulevard Post Office Box 1396 - Houston, Texas 77251-1396 WETLANDS C;t v t WATER QLALITY SEC I Dear Mr. Pittman: Reference your May 13, 1992 application for Department of the Army authorization to install a 1.5-inch diameter cathodic protection cable in Rowan County, North Carolina. The cable will be installed in a trench 4 to 8 inches wide and a minimum of 36 inches deep for 2.29 miles starting at U.S. 601 and running northeast to the South Yadkin River. It will be necessary to cross several unnamed tributaries of Second Creek and the South Yadkin River. Material excavated from the trench will be returned and contours restored to original condition. Disturbed areas will be seeded, fertilized, and mulched. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 404 of the Clean Water Act, was provided for the discharge of material for backfill or bedding for utility lines, including outfall and intake structures, provided there is no change in pre-construction contours. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and f..-n' y -2- conditions of the NWP authorization, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. Since then, I have received the Corps of Engineers determination that the project falls under Nationwide Permit 12 for which the State of North Carolina has denied water quality certification. Therefore, please find enclosed seven copies of an application for 401 certification concurrence. As I described in my aforementioned letter, the actual disturbances associated with this type of work are minimal since the trench is only 6" wide. Therefore, I respectfully request that you review this information and issue the necessary approval as soon as possible.
