Dear Mr. Wright: I was hired by South Fork Farms, Inc., Harry T. Phelps, Sr., Harry T. Phelps, Jr. and Michael Todd Phelps to prepare the permit application you refer to as Action ID. 199202198. This application is for a permit to construct a boat ramp, repair and backfill a bulkhead, construct a pier and a swimming pool on Bulls Bay section of the Albemarle Sound. This letter is to provide the additional information you requested in your letters of May 20, 1992 to: South Fork Farms, Inc., Harry T. Phelps, Sr., Harry T. Phelps, Jr. and Michael Todd Phelps. In response to section a. of your letter, there are no alternatives to the bulkhead repair and the backfilling of the areas that have washed out behind the damaged bulkhead. It is obvious that these repairs can only be made in the places that need repair. The pool, boat ramp, pier and jettys are all designed to have minimum effect on the water and its adjacent properties. The pool should have no effect on the water and any wetland areas. The pier will have very little effect on the water. The boat ramp is designed to have minimum effect on the water and adjacent land because its design will not cause any excavation. Auction - The Marketing Advantage a & 0] • REALTOR AAt In response to section b. of your letter, the only wetland areas effected by this plan is those very small areas that have developed since the existing bulkhead broke and allowed these areas to wash out. Again, there is no practical alternative since these repairs can only be made in the affected areas. In response to section c. of your letter, there has been no appropiate nor practical mitigation made since there is no unavoidable wetland loss. The wetlands that are affected by this permit did not exist until the bulkhead became nonfunctional and allowed these areas to wash out. This letter should answer the questions you addressed in your letter of May 20, 1992. PROJECT SUMMARY: The applicant concrete bulkhead, build a pier, ±1,152 ±2,080 ±2,080 ±4,168 to repair and backfill an _pool is also pressed - ,w E Project setting The applicant's property is located at Albemarle Shores off SR 1237 on the south side of Albemarle Sound on Bull Bay in Tyrrell County, North Carolina. The project site consist of six lots (five residential and one community lot). Three of the residential lots are developed with houses, lawn grass and landscaping around the houses. The remaining three lots are undeveloped. The entire project site is bulkheaded. The bulkhead is made of concrete bridge pilings which have shifted causing three eroded areas behind the openings which average 8' landward of the existing bulkhead alignment. The downstream (east) adjoining property is developed and bulkheaded including a house and vegetated with lawn grass. The upstream (west) adjoining property is an undeveloped wooded swamp containing mixed hardwoods. The project site is approximately 6' above mean sea level. Bull Bay is classified SB waters by the Environmental Management Commission. Project description The applicant proposes to repair an existing 576' concrete bulkhead. The bulkhead is made of concrete bridge pilings stacked to form a wall. The existing bulkhead has shifted and the applicant proposes to rebuild the wall along the NWL using 6" by 6" or 8" by 8" post every 10' to hold the pilings in place. The upstream limit of the repaired bulkhead will wingwall into the existing high ground and stops short of the adjoining wooded wetland. Ten wooden goins 25' in length are proposed spaced 50' apart. A 4' wide by 100' long pier will be build with a 20' by 10' T-head. A 10' wide by 24' long boat ramp is proposed which will attach to the top of the repaired bulkhead. The applicant also proposes to construct a 20' by 32' inground pool with a 10' wide concrete pad surrounding it within the 75' Estuarine Shoreline AEC. Anticipated impacts The project as proposed would result in the filling of approximately 1,152 square feet of sound bottom. Localized turbidity would occur as a result of the bulkhead and piling installation as well as the boatramp placement. David W. The bulkhead will not extend waterward more than 8 feet from the normal water level at any point along its alignment at the time of construction. 2. The bulkhead must be structurally tight prior to any backfilling activities. 3. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials or unsightly debris will not be used. 4. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third party. 5. The groins will be constructed of wood and extend a maximum of 1 foot above the NWL. David W. As we discussed by phone this morning, he is proposing to do the following: repair the bulkhead that has been in place for some time; to backfill behind the bulkhead; to construct a swimming pool within seventy five feet of the Albemarle Sound; to construct a pier and to construct a boat ramp that will extend into the Albemarle Sound. A swimming pool is also proposed. • i Project setting The applicant's property is located at Albemarle Shores off SR 1237 on the south side of Albemarle Sound on Bull Bay in Tyrrell County, North Carolina. The project site consist of six lots (five residential and one community lot). Three of the residential lots are developed with houses, lawn grass and landscaping around the houses. The remaining three lots are undeveloped. The entire project site is bulkheaded. The bulkhead is made of concrete bridge pilings which have shifted causing three eroded areas behind the openings which average 8' landward of the existing bulkhead alignment. The downstream (east) adjoining property is developed and bulkheaded including a house and vegetated with lawn grass. The upstream (west) adjoining property is an undeveloped wooded swamp containing mixed hardwoods. The project site is approximately 6' above mean sea level. Bull Bay is classified SB waters by the Environmental Management Commission. Project description The applicant proposes to repair an existing 576' concrete bulkhead. The bulkhead is made of concrete bridge pilings stacked to form a wall. The existing bulkhead has shifted and the applicant proposes to rebuild the wall along the NWL using 6" by 6" or 8" by 8" post every 10' to hold the pilings in place. The upstream limit of the repaired bulkhead will wingwall into the existing high ground and stops short of the adjoining wooded wetland. Ten wooden goins 25' in length are proposed spaced 50' apart. A 4' wide by 100' long pier will be build with a 20' by 10' T-head. A 10' wide by 24' long boat ramp is proposed which will attach to the top of the repaired bulkhead. We recommend that the following conditions be included in the State authorization: a. The bulkhead will be repaired on an alignment at or landward of the normal water elevation contour. To prevent an unintentional violation of this authorization, representatives of the North Carolina Division of Coastal Management and the Corps of Engineers will be available to stake the alignment prior to construction. b. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. c. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. d. No vegetated wetlands will be excavated or filled. e. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 1 a -2- f. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. g. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less are not considered significant.
